Census and Statistics Amendment Act 1981

An Act to amend the Census and Statistics Act 1905
[Assented to 25 May 1981]
BE IT ENACTED by the Queen, and the Senate and the House of Representatives of the Commonwealth of Australia, as follows:
PART I—PRELIMINARY
Short title, &c.
1. (1) This Act may be cited as the Census and Statistics Amendment Act 1981.
(2) The Census and Statistics Act 19051 is in this Act referred to as the Principal Act.
Commencement
2. (1) This Part and section 4 shall come into operation on the day on which this Act receives the Royal Assent.
(2) The remaining provisions of this Act shall come into operation on 30 June 1981.
PART II—AMENDMENTS OF THE PRINCIPAL ACT
Interpretation
3. Section 3 of the Principal Act is amended—
(a) by inserting before the definition of “Dwelling” the following definition:
“‘Bureau’ means the Australian Bureau of Statistics established by the Australian Bureau of Statistics Act 1975;”; and
(b) by inserting after the definition of “Occupier” the following definition:
“‘officer’ means—
(a) a member of the staff of the Bureau referred to in sub-section 16 (1) of the Australian Bureau of Statistics Act 1975; and
(b) a person engaged in accordance with the regulations to assist in the carrying out of the functions of the Statistician;”.
Occupiers to fill up Householder’s Schedules
4. Section 11 of the Principal Act is amended by omitting “deliver the Schedule so filled up and signed to the Collector authorized to receive it” and substituting “cause the Schedule so filled up and signed to be delivered to the Collector authorized to receive it or to be furnished, in accordance with those instructions, to the Statistician”.
Collectors to assist in filling up Schedules
5. Section 13 of the Principal Act is amended by omitting all the words after “Schedule” (first occurring).
Powers of entry and inspection
6. Section 19 of the Principal Act is amended by omitting sub-section (2).
Untrue returns by officers
7. Section 23 of the Principal Act is repealed.
Secrecy
8. Section 24 of the Principal Act is amended by omitting “The Statistician, an officer, or the occupier of a dwelling,” and substituting “A person who is, or has been, the Statistician or an officer”.
Forgery of forms
9. Section 25 of the Principal Act is repealed.
Amendments relating to penalties
10. The Principal Act is amended as set out in the Schedule.
