AIR NAVIGATION (CHARGES) AMENDMENT
ACT 1976
An Act to amend the Air Navigation (Charges) Act 1952.
BE IT ENACTED by the Queen, and the Senate and House of Representatives of the Commonwealth of Australia, as follows:—
Short title, & c.
1. (1) This Act may be cited as the Air Navigation (Charges) Amendment Act 1976.
(2) The Air Navigation (Charges) Act 1952 is in this Act referred to as the Principal Act.
Commencement.
2. This Act shall come into operation on 1 December 1976.
Air navigation charges.
3. Section 5 of the Principal Act is amended by adding at the end thereof the following sub-sections:—
“(2) Where the liability of a person to pay a charge under this Act is not discharged within 45 days after the day on which that charge became due and payable, that person is liable to pay to the Commonwealth, by way of penalty, in addition to the amount of that charge, an amount calculated at the rate of 10 per centum per annum upon the amount of that charge remaining unpaid, to be computed from the day on which that charge became due and payable.
“(3) The following amounts may be recovered by the Commonwealth as debts due to the Commonwealth:—
(a) a charge that is due and payable under this Act; and
(b) an amount payable by way of penalty under sub-section (2).”.
Regulations.
4. Section 6 of the Principal Act is amended by inserting in sub-section (2), after the word and figure “paragraph 4”, the word and figure “or 6”.
Schedule 1—paragraph 4.
5. Paragraph 4 of Schedule 1 to the Principal Act is amended—
(a) by omitting from clause (a) of sub-paragraph (1) the words “the second column” and substituting the words “Column 2 of Part I”;
(b) by omitting from clause (a) of sub-paragraph (1) the words “the third column” and substituting the words “Column 3 of that Part”;
(c) by inserting in clause (a) of sub-paragraph (1a), after the words “prescribed in”, the words “Part I of”;
(d) by inserting in clause (a) of sub-paragraph (2), after the words “an item in”, the words “Part I of”;
(e) by omitting from sub-paragraph (2) the words “the second column” and substituting the words “Column 2 of that Part”; and
(f) by inserting in sub-paragraph (3), after the words “A reference in”, the words “Part I of”.
Schedule 1—paragraph 5.
6. Paragraph 5 of Schedule 1 to the Principal Act is amended by inserting after the words “an item in” the words “Part I of”.
Schedule 1—paragraph 6.
7. Paragraph 6 of Schedule 1 to the Principal Act is amended by omitting sub-paragraph (3) and substituting the following subparagraphs:—
“(3) The amount of a charge payable under this paragraph is—
(a) in the case of a landing or take-off at a place in Australia specified in Part II of the Table in this Schedule—the amount ascertained by multiplying the unit charge for the aircraft by the factor applicable in accordance with that Part of that Table in relation to the flight completed by that landing or commenced by that take-off, as the case may be;
(b) in the case of a landing or take-off in connexion with a flight in respect of which a factor is prescribed by the Regulations for the purposes of this paragraph—the amount ascertained by multiplying the unit charge for the aircraft by the factor so prescribed; or
(c) in the case of any other landing or take-off—the amount ascertained by multiplying the unit charge for the aircraft by 8.
“(4) For the purposes of this paragraph and of Part II of the Table in this Schedule—
(a) where the last stopping place of an aircraft before it lands at a place in Australia was a place outside Australia, the landing shall be deemed to constitute the completion of a flight that commenced at that last stopping place; and
(b) where the first intended stopping place of an aircraft that takes off at a place in Australia is a place outside Australia, the take-off shall be deemed to constitute the commencement of a flight ending at that first intended stopping place.
“(5) In Part II of the Table in this Schedule—
‘eastern zone’ means the area bounded by a line commencing at the intersection of the parallel 25° south latitude and the meridian 135° east longitude, thence bearing generally north-easterly to the intersection of the parallel 10° north latitude and the meridian 180° longitude, thence bearing north along that meridian to the North Pole, thence bearing south along the meridian 30° west longitude to the South Pole, thence bearing north along the meridian 135° east longitude to the point of commencement;
‘northern zone’ means the area bounded by a line commencing at the intersection of the parallel 25° south latitude and the meridian 135° east longitude, thence bearing north along that meridian to the North Pole, thence bearing south along the meridian 180° longitude to its intersection with the parallel 10° north latitude, thence bearing generally south-westerly to the point of commencement;
‘north-western zone’ means the area bounded by a line commencing at the intersection of the parallel 25° south latitude and the meridian 135° east longitude, thence bearing north along that meridian to the North Pole, thence bearing south along the meridian 30° west longitude to its intersection with the parallel 30° north latitude, thence bearing generally south-easterly to the point of commencement;
‘western zone’ means the area bounded by a line commencing at the intersection of the parallel 25° south latitude and the meridian 135° east longitude, thence bearing generally north-westerly to the intersection of the parallel 30° north latitude and the meridian 30° west longitude, thence bearing south along that meridian to the South Pole, thence bearing north along the meridian 135° east longitude to the point of commencement.
“(6) For the purposes of Part II of the Table in this Schedule, a place shall, subject to sub-paragraph (7), be taken to be in the zone referred to in that Part in which the airport serving that place is, or the airports serving that place are, situated.
“(7) Where, by reason that—
(a) an airport serving a place is situated partly in one zone referred to in Part II of the Table in the Schedule and partly in another zone so referred to; or
(b) one of 2 or more airports serving a place is situated wholly or partly in one zone so referred to and another of those airports is situated wholly or partly in another zone so referred to,
2 or more factors would, but for this sub-paragraph, be applicable in accordance with that Part of that Table in relation to a particular flight, the factor applicable to that flight is the lower or the lowest of those factors”.
Schedule 1—paragraph 7.
8. Paragraph 7 of Schedule 1 of the Principal Act is amended by omitting sub-paragraph (1) and substituting the following subparagraph:—
“(1) The unit charge for an aircraft is—
(a) if the weight of the aircraft is not more that 700 kilogrammes—9 cents;
(b) if the weight of the aircraft is more that 700 kilogrammes but not more than 9,000 kilogrammes—15.2 cents for each 450 kilogrammes, or part of 450 kilogrammes, of the weight of the aircraft;
(c) if the weight of the aircraft is more than 9,000 kilogrammes but not more than 20,000 kilogrammes—$3.04 plus 36.4 cents for each 500 kilogrammes, or part of 500 kilogrammes, by which the weight of the aircraft exceeds 9,000 kilogrammes;
(d) if the weight of the aircraft is more than 20,000 kilogrammes but not more than 100,000 kilogrammes—$11.05 plus 44.8 cents for each 500 kilogrammes, or part of 500 kilogrammes, by which the weight of the aircraft exceeds 20,000 kilogrammes; or
(e) if the weight of the aircraft is more than 100,000 kilogrammes—$82.73 plus 41.5 cents for each 500 kilogrammes, or part of 500 kilogrammes, by which the weight of the aircraft exceeds 100,000 kilogrammes.”.
Schedule 1—paragraph 9.
9. Paragraph 9 of Schedule 1 to the Principal Act is repealed and the following paragraph substituted:—
“9. A charge under this Schedule becomes due and payable at the expiration of 28 days after the end of the month in which the flight, landing or take-off to which the charge relates was completed.”.
Schedule 1—Table of Flights.
10. The Table of Flights contained in Schedule 1 to the Principal Act is repealed and the following table substituted:—

Schedule 2—paragraph 2.
11. Paragraph 2 of Schedule 2 to the Principal Act is amended by omitting from sub-paragraph (1) the words “charge is payable” and substituting the words “charge becomes due and payable”.
Schedule 2—paragraph 5.
12. Paragraph 5 of Schedule 2 to the Principal Act is amended by adding at the end thereof the following sub-paragraph:—
“(2) Sub-paragraph (1) does not apply in relation to a change in the ownership of, or of the interests of persons in, a registered aircraft that takes place on or after 1 December 1976”.
Schedule 2—paragraph 10.
13. Paragraph 10 of Schedule 2 to the Principal Act is amended by omitting sub-paragraph (1a) and substituting the following subparagraph:—
“(1a) Where it is shown to the satisfaction of a person authorized under sub-paragraph (1) to authorize remissions or refunds of the whole or any part of charges payable or paid under this Schedule that—
(a) between flights made by an aircraft during a year in respect of which a charge is payable under this Schedule in respect of that aircraft, that aircraft will not be, or was not, as the case may be, ordinarily kept at an aerodrome operated by the Commonwealth or in respect of which the Commonwealth provides financial assistance; and
(b) less than one-half of the total number of those flights will be, or were, flights commencing by take-off from, or ending by landing at, such an aerodrome,
that person shall authorize a remission or refund, as the case may be, of one-half of the amount of the charge payable under this Schedule in respect of that aircraft in respect of that year”.
Schedule 2—paragraph 11.
14. Paragraph 11 of Schedule 2 to the Principal Act is amended by omitting from sub-paragraph (2) the words “four weeks” and substituting the figure and word “3 months’’.

15. Paragraph 12 of Schedule 2 to the Principal Act is repealed and the following paragraph substituted:—

A charge in respect of an aircraft that is payable under this Schedule in addition to the charge payable in respect of that aircraft under paragraph 2 becomes due and payable at the expiration of 28 days after the end of the month in which the aircraft first became engaged in the operations by reason of the engagement in which the additional charge is payable”.
Schedule 3— paragraph 4.
16. Paragraph 4 of Schedule 3 to the Principal Act is amended—
(a) by omitting clause (a); and
(b) by omitting from clause (c) the words “are payable” and substituting the words “become due and payable ”.
Application of amendments.
17. (1) To the extent that the amendment made by section 8 affects a charge payable in respect of a year of registration of an aircraft or a charge payable by the owner of a foreign aircraft in respect of a week or part of a week, that amendment applies in the case of such a charge that is payable in respect of a year, or in respect of a week or part of a week, commencing on or after 1 December 1976.
(2) The amendment made by section 13 applies in relation to charges paid or payable in respect of a year of registration of an aircraft commencing on or after 1 December 1976.
(3) The amendment made by section 14 does not affect any entitlement to a refund accruing before 1 December 1976.
