STATES GRANTS (ADVANCED EDUCATION) AMENDMENT ACT 1976
An Act to amend the States Grants (Advanced Education) Act 1972-1975.
BE IT ENACTED by the Queen, and the Senate and House of Representatives of the Commonwealth of Australia, as follows:—
Short title and citation.
1. (1) This Act may be cited as the States Grants (Advanced Education) Amendment Act 1976.
(2) The States Grants (Advanced Education) Act 1972-1975 is in this Act referred to as the Principal Act.
(3) The Principal Act, as amended by this Act, may be cited as the States Grants (Advanced Education) Act 1972-1976.
Commencement.
2. This Act shall come into operation on the day on which it receives the Royal Assent.
Grant for course in social work.
3. Section 7b of the Principal Act is amended by omitting from paragraph (b) of sub-section (3) the figures “$123,080” and substituting the figures “$127,570”.
Grants for colleges conducting pre-school teachers’ courses.
4. Section 7e of the Principal Act is amended by omitting from sub-section (2) the figures “$457,410” and substituting the figures “$462,700”.
Grant in relation to Western Australian Institute of Technology.
5. Section 7f of the Principal Act is amended by omitting from sub-section (2) the figures “$258,600” and substituting the figures “$259,600”.
Grant to Victoria in connexion with certain new courses.
6. Section 7g of the Principal Act is amended by omitting from sub-section (1) the figures “$880,550” and substituting the figures “$894,430”.
Grant in relation to State College of Victoria, Toorak.
7. Section 7h of the Principal Act is amended by omitting from sub-section (2) the figures “$94,240” and substituting the figures “$96,050”.
Grants for postgraduate diploma courses in recreation leadership.
8. Section 7j of the Principal Act is amended by omitting from sub-section (2) the figures “$82,670” and substituting the figures “$83,820”.
Grants for associate diploma courses in recreation leadership.
9. Section 7k of the Principal Act is amended by omitting from sub-section (2) the figures “$157,800” and substituting the figures “$162,000”.
Supplementary grants for Riverina College of Advanced Education.
10. Section 7m of the Principal Act is amended—
(a) by omitting from sub-section (3), the words “or capital expenditure”, and substituting the words “, or during the year 1975 or a subsequent year by way of capital expenditure,”; and
(b) by omitting sub-section (4) and substituting the following sub-section:—
“(4) The Minister shall cause a statement of the approvals given under this section in a year, being the year ended on 31 December 1975 or a subsequent year, to be laid before each House of the Parliament as soon as practicable after the end of that year.”.
Recurrent grants in respect of student residences and affiliated colleges.
11. Section 8 of the Principal Act is amended by omitting sub-sections (2), (3) and (4) and substituting the following sub-sections:—
“(2) In relation to each student residence, there is payable to a State—
(a) in respect of the year 1973—$5,000;
(b) in respect of the year 1974—$6,130; and
(c) in respect of the year 1975—$7,150.
“(3) In relation to each affiliated college, there is payable to a State in respect of the year 1973, the year 1974 or the year 1975 the amount that is specified in the following table in respect of that year in relation to the number of resident full-time students of the college in that year:—

“(4) In addition to the amount payable in accordance with sub-section (2) or sub-section (3), there is payable to a State in respect of the year 1973, the year 1974 or the year 1975, in relation to each student residence or affiliated college, an amount calculated by multiplying—
(a) in the case of the year 1973—$60;
(b) in the case of the year 1974—$73.60; or
(c) in the case of the year 1975—$85.80,
by the number of resident full-time students of the student residence or affiliated college in that year.
Building grants in respect of student residences and affiliated colleges in country areas.
12. Section 9 of the Principal Act is amended by omitting from sub-section (2) the words “, during the years 1974 and 1975”.
Building grants in respect of student residences and affiliated colleges providing non-collegiate accommodation.
13. Section 10 of the Principal Act is amended—
(a) by omitting from sub-section (2) the words during the years 1974 and 1975”; and
(b) by omitting from sub-section (2a) the figures “$1,000,000” and substituting the figures “$1,560,000”.
Additional conditions
14. Section 11 of the Principal Act is amended—
(a) by omitting from paragraph (e) the words “to which this Act applies”; and
(b) by adding at the end thereof the following sub-section:—
“(2) In sub-section (1), ‘year’ means a period of 12 months ending on a 31 December.”.
15. Section 14 of the Principal Act is repealed and the following sections are substituted:—
Payments out of Consolidated Revenue Fund and Loan Fund.
“14. Payments to a State under this Act may be made out of—
(a) in the case of payments in accordance with section 6, 6a, 6b, 7, 7c, 9 or 10, or of sub-section (2) of section 7m, and of payments by way of advances under section 12 on account of moneys expected to become payable in accordance with such a section or sub-section—the Consolidated Revenue Fund or the Loan Fund; or
(b) in any other case—the Consolidated Revenue Fund.
Authority to borrow.
“15. The Treasurer may, from time to time, in accordance with the provisions of the Commonwealth Inscribed Stock Act 1911-1973, or in accordance with the provisions of an Act authorizing the issue of Treasury Bills, borrow moneys not exceeding in the aggregate the sum of the amounts that have been paid since 30 June 1975, or that may become payable, in accordance with the following sections and sub-section namely, sections 6, 6a, 6b, 7, 7c, 9 and 10 and sub-section (2) of section 7m.
Application of moneys borrowed.
“16. Moneys borrowed under section 15 shall be issued and applied only for the expenses of borrowing, for the purpose of making payments to the States in accordance with a section or sub-section specified in section 15, for the purpose of making advances to the States in accordance with section 12 on account of moneys that are expected to become payable under a section or sub-section so specified and for the purpose of making payments to the Consolidated Revenue Fund in accordance with section 17.
Reimbursement of Consolidated Revenue Fund from Loan Fund.
“17. (1) Where an amount has, after 30 June 1975, been paid out of the Consolidated Revenue Fund in accordance with a section or subsection specified in section 15, or by way of an advance in accordance with section 12 on account of moneys expected to become payable in accordance with a section or sub-section so specified, the Treasurer may authorize the payment to that Fund, out of the Loan Fund, of an amount not exceeding the amount so paid.
“(2) In any statements of the receipts and expenditure, or of the expenditure, of the Consolidated Revenue Fund prepared by the Treasurer under section 49 or 50 of the Audit Act 1901-1975, amounts paid to the Consolidated Revenue Fund under sub-section (1) of this section shall not be shown as receipts of that Fund but shall be shown as having reduced the total of the amounts expended from that Fund under this Act.
Appropriation.
“18. The Consolidated Revenue Fund and the Loan Fund are appropriated as necessary for the purposes of this Act.”.
Schedules First to Fifth (inclusive).
16. The First, Second, Third, Fourth and Fifth Schedules to the Principal Act are repealed and the Schedules set out in Schedule 1 to this Act are substituted.
Seventh Schedule.
17. The Seventh Schedule to the Principal Act is repealed and the Schedule set out in Schedule 2 to this Act is substituted.
