Navigation (Deck Cargo) Regulations2

(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Navigation Act 1912.

Commencement

1. These Regulations shall come into operation on 1 October 1986.

Notice of intention to load live stock or deck cargo

2. Regulation 6 of the Navigation (Deck Cargo) Regulations is amended—

(a) by omitting sub-regulation (6) and substituting the following sub-regulation:

“(6) Where, as a result of a request made by the owner, builder, master or agent of a ship, a surveyor engages in inspection of the ship when the authorized officer’s office in the State where the inspection is made is not open for public business, there is payable, in addition to any other fee payable by virtue of this sub-regulation—

(a) in a case in which such inspection by the surveyor during such a period immediately precedes, or immediately follows, inspection by the surveyor of that ship at a time when the authorized officer’s office in the State where the inspection is made is open for public business—a fee calculated at the rate of $35 for each whole hour or part of an hour falling within that period during which the surveyor so engages in inspection; or

(b) in any other case—a fee calculated at the rate of $35 for each whole hour or part of an hour falling within that period during which the surveyor so engages in inspection, or a fee of $105, whichever is the greater.”; and

(b) by omitting from sub-regulation (8) “$86” and substituting “$70”.
