REGULATIONS UNDER THE FLAX CANVAS BOUNTY ACT 1950.*

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Flax Canvas Bounty Act 1950.

Flax Canvas Bounty Regulations.

Citation.

1. These Regulations may be cited as the Flax Canvas Bounty Regulations.

Interpretation.

2. (1.) In these Regulations, unless the contrary intention appears—

“ authorized agent ” means a person appointed in pursuance of regulation 3 of these Regulations to be an authorized agent for the purposes of these Regulations ;

“ bounty ” means bounty under the Ac t;

“ the Act ” means the Flax Canvas Bounty Act 1950.

(2.) In these Regulations, any reference to a form shall be read as a reference to a Form in the Schedule to these Regulations.

Authorized agent.

3. (1.) A manufacturer may appoint a person to be his authorized agent for the purposes of executing on his behalf a notice, declaration, certificate or document which the manufacturer is required to execute by, or for the purposes of, the Act or these Regulations.

(2.) An authorized agent may execute on behalf of the manufacturer any such notice, declaration, certificate or document.

(3.) Where a notice, declaration, certificate or document has been executed by an authorized agent, the manufacturer shall be subject to the same liabilities and penalties as if he, had executed the notice, declaration, certificate or document.

(4.) The appointment of an authorized agent shall be in accordance with Form 1 and shall be

(a) signed by the manufacturer in the presence of a witness; and

(b) lodged by the manufacturer with the Collector for the State in which the manufacturer products flax canvas

Notice of intention to claim bounty.

4. (1.) A manufacturer shall, at least thirty days before a claim for bounty is made, furnish to the Collector a notice of intention to claim bounty.

(2.) The notice of intention to claim bounty may specify a particular period for which the claim is to be made or may be for the period during which the Act is in operation.

(3.) The notice of intention to claim bounty shall be in accordance with Form 2.

Form of claim for bounty.

5. An application for bounty shall be in accordance with Form 3 and the manufacturer shall complete and sign, in the presence of a witness, a declaration in accordance with the declaration contained in that form.

Time within which claim for bounty to be made.

6. (1.) An application for bounty oh flax canvas produced on and after the seventeenth day of July, 1950, and prior to the date of commencement of these Regulations shall be lodged with the Collector of Customs for the State in which the flax canvas was produced within sixty days after the date of commencement of these Regulations.

(2.) Subject to the next succeeding sub-regulation, an application for bounty on flax canvas, the production of which is completed during any month, shall be lodged with the Collector in the State in which the flax canvas has been produced within thirty days after the end of that month.

(3.) The Collector may permit applications for bounty in respect of flax canvas, the production of which has been completed during a period of three months ending on the last day of March, June, September or December, respectively, to be lodged with him within sixty days after the expiration of that period.

Formula to be used for calculating bounty to be paid.

7. The formula for calculating the weight of scutched flax fibre used in the manufacture of flax canvas is the sum of the following :

(a) the weight of line yarn produced from flax grown and processed in Australia contained in the flax canvas multiplied by 1.37 ; and

(b) the weight of machine tow yarn produced from flax grown and processed in Australia contained in the flax canvas multiplied by 1.50.

I, (a) hereby appoint (b) (a specimen of whose signature appears hereunder) to be my authorized agent for the purpose of the Flax Canvas Bounty Act 1950 and the Regulations made there under, and to execute on my behalf any notice, declaration, certificate or document which I am required to execute by, or for the purposes of, the Act manufacturer or those Regulations.

NOTICE BY MANUFACTURER OF INTENTION TO CLAIM BOUNTY.

I, (a)  hereby give notice that I intend to claim bounty in respect of flax canvas produced or to be produced in the factory situated at (b)               during the period

APPLICATION FOR BOUNTY.

To the Collector of Customs for the State of

I, (a).  hereby apply for bounty in respect of flax canvas produced by me in a factory situated at (b)                during the period commencing on              , 19   and ending on 19   .

The particulars relating to the goods covered by this application are as follows:

Full description of goods on which bounty is applied for.

Weight in pounds of flax yarn used.

Full description of yarn used.

Name of person from whom the yarn was purchased.

(1) I am the (d)  of the flax canvas specified in the foregoing application for bounty ;

(2) The goods were produced in premises registered by minister of State for Trade and Customs as a factory for the purpose of the Flax Canvas Bounty Act 1950 ;

(3) The description of the goods, and all the particulars relating thereto set out in the foregoing application for bounty, are true and correct in every particular ;

(4 ) The whole of the goods specified in the foregoing bounty are of good. and merchantable quality;

 

(5) Nothing on my part has been done or omitted to be done, and, to the best of my knowledge and belief, nothing on the part of any other person has been done or omitted to be clone, whereby the right of the manufacturer to bounty in respect of the goods described in the foregoing application for bounty has been forfeited or taken away ; and

(6) To the best of my knowledge and belief, no other application for bounty has been made, nor has any bounty been paid, in respect of the goods specified in the foregoing application for bounty.
