STATES GRANTS (TERTIARY EDUCATION
ASSISTANCE) AMENDMENT ACT 1978

An Act to amend the States Grants (Universities Assistance) Act 1976, the States Grants (Advanced Education Assistance) Act 1976, the States Grants (Technical and Further Education Assistance) Act 1976 and the States Grants (Tertiary Education Assistance) Act 1977, and for related purposes.
BE IT ENACTED by the Queen, and the Senate and House of Representatives of the Commonwealth of Australia, as follows:
PART I—PRELIMINARY
Short title
1. This Act may be cited as the States Grants (Tertiary Education Assistance) Amendment Act 1978.
Commencement
2. This Act shall come into operation on the day on which it receives the Royal Assent.
PART II—AMENDMENTS OF STATES GRANTS (UNIVERSITIES ASSISTANCE) ACT 1976
Principal Act
3. The States Grants (Universities Assistance) Act 1976 is in this Part referred to as the Principal Act.
Schedules 1, 2, 3, 4 and 5
4. Schedules 1, 2, 3, 4 and 5 to the Principal Act are repealed and the Schedules set out in Schedule 1 to this Act are substituted.
Schedule 6
5. Schedule 6 to the Principal Act is amended by omitting paragraphs 1, 2 and 3 and substituting the paragraphs set out in Schedule 2 to this Act.
Schedule 7
6. Schedule 7 to the Principal Act is repealed and the Schedule set out in Schedule 3 to this Act is substituted.
Payments made before Royal Assent
7. Payments (including advances) by way of financial assistance made to a State under the Principal Act shall be deemed to have been made for the purposes of the Principal Act as amended by this Act.
PART III—AMENDMENTS OF STATES GRANTS
(ADVANCED EDUCATION ASSISTANCE) ACT 1976
Principal Act
8. The States Grants (Advanced Education Assistance) Act 1976 is in this Part referred to as the Principal Act.
Schedules 1 and 2
9. Schedules 1 and 2 to the Principal Act are repealed and the Schedules set out in Schedule 4 to this Act are substituted.
Determinations under Principal Act
10. A determination given by the Minister under sub-section 6(9) or (10) of the Principal Act shall, by force of this section, cease to have effect upon the commencement of this Act, but this section shall not be taken to affect the previous operation of the determination.
Payments before Royal Assent
11. Payments (including advances) by way of financial assistance made to a State under the Principal Act shall be deemed to have been made for the purposes of the Principal Act as amended by this Act.
PART IV—AMENDMENTS OF STATES GRANTS
(TECHNICAL AND FURTHER EDUCATION ASSISTANCE) ACT 1976
Principal Act
12. The States Grants (Technical and Further Education Assistance) Act 1976 is in this Part referred to as the Principal Act.
Schedules 3, 4 and 5
13. Schedules 3, 4 and 5 to the Principal Act are repealed and the Schedules set out in Schedule 5 to this Act are substituted.
Determinations under Principal Act
14. A determination given by the Minister under sub-section 9(5) of the Principal Act shall, by force of this section, cease to have effect upon the commencement of this Act, but this section shall not be taken to affect the previous operation of the determination.
Payments made before Royal Assent
15. Payments by way of financial assistance made to a State under the Principal Act shall be deemed to have been made for the purposes of the Principal Act as amended by this Act.
PART V—AMENDMENTS OF STATES GRANTS
(TERTIARY EDUCATION ASSISTANCE) ACT 1977
Principal Act
16. The States Grants (Tertiary Education Assistance) Act 1977 is in this Part referred to as the Principal Act.
Recurrent grants in respect of student residences and affiliated colleges
17. Section 9 of the Principal Act is amended—
(a) by omitting paragraph (a) of sub-section (2) and substituting the following paragraph:
“(a) an amount equal to the sum of $9,269 and the amount ascertained by multiplying $144.60 by the prescribed number of students for the year 1978 in relation to that student residence; or”;
(b) by omitting from paragraph (b) of sub-section (2) “$315.15” and substituting “$327.52”;
(c) by omitting from paragraph (a) of sub-section (4) “$315.15” and substituting “$327.52”;
(d) by omitting from paragraph (b) of sub-section (4) “$315.15 reduced by $2.38” and substituting “$327.52 reduced by $2.47”;
(e) by omitting from paragraph (c) of sub-section (4) “$255.69 reduced by $1.19” and substituting “$265.72 reduced by $1.24”; and
(f) by omitting from paragraph (d) of sub-section (4) “$225.96 reduced by $0.19” and substituting “$234.83 reduced by $0.20”.
Building projects, &c.
18. Section 11 of the Principal Act is amended by omitting from paragraph (b) of sub-section (8) “this section” and substituting “this Act”.
19. After section 11 of the Principal Act the following section is inserted:
Additional grants in respect of cost increases for major building projects of Universities
“11a. (1) Where, by reason of increases in the cost of an approved building project of a University, the expenditure on that project in respect of the year 1978 exceeds, or appears to the Minister likely to exceed, the amount of the approved expenditure on that project in respect of that year, there is payable to the State in which the University is situated, for the purpose of financial assistance in relation to that project, in addition to the amount payable in respect of the project under section 11, such amount as the Minister determines for the purposes of this section, not exceeding the amount of the excess or likely excess.
“(2) The total of the amounts payable to the States under sub-section (1) shall not exceed the amount specified in Part VII of Schedule 7.
“(3) Sub-sections 11(8) and (9) apply to a grant of financial assistance under this section as if that grant were a grant of financial assistance under section 11.
“(4) In this section—
(a) a reference to an approved building project of a University shall be read as a reference to—
(i) a building project specified in column 2 of Part I of Schedule 7 in relation to the University; or
(ii) a building project of the University approved by the Minister under paragraph 4(1)(a) as an approved building project of the University in respect of the year 1978; and
(b) a reference to the amount of the approved expenditure on a project in respect of the year 1978 shall be read as a reference to—
(i) where the project is a building project specified in column 2 of Part I of Schedule 7 in relation to a University—the amount specified in column 3 of Part I of that Schedule in relation to that project; or
(ii) where the project is a building project of a university approved by the Minister under paragraph 4(1)(a)—the amount of expenditure approved by the Minister under sub-section 4(3) as the amount of the approved expenditure on the project in respect of the year 1978.”.
Recurrent grants in respect of student residences and affiliated colleges
20. Section 17 of the Principal Act is amended—
(a) by omitting paragraph (a) of sub-section (2) and substituting the following paragraph:
“(a) an amount equal to the sum of $9,269 and the amount ascertained by multiplying $144.60 by the number of resident full-time students at the student residence, or at the student residences, as the case may be, in the year 1978; or”;
(b) by omitting from paragraph (b) of sub-section (2) “$315.15” and substituting “$327.52”;
(c) by omitting from paragraph (a) of sub-section (4) “$315.15” and substituting “$327.52”;
(d) by omitting from paragraph (b) of sub-section (4) “$315.15 reduced by $28.38” and substituting “$327.52 reduced by $2.47”;
(e) by omitting from paragraph (c) of sub-section (4) “$255.69 reduced by $1.19” and substituting “$265.72 reduced by $1.24”; and
(f) by omitting from paragraph (d) of sub-section (4) “$225.96 reduced by $0.19” and substituting “$234.83 reduced by $0.20”.
Building projects, &c.
21. Section 18 of the Principal Act is amended by omitting from paragraph (b) of sub-section (6) “this section” and substituting “this Act”.
22. After section 18 of the Principal Act the following section is inserted:
Additional grants in respect of cost increases for major building projects of colleges of advanced education
“18a. (1) Where, by reason of increases in the cost of an approved building project of a college of advanced education, the expenditure on that project in respect of the year 1978 exceeds, or appears to the Minister likely to exceed, the amount of the approved expenditure on that project in respect of that year, there is payable to the State in which the college is situated, for the purpose of financial assistance in relation to the project, in addition to the amount payable in respect of the project under section 18, such amount as the Minister determines for the purposes of this section, not exceeding the amount of the excess or likely excess.
“(2) The total of the amounts payable to a State under sub-section (1) shall not exceed the amount specified in column 2 of Part VIII of Schedule 7 opposite to the name of the State in column 1 of that Part.
“(3) Sub-sections 18(6) and (7) apply to a grant of financial assistance under this section as if that grant were a grant of financial assistance under section 18.
“(4) In this section—
(a) a reference to an approved building project of a college of advanced education shall be read as a reference to—
(i) a building project specified in column 2 of Part III of Schedule 7 in relation to the college; or
(ii) a building project of the college approved by the Minister under paragraph 4(1)(b) as an approved building project of the college in respect of the year 1978; and
(b) a reference to the amount of the approved expenditure on a project in respect of the year 1978 shall be read as a reference to–
(i) where the project is a building project specified in column 2 of Part III of Schedule 7 in relation to a college of advanced education—the amount specified in column 3 of Part III of that Schedule in relation to that project; or
(ii) where the project is a building project of a college of advanced education approved by the Minister under paragraph 4(1)(b)—the amount of expenditure approved by the Minister under sub-section 4(3) as the amount of the approved expenditure on the project in respect of the year 1978.”.
Building projects, &c.
23. Section 26 of the Principal Act is amended by omitting from paragraph (a) of sub-section (4) “this section” and substituting “this Act”.
24. After section 26 of the Principal Act the following section is inserted:
Additional grants in respect of cost increases for major building projects of technical and further education institutions
“26a. (1) Where, by reason of increases in the cost of an approved building project of a technical and further education institution, the expenditure on the project in respect of the year 1978 exceeds, or appears to the Minister likely to exceed, the amount of the approved expenditure on that project in respect of that year, there is payable to the State in which the institution is situated, for the purpose of financial assistance in relation to the project, in addition to the amount payable in respect of the project under section 26, such amount as the Minister determines for the purposes of this section, not exceeding the amount of the excess or likely excess.
“(2) The total of the amounts payable to a State under sub-section (1) shall not exceed the amount specified in column 3 of Part VIII of Schedule 7 opposite to the name of the State in column 1 of that Part.
“(3) Sub-sections 26(4) and (5) apply to a grant of financial assistance under this section as if the grant were a grant of financial assistance under section 26.
“(4) In this section—
(a) a reference to an approved building project of a technical and further education institution shall be read as a reference to—
(i) a building project specified in column 2 of Part V of Schedule 7 in relation to the institution; or
(ii) a building project of the institution approved by the Minister under paragraph 4(1)(c) as an approved building project of the institution in respect of the year 1978; and
(b) a reference to the amount of the approved expenditure on a project in respect of the year 1978 shall be read as a reference to-
(i) where the project is a building project specified in column 2 of Part V of Schedule 7 in relation to a technical and further education institution—the amount specified in column 3 of Part V of that Schedule in relation to that project; or
(ii) where the project is a building project of a technical and further education institution approved by the Minister under paragraph 4(1)(c)—the amount of expenditure approved by the Minister under sub-section 4(3) as the amount of the approved expenditure on the project in respect of the year 1978.”.
Variations of building grants in Schedule 7
25. Section 28 of the Principal Act is amended—
(a) by omitting from sub-section (1) “sub-sections (2), (3), (4) and (5)” and substituting “sub-sections (2), (3), (4), (5) and (5a)”;
(b) by omitting from sub-section (2) “sub-sections (1), (3), (4) and (5)” and substituting “sub-sections (1), (3), (4), (5) and (5a)”;
(c) by omitting from sub-section (3) “sections 11, 18 and 26” and substituting “sections 11, 18, 18a, 26 and 26a”;
(d) by omitting from paragraph (c) of sub-section (4) “section 11, 18 or 26” and substituting “section 11, 18, 18a, 26 or 26a”;
(e) by omitting from paragraph (b) of sub-section (5) “sections 11, 18 and 26 is greater or less than $132,607,000” and substituting “sections 11, 11a, 18, 18a, 26 and 26a is greater or less than $137,963,000”; and
(f) by inserting after sub-section (5) the following sub-section:
“(5a) A direction shall not be given under sub-section (1) or (2) in respect of the amount specified in Part VII of Schedule 7—
(a) that will have the effect of varying the amount in such a way that, after the variation, the aggregate of the amounts payable to the States under sections 11, 11a, 18, 18a, 26 and 26a is greater or less than $137,963,000; or
(b) that could result in a State becoming liable to repay an amount to the Commonwealth under this Act.”.
Payments may be made out of Consolidated Revenue Fund or Loan Fund
26. Section 33 of the Principal Act is amended by omitting from paragraph (a) “section 8, 11, 16, 18, 26 or 27” and substituting “section 8, 11, 11a, 16, 18, 18a, 26, 26a or 27”.
Authority to borrow
27. Section 34 of the Principal Act is amended by omitting “sections 8, 11, 16, 18, 26 and 27” and substituting “sections 8, 11, 11a, 16, 18, 18a, 26, 26a and 27”.
Application of moneys borrowed
28. Section 35 of the Principal Act is amended by omitting “section 8, 11, 16, 18, 26 or 27” and substituting “section 8, 11, 11a, 16, 18, 18a, 26, 26a or 27”.
Reimbursement of Consolidated Revenue Fund from Loan Fund
29. Section 36 of the Principal Act is amended by omitting from subsection (1) “section 8, 11, 16, 18, 26 or 27” and substituting “section 8, 11, 11a, 16, 18, 18a, 26, 26a or 27”.
Schedules
30. Schedules 1 to 14 (inclusive) to the Principal Act are repealed and the Schedules set out in Schedule 6 to this Act are substituted.
Directions under Principal Act
31. A direction given by the Minister under sub-section 14(3) or (4), 15(1), 23(1) or 28(1) of the Principal Act or by the Tertiary Education Commission under sub-section 15(2), 23(2) or 28(2) of that Act shall, by force of this section, cease to have effect upon the commencement of this Act, but this section shall not be taken to affect the previous operation of the direction.
Payments made before Royal Assent
32. Payments (including advances) by way of financial assistance made to a State under the Principal Act shall be deemed to have been made for the purposes of the Principal Act as amended by this Act.

New paragraphs 1, 2 and 3 to be inserted in Schedule 6 to the States Grants (Universities
Assistance) Act 1976
1. In relation to each hall of residence of a University, there is payable under sub-section 8(1) to the State in which the University is situated, in respect of the year 1977—
(a) an amount equal to the sum of $8,917 and the amount ascertained by multiplying $139.10 by the prescribed number of students in relation to that hall of residence: or
(b) an amount ascertained by multiplying $315.06 by the prescribed number of students in relation to that hall of residence,
whichever is the lesser amount
2. In relation to each residential college of a University there is payable under sub-section 8(1) to the State in which the University is situated an amount ascertained by multiplying the basic grant in respect of that college by the prescribed number of students in relation to that college.
3. For the purposes of paragraph 2, the basic grant in respect of a residential college is—

(a) if the prescribed number of students in relation to that college is less than 50—$315.06,
(b) if the prescribed number of students in relation to that college is more than 49 but less than 75—$315.06 reduced by $2.38 for each student by which the prescribed number of students exceeds 50;
(c) if the prescribed number of students in relation to that college is more than 74 but less than 100—$255.61 reduced by $1.19 for each student by which the prescribed number of students exceeds 75; and
(d) if the prescribed number of students in relation to that college is more than 99—$225.89 reduced by $0.19 for each student by which the prescribed number of students exceeds 100.

METHOD OF ASCERTAINING GRANT FOR 1977 IN RESPECT OF A STUDENT RESIDENCE OR AN AFFILIATED COLLEGE
1. In relation to each college of advanced education providing collegiate accommodation at a student residence or at student residences, there is payable under section 7(1) to the State in which the college of advanced education is situated, in respect of the year 1977—
(a) an amount equal to the sum of $8,917 and the amount ascertained by multiplying $139.10 by the number of resident full-time students at that student residence, or those student residences, as the case may be, or
(b) an amount ascertained by multiplying $315.06 by the number of resident full-time students at that student residence, or those student residences, as the case may be,
whichever is the lesser amount.
2. In relation to each affiliated college of a college of advanced education, there is payable under sub-section 7 (1) to the State in which the college of advanced education is situated an amount ascertained by multiplying the basic grant in respect of that affiliated college by the number of resident full-time students at that affiliated college.
3. For the purpose of paragraph 2, the basic grant in respect of an affiliated college is—
(a) if the number of resident full-time students at the college is less than 50—$315.06;
(b) if the number of resident full-time students at the college is more than 49 but less than 75—$315.06 reduced by $2.38 for each student by which that number of students exceeds 50;
(c) if the number of resident full-time students at the college is more than 74 but less than 100—$255.61 reduced by $1.19 for each student by which that number of students exceeds 75;
(d) if the number of resident full-time students at the college is more than 99—$225.89 reduced by $0.19 for each student by which that number of students exceeds 100.
4. Where a student residence or affiliated college or a part of such a residence or college was not in use during the whole of the academic year comprised in the year 1977, the Commission may determine that an amount payable under sub-section 7 (1) in respect of that year in relation to that residence or college shall be such part only of the amount that would otherwise be payable as the Commission thinks appropriate.
