REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1971.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1971.

Amendments of the Naval Forces (Papua and New Guinea Division) Regulations

Commencement.

1. These Regulations shall come into operation on the ninth day of February, 1973.

Pay.

2. Regulation 8 of the Naval Forces (Papua and New Guinea Division) Regulations is amended—

(a) by omitting from sub-regulation (3e.) the words “Eighty-eight cents” and inserting in their stead the words “One dollar thirty-seven cents”; and

(b) by omitting sub-regulation (3f.) and inserting in its stead the following sub-regulation:—

(3f.) Subject to the succeeding sub-regulations of this regulation, the rate of pay of a sailor who holds the rank of ordinary seaman is—

(a) in the case of a sailor who has less than one year’s pay seniority—

(i) if he has not attained the age of twenty years and is unmarried—One dollar forty-eight cents per day;

(ii) if he has attained the age of twenty years but has not attained the age of twenty-one years and is unmarried—One dollar sixty-two cents per day; or

(iii) in any other case—One dollar seventy-six cents per day;

(b) in the case of a sailor who has not less than one year’s pay seniority but less than two years’ pay seniority—

(i) if he has not attained the age of twenty-one years and is unmarried—One dollar sixty-two cents per day; or

(ii) in any other case—One dollar seventy-six cents per day; and

(c) in the case of a sailor who has not less than two years’ pay seniority—One dollar seventy-six cents per day.”.

Living out allowance.

3. Regulation 16 of the Naval Forces (Papua and New Guinea Division) Regulations is amended by omitting from sub-regulation (1.) the words “Fifty-four cents” and inserting in their stead the words “Seventy-two cents”.

Family needs allowance.

4. Regulation 18a of the Naval Forces (Papua and New Guinea Division) Regulations is amended by adding at the end thereof the following sub-regulations:—

“(4.) Subject to the next succeeding sub-regulation, family needs allowance is not payable to a member who enlisted or enlists in, or was appointed or is appointed an officer of, the Naval Forces on or after the seventh day of December, 1972.

“(5.) Where—

(a) a member has been appointed an officer of the Naval Forces on or after the seventh day of December, 1972;

(b) the member was, immediately before having been so appointed, discharged from the Naval Forces for the purposes of being appointed an officer; and

(c) the member enlisted or last enlisted in the Naval Forces before the seventh day of December, 1972,

the last preceding sub-regulation does not apply in relation to the member.”.

Second, Third and Fourth Schedules.

5. The Second, Third and Fourth Schedules to the Naval Forces (Papua and New Guinea Division) Regulations are repealed and the following Schedules inserted in their stead:—

Application.

6.—(1.) Subject to the next succeeding sub-regulation, the rates of pay provided for under the Naval Forces (Papua and New Guinea Division) Regulations as amended by these Regulations apply to and in relation to service, on and after the twenty-third day of November, 1972, in relation to which those first-mentioned regulations apply.

(2.) The last preceding sub-regulation does not apply in relation to the rates provided for in the Fourth Schedule to the Naval Forces (Papua and New Guinea Division) Regulations as amended by these Regulations.

(3.) The rate specified in regulation 16 of the Naval Forces (Papua and New Guinea Division) Regulations as amended by regulation 3 of these Regulations applies to and in relation to living out allowance paid or payable in accordance with those first-mentioned Regulations in respect of the twenty-sixth day of January, 1973, or any subsequent day.

(4.) A member to whom the Naval Forces (Papua and New Guinea Division) Regulations apply, being a member who was in receipt of pay in respect of a day in the period from and including the twenty-third day of November, 1972, to and including the twenty-fifth day of January, 1973, is, by virtue of this sub-regulation, entitled to be paid an amount of Six cents as additional pay in respect of his service on that day.
