REGULATIONS UNDER THE FISHERIES ACT 1952-1967.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Fisheries Act 1952-1967.

Amendments of the Fisheries Regulations†

Interpretation.

1. Regulation 3 of the Fisheries Regulations is amended—

(a) by omitting from sub-regulation (1.) the definition of “licensing authority” and inserting in its stead the following definition:—

“‘licensing authority’ means—

(a) in relation to a licence to engage in fishing in proclaimed waters or in an area of proclaimed waters—a person or authority authorized by or under the Act to grant such a licence;

(b) in relation to a licence authorizing the use of a boat for fishing in proclaimed waters or in an area of proclaimed waters—

(i) in the case of a foreign boat—the Minister or the Secretary; or

(ii) in any other case—a person or authority authorized by or under the Act to grant such a licence; and

(c) in relation to the registration of nets, traps and other equipment for use in the taking of fish in proclaimed waters or in an area of proclaimed waters—a person or authority authorized by or under the Act to grant registration of any such nets, traps and other equipment;”; and

(b) by omitting sub-regulation (2.).

Application for licences or registration.

2. Regulations 4, 5, 6 and 7 of the Fisheries Regulations are repealed and the following regulation is inserted in their stead:—

“4. An application for—

(a) a licence to engage in fishing in proclaimed waters or in an area of proclaimed waters;

(b) a licence authorizing the use of a boat for fishing in proclaimed waters or in an area of proclaimed waters;

(c) registration of nets, traps and other equipment for use in the taking of fish in proclaimed waters or in an area of proclaimed waters; or

(d) for the transfer of a licence authorizing the use of a boat for fishing in proclaimed waters or in an area of proclaimed waters,

shall be taken not to be duly made to a licensing authority unless it is accompanied by the fee payable in respect of the grant of the application or the transfer of the licence, as the case may be.”.

Lost or destroyed licences, etc.

3. Regulation 8 of the Fisheries Regulations is amended by omitting from sub-regulation (4.) the words “One hundred pounds” and inserting in their stead the words “Two hundred dollars”.

Licences, etc., fees.

4. Regulation 10 of the Fisheries Regulations is amended—

(a) by omitting the words “Second Schedule” and inserting in their stead the word “Schedule”; and

(b) by adding at the end thereof the following sub-regulation:—

“(2.) For the purpose of the Schedule to these Regulations, the overall length of a boat in feet shall be taken to be the number of feet, disregarding any part of a foot, in the length of an imaginary straight line following the centre of the main deck of the boat from the fore side of the stem to the aft side of the stern of the boat.”.

Distinguishing number.

5. Regulation 11 of the Fisheries Regulations is amended—

(a) by omitting from sub-regulation (1.) the words “in the taking of fish” and inserting in their stead the words “for fishing”;

(b) by omitting from sub-paragraph (i) of paragraph (a) of sub-regulation (2.) the words “in the taking of fish” and inserting in their stead the words “for fishing”;

(c) by omitting from paragraph (c) of sub-regulation (2.) the words “in the taking of fish” and inserting in their stead the words “for fishing”; and

(d) by omitting from sub-regulation (2.) the words “One hundred pounds” and inserting in their stead the words “Two hundred dollars”.

Signals and rules of navigation.

6. Regulation 13 of the Fisheries Regulations is amended by omitting from sub-regulation (2.) the words “One hundred pounds” and inserting in their stead the words “Two hundred dollars”.


The Schedules.

7. The Schedules to the Fisheries Regulations are repealed and the following Schedule is inserted in their stead:—
