Extradition (Brazil) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Extradition (Foreign States) Act 1966.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Extradition (Brazil) Regulations.

2. After regulation 1 of the Principal Regulations the following regulation is inserted:

Interpretation

“1a. In these Regulations, ‘the Act’ means the Extradition (Foreign States) Act 1966.”.

Application of Act

3. Regulation 2 of the Principal Regulations is amended—

(a) by omitting “The Extradition (Foreign States) Act 1966-1974” and substituting “The Act”; and


(b) by adding at the end thereof the following sub-regulation:

“(2) The Act applies to the Federative Republic of Brazil subject also to the Single Convention on Narcotic Drugs, 1961 as subsequently amended (being the Convention referred to in, and a copy of the English text of which is set out in the Schedule to, the Extradition (Narcotic Drugs) Regulations.”.

Limitations, &c., in relation to application of Act

4. Regulation 3 of the Principal Regulations is amended—

(a) by omitting all words to and including “granted” and substituting “A person is not liable to be surrendered to the Federative Republic of Brazil in respect of an offence”;

(b) by omitting from paragraph (a) “for which extradition of the person is requested”;

(c) by omitting from paragraph (b) “for which extradition of the person is requested”; and

(d) by omitting “whose extradition is requested”.
