REGULATIONS UNDER THE DEFENCE ACT 1903-1970.*

Amendments of the Military Financial Regulations

Consolidated rates of pay.

1. Regulation 11 of the Military Financial Regulations is amended by omitting sub-regulation (3.) and inserting in its stead the following sub-regulation:—

“(3.) The rate at which pay is payable to a male officer who is a medical officer or a dental officer and holds a rank specified in the following table is the consolidated rate specified in that table in relation to the rank that he holds.

(3.) Regulation 12 of the Military Financial Regulations is amended by omitting from sub-regulation (3.) the words “Twelve dollars seventy-three cents” and inserting in their stead the words “Thirteen dollars sixty-nine cents.”

(4.) Regulation 12 of the Military Financial Regulations is amended by omitting sub-regulation (4.) and inserting in its stead the following sub-regulation:—

“(4.) The rate of pay per day of an officer, being an officer holding the rank of captain and having not less than 8 years’ service in the rank, who is qualified for promotion to the rank of major and is included on the Administrative and Technical Officers List of a Corps is Seventeen dollars ninety-one cents.”.


(5.) Regulation 12 of the Military Financial Regulations is amended by omitting from sub-regulation (5.) the words “ Five dollars twenty-four cents” and inserting in their stead the words “Five dollars forty-nine cents “.

(6.) Regulation 12 of the Military Financial Regulations is amended by omitting the table in sub-regulation (6.) and inserting in its stead the following table:—

Rates of higher duties allowance.

5. Regulation 29 of the Military Financial Regulations is amended—

(a) by omitting sub-regulations (4.) and (5.) and inserting in their stead the following sub-regulations:—

“(4.) Where—

(a) the member is entitled to payment of higher duties allowance for the performance of the duties of a position;

(b) the member is not in receipt of pay at a consolidated rate; and

(c) pay would be payable to the member at a consolidated rate if he were promoted to the relevant rank,

the amount of higher duties allowance so payable to the member in respect of each day for which he is entitled to be paid the allowance is the amount by which one three hundred and sixty-fifth part of the consolidated rate at which pay would be payable to the member if he were promoted to the relevant rank exceeds an amount equal to the sum of the rate of pay per day at which pay is payable to the member and the rate per day at which each allowance, being an allowance that would not be payable to the member if he were promoted to the relevant rank, payable to the member under this Part is so payable.

“(5.) Where—

(a) a member is entitled to payment of higher duties allowance for the performance of the duties of a position;

(b) the member is in receipt of pay at a consolidated rate; and

(c) the member would be entitled to be paid pay at a consolidated rate if he were promoted to the relevant rank.

the amount of higher duties allowance so payable to the member in respect of each day for which he is entitled to be paid the allowance is the amount by which one three hundred and sixty-fifth part of the consolidated rate at which pay would be payable to the member if he were promoted to the relevant rank exceeds one three hundred and sixty-fifth part of the consolidated rate at which pay is payable to the member.”; and

(b) by omitting sub-regulations (8.) and (9.).

Flying allowance.

6.—(1.) Regulation 33 of the Military Financial Regulations is amended by omitting sub-regulation (3.) and inserting in its stead the following sub-regulations:—

“(3.) Subject to the next succeeding sub-regulation, the rate at which flying allowance is payable to a member is—

(a) in the case of a member who is eligible for payment of the allowance under paragraph (a) of sub-regulation (1.) of this regulation—One dollar twenty-three cents per day; or

(b) in the case of a member who is eligible for payment of the allowance under paragraph (b) of sub-regulation (1.) of this regulation—the rate per day specified in the second column of the following table in relation to the rank of the member and, where applicable, his length of service in that rank in the first column of that table.

“(4.) Where a member is in receipt of flying allowance in respect of a day and the condition specified in the next succeeding sub-regulation is fulfilled in relation to payment of increased flying allowance in respect of that day, the rate at which flying allowance would, but for this sub-regulation, be payable to the member in respect of the day is, by force of this sub-regulation, increased by Fifteen cents.

“(5.) For the purposes of the last preceding sub-regulation, the condition in relation to the payment of increased flying allowance in respect of a day (in this regulation called the relevant day’) is that a certificate, under the hand of the member, has been furnished to the member’s Commanding Officer certifying that—

(a) on a specified day, being the relevant day or a day not more than six months before the relevant day, a policy of insurance was in force under which provision was made for the payment of a benefit in the event of the occurrence of the member’s death by accident, or of his injury or disability caused by accident, occurring while the member was flying in the course of performing his duties as a pilot or trainee pilot in the Australian Military Forces; and

(b) the amount of premium payable under the policy in respect of that benefit for any period was not less than the sum. calculated at the rate of Fifteen cents for each day in the period.”.

(2.) Where a member of the Permanent Military Forces was in receipt of flying allowance in respect of a day in the period from and including the third day of July, 1970, to and including the day immediately before the commencement of these Regulations and the amount of flying allowance that would have been payable to him in respect of that day if the amendment of regulation 33 of the Military Financial Regulations effected by sub-regulation (1.) of this regulation had come into operation on the third day of July, 1970, exceeds the amount of flying allowance paid or payable to him in respect of that day, the member is, by force of this sub-regulation, entitled to be paid an amount equal to the excess.


(3.) For the purpose of ascertaining the amount of flying allowance that would have been payable to a member in respect of a day in the period referred to in the last preceding sub-regulation if the amendment referred to in that sub-regulation had come into operation on the third day of July, 1970, a certificate furnished by the member to his Commanding Officer after the commencement of these Regulations under regulation 33 of the Military Financial Regulations as amended by this regulation, being a certificate that specifies a day in that period as the day on which there was in. force in relation to the member an insurance policy of a kind referred to in sub-regulation (5.) of regulation 33 of the Military Financial Regulations as so amended has effect as if the amendment of regulation 33 effected by this regulation had come into operation on the third day of July, 1970.

8. Regulation 210 of the Military Financial Regulation is amended by omiting sub-regulation (3.) and inserting in its stead the following sub-regulation:—

“(3.) An allowance under this regulation is not payable to—

(a) a member referred to in regulation 189 of these Regulations;

(b) a member who holds the rank of Major-General or Brigadier and is entitled to pay as provided by regulation 190 of these Regulations;

(c) a male medical officer or dental officer who holds the rank of Colonel or Lieutenant-Colonel and is entitled to pay as provided by regulation 190 of these Regulations; or

(d) a member serving in the Papua and New Guinea Volunteer Rifles who is not entitled to expatriate allowance under regulation 198 of these Regulations.”.


9. The Second and Third Schedules to the Military Financial Regulations are repealed and the following Schedules inserted in their stead:—

Transitional.

10.—(1.) The rates of pay provided for in the Military Financial Regulations as amended by sub-regulations (1.), (3.), (4.), (5.) and (6.) of regulation 2, regulations 3 and 4, sub-regulations (1.), (3.) and (4.) of regulation 7 and regulation 9 of these Regulations apply to and in relation to service in the Permanent Military Forces and the Citizen. Military Forces, as the case may be, on and after the eleventh day of September, 1970.

(2.) A male medical officer or dental officer in receipt of pay in respect of his service on a day in the period from and including the eleventh day of September, 1970, to and including the day immediately before the commencement of these Regulations in accordance with sub-regulation (2.) of regulation 12 or sub-regulation (2.) of regulation 190 of the Military Financial Regulations, being a male officer who held the rank of Major or Captain on that day, is, by force of this sub-regulation, entitled to be paid pay in respect of that day at the rate specified in sub-regulation (2.) of regulation 12 or sub-regulation (2.) of regulation 190, as the case may be, of the Military Financial Regulations as amended by these Regulations in relation to the rank that he held on that day and, where relevant, his length of service in that rank on that day instead of at the rate applicable under the Military Financial Regulations as in force on that day.

(3.) A male medical officer or dental officer in receipt of pay in respect of his service on a day in the period from and including the eighteenth day of December, 1969, to and including the tenth day of September, 1970, in accordance with sub-regulation (2.) of regulation 12 or sub-regulation (2.) of regulation 190 of the Military Financial Regulations, being a male officer who held the rank of Major or Captain on that day, is, by force of this sub-regulation, entitled to be paid pay in respect of that day at the rate specified in the second column or third column, whichever is appropriate, of the following table in relation to the rank that he held on that day and, subject to the next succeeding sub-regulation, his length of service in that rank on that day instead of at the rate applicable under the Military Financial Regulations as in force on that day.

(4.) For the purpose of the last preceding sub-regulation, a male medical officer or dental officer in receipt of pay, in accordance with sub-regulation (2.) of regulation 190 of the Military Financial Regulations, in respect of his service on a day in the period specified in the last preceding sub-regulation shall be deemed to have had less than one year’s service in his rank on that day.


(5.) Where a male medical officer or dental officer held during the period from and including the eighteenth day of December, 1969, to and including the day immediately before the commencement of these Regulations or during a part of that period the rank of Colonel or Lieutenant-Colonel, the member is entitled to be paid in respect of his. service during that period while holding such a rank, as additional pay, an amount equal to the amount by which the sum of the pay and allowances paid or payable to him in respect of that service is less than the sum of the pay and allowances that would have been payable to him in respect of that service if the Military Financial Regulations as amended by Statutory Rules 1970, No. 133, and these Regulations had been in force throughout that period.

(6.) In calculating the amount of pay and allowances that would have been payable to a member of the medical branch or dental branch in respect of service to which the last preceding sub-regulation relates under the Military Financial Regulations as amended by Statutory Rules 1970, No. 133, and these Regulations, it shall be assumed—

(a) that the amount specified in the table in. sub-regulation (3.) of regulation 12 of the Military Financial Regulations as so amended in relation to the rank of Colonel was—

(i) on the eighteenth day of December, 1969—Twelve thousand nine hundred and thirty-five dollars; and

(ii) on and after the nineteenth day of December, 1969—Thirteen thousand three hundred and twenty-three dollars;

(b) that the amount specified in that table in relation to the rank of Lieutenant-Colonel was—

(i) on the eighteenth day of December, 1969—Eleven thousand nine hundred and sixty dollars; and

(ii) on and after the nineteenth day of December, 1969—Twelve thousand three hundred and nineteen dollars;

(c) that the amount specified in the table in sub-regulation (2.) of regulation 190 of the Military Financial Regulations as so amended in relation to the rank of Colonel was—

(i) on the eighteenth day of December, 1969—Thirty-five dollars forty-four cents; and

(ii) on and after the nineteenth day of December, 1969—Thirty-six dollars fifty cents; and

(d) that the amount specified in that last-mentioned table m relation to the rank of Lieutenant-Colonel was—

(i) on the eighteenth day of December, 1969—Thirty-two dollars seventy-seven cents; and

(ii) on and after the nineteenth day of December, 1969—Thirty-three dollars seventy-five cents.

(7.) Subject to sub-regulations (9.), (10.), (11.) and (12.) of regulation 190 of the Military Financial Regulations, where, on a day in the transitional period, a male member, within the meaning of Part IV. of the Military Financial Regulations—

(a) served in the Citizen Military Forces otherwise than on continuous full time military service in relation to which regulation 190a of the Military Financial Regulations applied; and


(b) held a rank specified in the first column of the following table,

the rate of pay applicable to his service on that day is the rate specified in the second column or third column, whichever is appropriate, of the following table in relation to the rank that he held on that day in the first column of that table instead of the rate applicable under the Military Financial Regulations as in force on that day.

(9.) For the purposes of the last two preceding sub-regulations, the transitional period is the period from and including the tenth day of November, 1969, to and including the tenth day of September, 1970.

(10.) Higher duties allowance payable to a member in respect of a day in the period from and including the eighteenth day of December, 1969 to and including the day immediately before the commencement of these Regulations is payable as if the amendments of regulation 29 of the Military Financial Regulations effected by regulation 5 of these Regulations had come into operation on the eighteenth day of December, 1969.
