REGULATIONS UNDER THE CANNED FRUITS EXPORT CONTROL ACT 1926-1959.*

WHEREAS by section 13 of the Canned Fruits Export Control Act 1926-1959 it is enacted that the regulations may prohibit the export from the Commonwealth of canned fruits—

(a) except by a person who holds a licence granted as prescribed; and

(b) except in accordance with such conditions and restrictions as are prescribed after recommendation to the Minister by the Australian Canned Fruits Board:

And whereas the Australian Canned Fruits Board has recommended to the Minister that the conditions and restrictions applying to the export from the Commonwealth of canned fruits should be the conditions and restrictions set forth in the Canned Fruits Export Control (Licences) Regulations as amended by the following Regulations:

Now therefore I, the Governor-General in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Canned Fruits Export Control Act 1926-1959.

Amendments of the Canned Fruits Export Control (Licences) Regulations.†

Conditions and restrictions.

1. Regulation 7 of the Canned Fruit Export Control (Licences) Regulations is amended—

(a) by omitting paragraphs (f) and (g) of sub-regulation (1.) and inserting in their stead the following word and paragraph:—

“and; (f) if the canned fruits are being exported to the United Kingdom, Canada or New Zealand—

(i) the Secretary or an authorized person has certified, on the application in accordance with Form C or Form

D (whichever is applicable) furnished to the Secretary in accordance with the next succeeding regulation, that the export to that country of the canned fruits referred to in the application is authorized under these Regulations;

(ii) that certificate had not been revoked; and

(iii) the export is in accordance with the particulars shown on that application.”; and

(b) by omitting from sub-regulation (2.) the words “the Dominion of” (wherever occurring).

Certificate of authority to export.

2. Regulation 8 of the Canned Fruits Export Control (Licences) Regulations is amended—

(a) by omitting sub-regulation (1.) and inserting in its stead the following sub-regulation:—

“(1.) A licensee who intends to export canned fruits to the United Kingdom, Canada or New Zealand is not eligible to have a certificate certifying that the export is authorized under these Regulations granted to him unless, at least three clear working days before the proposed date of shipment, he furnishes to the Secretary an application in writing, in accordance with Form C or Form D (whichever is applicable), together with a copy of that application.”;

(b) by omitting from paragraph (a) of sub-regulation (2.) the words “grant the certificate” and inserting in their stead the words “certify, on the application, that the export is authorized under these Regulations, and then return that application to the licensee”; and

(c) by omitting from paragraph (b) of sub-regulation (2.) the words “to grant the certificate” and inserting in their stead the words “the application”.

3. After regulation 12 of the Canned Fruits Export Control (Licences) Regulations the following regulation is inserted:—

Compliance with Forms.

“13. Strict compliance with the Forms in the Schedule to these Regulations is not necessary, and substantial compliance is sufficient.”.

4. The Schedule to the Canned Fruits Export Control (Licences) Regulations is repealed and the following Schedule inserted in its stead:—
