Primary Industries Levies and Charges Collection (Buffalo, Cattle and Live-stock) Regulations 19982 (Amendment)

I, WILLIAM PATRICK DEANE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Livestock Transactions Levy Act 1997 and the National Residue Survey (Sheep, Lambs and Goats Transactions) Levy Act 1997.

1.   Commencement

1.1   These Regulations (except regulations 5 and 6) commence on 1 July 1998, immediately after regulation 15 of Statutory Rules 1998 No. 126.

1.2   Regulations 5 and 6 commence on 3 July 1998, immediately after regulation 35 of Statutory Rules 1998 No. 126.

2.   Amendment

2.1   The Primary Industries Levies and Charges Collection (Buffalo, Cattle and Live-stock) Regulations 1998 are amended as set out in these Regulations.

3.   Regulation 50 (Rates of levy—sheep)

3.1   Add at the end:

 (4) For a sheep transaction to which subregulation (1) does not apply, or a delivery or slaughter of sheep referred to in paragraph 5 (1) (b), (c) or (d) of the Live-stock Transactions Levy Act:

 (a) the amount for paragraph 6 (1) (a) of that Act is 8.7 cents; and

 (b) the amount for paragraph 6 (1) (b) of that Act is 7.7 cents; and

 (c) the amount for paragraph 6 (1) (c) of that Act is 1.8 cents.

 (5) For a transaction or other dealing (within the meaning given by section 3 of the NRS (Sheep, Lambs and Goats Transactions) Levy Act) in relation to sheep, to which subregulation (1) does not apply, the amount for subsection 6 (1) of that Act is 1.8 cents per head.”.

4.   Regulation 51 (Rates of levy—lambs)

4.1   Add at the end:

 (4) For a lamb transaction to which subregulation (1) does not apply, or a delivery or slaughter of lambs referred to in paragraph 5 (1) (b), (c) or (d) of the Live-stock Transactions Levy Act:

 (a) the amount for paragraph 7 (a) of that Act is 62.6 cents; and

 (b) the amount for paragraph 7 (b) of that Act is 11.3 cents; and

 (c) the amount for paragraph 7 (c) of that Act is 1.4 cents.”.

 (5) For a transaction or other dealing (within the meaning given by section 3 of the NRS (Sheep, Lambs and Goats Transactions) Levy Act) in relation to lambs to which subregulation (1) does not apply, the amount for subsection 6 (1) of that Act is 4.7 cents per head.”.

5.   Regulation 50 (Rates of levy—sheep)

5.1   Subregulation 50 (5):

Omit the subregulation.

6.   Regulation 51 (Rates of levy—lambs)

6.1   Subregulation 51 (5):

Omit the subregulation.
