Naval Financial Regulations.

PART I.

Preliminary.

1. These Regulations may be cited as the Naval Financial Regulations.

Repeal.

2. The Naval Financial and Allowance Regulations (Statutory Rules 1912, No. 18, as amended to present date) are hereby repealed save as to any right, privilege, obligation, or liability acquired, accrued, or incurred thereunder.

Definitions

4. In these Regulations, unless the contrary intention appears—

“Naval Board” means the Board of Administration for the Naval Forces.

“Secretary” means the Officer appointed to be Secretary to the Department of the Navy.

“Commanding Officer” means the Officer in actual command of one of H.M.A. Ships or Naval Establishments.

“Officer-in-Charge” means the Officer in Charge of a Naval Establishment or Office or District Naval Officer appointed to command a District.


“Director of Navy Accounts” means the Officer appointed to be Director of Navy Accounts in the Office of the Naval Administration or such person as may be appointed by the Naval Board to perform the duties of the position during his absence.

“Accountant Officer” means the Officer in charge under the Commanding Officer of cash, victualling, and clothing duties.

“Certifying Officer” means the Officer appointed by the Naval Board to certify accounts and approve the payment thereof.

“Accounts Officer” means the Officer responsible for the receipt and payment of Public Moneys in Naval Establishment or Office.

“Executive Officer” means an Officer of the Executive Branch of the Forces.

“Minister” means the Minister of State administering the Naval Defence Act 1910-1918.

PART II.

General Instructions.

Regulations not to apply to Cadets.

5. Regulations herein contained, except where otherwise stated, do not apply to Senior or Junior Naval Cadets.

Responsibility of Commanding Officers.

6. Officers-in-Charge shall be responsible for enforcing due economy on all Officers and others charged with any expenditure of public money, or with the care, use, or expenditure of stores.

7. It is the duty of every member of the Naval Forces to assist in carrying out these Regulations.

8. Each District Naval Officer is authorized—

Expenditure that may be authorized by District Naval Officers.

(a) To approve of all requisitions for stores which are allowed by establishment.

Ordinary services.

(b) To approve of expenditure not exceeding £25 in any one case under Contingencies, provided he has satisfied himself that funds are available; that it is not a new vote or item; that it does not involve any alteration in existing rules or practice; that, in the case of purchase of stores, such stores are allowed by establishment; that there is nothing irregular in the character of the expenditure; and that it is not an allowance or payment to any member of the Forces (except such as is governed by Regulation and does not require Ministerial approval).

Casual labour.

(c) To approve of the employment of casual labour (non-clerical); but no person is to be employed under this authority for any longer time than an aggregate period of six weeks in any financial year without the approval of the Naval Board.

Compensation for injuries.

(d) To approve—in accordance with Regulations—of payments for Compensation for Injuries, provided the award does not exceed payment of compensation for thirty working days, and the medical expenses do not exceed £3 3s.

Striking off stores.

(e) To approve, in accordance with any regulations on the subject, of striking off charge of stores damaged or deficient, provided that the original value of the stores struck off does not exceed £10 in any one month. The value of the stores struck off must be shown in the monthly schedule of expenditure incurred by District Naval Officers.

Increments.

(f) To approve of increments to Warrant Officers, Petty Officers, and men, where such are provided in the Appropriation Act, and prescribed by the Regulations.

Expenditure limited.

9. (1) The expenditure to be authorized by District Naval Officers under regulation 8, clauses (b), (c), (d), and (e) must not exceed in the aggregate the following amounts per month in the respective States, without the approval of the Naval Board:—

10. A monthly schedule of expenditure incurred by each Certifying Officer, under the authority in regulation 8 shall (after being signed by the Officer-in-Charge) be forwarded to the Director of Navy Accounts in the following form so as to reach him not later than the end of each month:—

11. Officers-in-Charge shall not vary any payments provided for under Regulations.

Voters—re-arrangement of.

12. When it is necessary to make re-arrangements or transfers in connexion with any Votes, application shall be made, giving full reasons for the same, to the Secretary.


Certificate as to funds to be furnished.

13. When an Officer-in-Charge submits any proposal involving expenditure, such proposal shall be accompanied by a statement from the Certifying Officer, showing—

(a) The Division, Subdivision, and item of the Estimates to which the expenditure should be charged.

(b) That funds are available.

He shall, in addition, state that, with his knowledge of the requirements for the remaining period of the financial year, the proposed expenditure will not involve the necessity of applying for additional funds under any Vote concerned.

Financial instructions—Accountant Officers to see.

14. All financial instructions, approvals, or other decisions regarding expenditure, communicated to Officers-in-Charge, shall be forwarded without delay to the Certifying Officer.

Financial advice.

15. Officers-in-Charge shall consult with and obtain the advice of the Certifying Officer upon all financial matters.

Audit queries.

16. All audit queries shall be dealt with through the Certifying Officer, who shall obtain the necessary information and report to the Director of Navy Accounts for the satisfaction of the Treasury and Audit Departments.

17. Where the position of Accountant Officer does not exist, and a clerk is not appointed for the duties of Certifying Officer, the Accounts Officer shall perform the duties required of the Certifying Officer under the provisions of regulations 14, 15, and 16 only.

PART III.

Duties of Accountant Officers.

Duties of Accountant Officers

18. (1) The duties of an Accountant Officer shall be as set out in the following sub-regulations:—

(2) He shall be responsible for the disbursement of public moneys in accordance with the Regulations, and the carrying out of any instruction or authority issued by the Naval Board.

Arrears of work.

(3) He shall be responsible that no arrears occur in the work of his office, and that the books are posted up daily, so that they may, at all times, be ready for examination.

Financial adviser.

(4) He shall act as financial adviser to the Officer-in-Charge upon all questions involving expenditure.

Accounts—responsibility as to.

(5) He shall be responsible that all accounts are kept strictly in accordance with the Naval Account Regulations or other approval.

Not to exceed authority for expenditure.

(6) He shall be responsible that the amount authorized for expenditure under any Division or Subdivision of the Estimates, any Loan Appropriation or Trust Fund Credit, is not exceeded without due authority.

Claims inadmissible.

(7) He shall, in the event of receiving any claim which appears to him not authorized by Regulations or instructions, or in regard to which there is doubt as to the admissibility of any charge, point out


the same in writing to the Officer-in-Charge. Should the Officer in Command consider that, on the contrary, such claim is covered by Regulation or authority, and that the charges are admissible, an immediate report as to the circumstances of the case shall be made by him to the Secretary, and the account shall not be paid without the approval of the Naval Board.

Officers due for retirement—notification of.

(8) He shall be responsible that the Officer-in-Charge is informed, in writing, six months before the event, of the name of any member of the Permanent Naval Forces attaining the age prescribed for compulsory retirement, to enable the Officer-in-Charge to take such steps as he may deem necessary in the matter. In no circumstances is a member to be granted pay for any period after the date on which he was, in the ordinary course, due for retirement, unless authority for the extension of his services has first been obtained.

Public funds—how to be dealt with.

(9) He shall not apply Public Moneys to any purpose not authorized by the Regulations, nor shall he advance (except as hereinafter provided), lend, or exchange any sums for which he is accountable, nor shall he exchange private cheques out of public funds. In the case of members of the Forces travelling on duty, where extended absence is probable, and cash payments exceeding a total sum of £5 have to be made, he may make an advance up to 75 per cent. of the maximum allowance that can be claimed.

Advances not to be made without authority.

(10) He shall not advance any moneys to a member of another Establishment or Office, on account of travelling or other expenses, unless authority has first been obtained for so doing from the certifying officer of the Establishment or Office to which the expenditure is to be charged. In the cases of members of the Naval Administration, the authority of the Director of Navy Accounts must be obtained before any such advances are made.

Liable for errors

(11) He shall be liable for the amount of disallowances arising from errors or over-issues made by him in disregard of Regulations, or in the absence of proper authority.

Recovery of vouchers.

(12) Should difficulty be experienced in recovering vouchers, supporting receipts, statements, &c., or money due from officers or others, he shall at once represent the circumstances in writing to the Officer-in-Charge, who shall, if necessary, refer the matter to the Secretary.

Audit queries.

(13) He shall submit to the Officer-in-Charge all queries from the Director of Navy Accounts and the Audit Department, together with the correspondence, if any, involved.

Audit Act and Regulations.

(14) He shall see that a copy of the Audit Act, Treasury Regulations and the Naval Account Regulations is supplied to every officer receiving or disbursing Public Moneys, and shall obtain receipts for such supply.

Responsible for supplies stores, &c.

(15) He is charged with the duty of obtaining requisite supplies of provisions, victualling stores, and clothing for Ships or Establishments.

19. Where the position of Accountant Officer does not exist, the Certifying Officer shall perform the duties required of an Accountant Officer in these Regulations.


Instructions as to Payments.

Instructions as to payments, Salaries—general.

20. (1) An amount provided on the Appropriation Act as salary for one appointment shall not be utilized for the payment of the salaries or portions thereof of two persons for the same period.

Officers’ salaries.

(2) No Officer shall be paid the salary of any position to which he has not been appointed by Order in Council.

Allowances—payment of.

(3) In no case, unless governed by regulation, shall an allowance be paid to any member of the Forces unless such allowance be authorized by the Naval Board.

Overtime.

(4) Overtime shall not be paid for unless the same has received the approval of the Naval Board.

Salaries to be paid from pay vote only.

(5) Salaries must not be paid from any Vote other than a Pay Vote. Temporary assistance, casual labour, and special services are chargeable to items under Contingency Votes, where provision exists.

Temporary employment.

(6) In no case shall any person be temporarily employed without the approval of the Naval Board, except as provided in regulation 8 (c).

Advertising—claims for.

(7) Claims on account of advertising shall, wherever practicable, be submitted to the Government Printer or Advertising Board of the State concerned, for checking, before payment is made.

Transfer of Members of the Forces.

Transfer of members.

21. (1) When the transfer of a member of the Naval Auxiliary Forces is effected, a transfer list, Form A.S.45, shall be completed, signed by the Certifying Officer and transmitted to the Certifying Officer of the district or depôt, as the case may be, to which the transfer is made. Pay shall be adjusted to last fortnightly pay period only and not to actual date of transfer. The transfer list shall be attached to the voucher upon which the first payment of pay is made.

In the case of members enlisted or mobilized whose accounts are kept on a ship’s ledger, pay shall be credited on ledger to date of transfer and balance shown on transfer list as carried to next establishment for settlement in the usual course.

The date to which payment has been adjusted shall be indorsed on transfer list in all cases.

Accounts for cost of transfers.

(2) The account for rail, steamer, or other fare of the member transferred shall be rendered to and paid by the office or ship from which the warrant for such service was issued; but the member’s claim for travelling allowance and reimbursement of expenditure incurred consequent upon transfer shall be dealt with by the office or ship to which such member is transferred.

Cheques.Provision for Signing of.

Cheques.

22. (1) All cheques shall be signed by the Paying Officer, or such officer as may be dealing with the advances or credit against which the cheques are drawn, and countersigned by the Certifying Officer, or such other Officer as may, in accordance with the Naval Account Regulations, be appointed for the purpose.

Specimen signatures.

(2) The name of the Countersigning Officer, with a specimen of his signature, shall be forwarded by the Officer-in-Charge to the manager of the bank in which the account is kept. The Treasury will advise the bank as to the appointment of the Accounts Officer. See also the Naval Account Regulations.


Payments of the Department.

Payments to Departments.

23. All payments to the Department in any District are to be made to the Accounts Officer as Receiver of Public Moneys, and bank drafts, cheques, post-office orders, or postal notes should be made payable to the Receiver of Public Moneys or order. Postage stamps in excess of 5d. are not to be used as portions of remittance. The official receipt given and accepted shall be that issued by the Receiver of Public Moneys only.

Trust Funds.

Trust Fund Accounts.

24. The following Trust Funds are approved:—

  (i) Uniform Clothing and Necessaries (Naval) Account.

Trust Fund—Uniform Clothing and Necessaries (Naval) Account.

This Trust Fund is to be utilized for the following purposes:—

(a) Permanent Naval Forces (Sea-going).—Purchase of any article of uniform or necessaries required on board ship, and which are issued on payment.

(b) Naval Reserves and Senior Naval Cadets.—Purchase of uniform material (serge, duck, and flannel), and articles of uniform.

Trust Fund—Deferred Pay (Naval) Account.

The proceeds of sale of any article purchased from the Trust Fund shall be credited to the Trust Fund.

 (ii) Deferred Pay (Naval) Account.

The purpose of this Trust Fund is defined as follows:—

Payment of deferred pay and interest thereon to members of the Permanent Naval Forces (Sea-going), in accordance with Regulations.

 (iii) Naval Dockyard Account.

Trust Fund—Naval Dockyard Account.

The purpose of this Trust Fund is defined as follows:—

Payment for labour employed and material used in the Naval Dockyard for purposes other than the construction of the Fleet.

25. A monthly statement shall be furnished and attached to the Statement of Expenditure (in the form of the Estimates) in respect of the Trust Fund—Uniform, Clothing, and Necessaries (Naval) Account, made out in the following form:—

Payment and Certification of Claims.

Payments to be made by the 30th June.

27. In order to prevent arrears, Officers shall be responsible that the following steps are taken:—

Payments to be made by 30th June.

(a) Stores and supplies required to the end of June should be ordered in April or early in May, so that the accounts may be paid in May or early in June; and no orders except such as are absolutely necessary should be given after the middle of May.

Repairs and works.

(b) The requisitions for repairs and similar works should be sent in as early as possible, and the works should, wherever practicable, be completed early in May.

Outstanding accounts.

(c) Where accounts outstanding are likely to be of considerable amount, the persons interested should be requested to furnish the accounts promptly. A memorandum to that effect should be written across the orders when given.


Government Printer’s accounts:

(d) Accounts for amounts due to the Government Printer, Railways, and other Departments should be specially asked for.

Monthly or quarterly accounts.

(e) In the case of monthly or quarterly payments, where the amount due on the 30th June can be ascertained claimants should be asked to render their claims early in June, so that they may be paid before the 30th. Where the amount due cannot be ascertained before the end of June, the claimants should be asked to render accounts up to the middle of June only, the balance to be included in the next account.

Rents.

(f) Accounts for services up to end of June, such as rents and similar matters, should be paid about the middle of June.

Pay and allowances.

(g) With regard to the pay and allowances of the Naval Forces, such arrangements should be made as will enable all payments due for the financial year to be made prior to the 30th June.

Officers signing as “Person incurring the Expense” to be personally liable.

(h) Officers signing claims as “Person incurring the expense” will be held personally responsible that the claims certified by them are correct in every particular, and care in this respect will insure prompt payment. All claims must quote the regulation or other authority under which preferred.

Rates or Taxes.

Rates or taxes.

28. In all cases where premises are rented or leased for departmental purposes no provision is to be included in the agreement or lease by which the Commonwealth Government is required to pay any taxes or water rates.

Water rates.

29. Unless special approval to the contrary be obtained, where water is supplied meters must be provided, so that payment may only be made for the quantity actually consumed. Accounts in connexion with such supplies should show that the charges are for services rendered, i.e., water supplied, claims for “water rate” not being admissible.

Charges for Use of Furniture and Mess Traps.

Furniture—charges for use of.

30. (1) In all cases where furniture is supplied to official residences, a charge at the rate of 7½ per cent. per annum on the value of such furniture shall be made unless otherwise approved by the Minister.

(2) Subject to the approval of the Minister, a similar charge may also be made in any instance where furniture is supplied to persons occupying Government quarters, and in any case where a billiard table is provided for the use of an officers’ mess.


(3) In cases where supply of mess traps is approved to official residences, a charge at the rate of 8 per cent. per annum on the value of such mess traps shall be made.

(4) The percentage charge shall be made on the official valuation. A revaluation may be made at intervals not exceeding five years, and also at the time of a change in tenancy.

(5) Percentage charges under this regulation shall be made in arrear on the last day of each quarter, or if furniture or mess traps are returned to store before the end of the quarter, on the return of the furniture or mess traps.

Rent Chargeable for Quarters.

Quarters—rent chargeable.

31. (1) If any person occupies for purpose of residence the whole or part of a building belonging to or occupied by the Commonwealth, a deduction of 10 per centum from such person’s salary or wages shall be made as rent therefor.

The Minister may, however, fix the rent to be charged to any person on a basis other than the foregoing, or may waive altogether the charge for rent when considered desirable.

(2) In calculating for any purpose the rate of salary or wages of such person, the amount so deducted for rent shall be deemed and taken to be part of his salary.

(3) Percentage deductions from salary or wages for rent shall be treated as a saving to the Pay Vote in each case, and shall be made in arrear on the respective salaries sheets and ship’s ledger.

Fractions of a pound shall be discarded in arriving at the amount to be deducted.

(4) All officers and men on sea-going rates of pay, in occupation of official married quarters, shall pay such rent for the premises as is approved by the Minister.              In such cases, the rent shall be charged in arrear against the member’s account in the ship’s ledger at the end of each quarter, or, if the married quarters are vacated before the end of the quarter, on vacation of the premises.

(5) The Officer-in-Charge shall be responsible, in all cases, for the abatement from salary or wages of the necessary charges for rent of quarters.

Fuel and Light.

32. Any person in receipt of consolidated rates of pay, who is in occupation of official quarters, shall not be provided with fuel, light, or furniture at Government expense, unless the Order in Council appointing such person expressly provides that one or more of such services are to be allowed, or unless the Minister approves of one or more of such services being supplied.


PART IV.

Pay and Allowances.

33. (1) The daily rates of active pay set forth in this regulation, of allowances set forth in regulations 35 to 39, and the rates of deferred pay as set forth in regulation 41 shall apply, where not otherwise stated, to Officers serving in the Permanent Naval Forces (Sea-going) of the ranks or relative ranks specified, as defined in the King’s Regulations and Admiralty Instructions.

Definition of Service.

(5) Service for the purpose of increments of pay shall be defined for all Officers as actual service in rank, specified on Active List of Royal Navy or Royal Australian Navy.

Increments.

(6) All increments of pay shall be subject to such conditions as may be escribed by the Naval Board. “Provisional” time shall count for increments of pay, but “Acting” time shall not so count. Temporary Acting Warrant Officers will be allowed the same increments of full pay as authorized for confirmed Warrant Officers, R.A.N., of similar rank.


Retention of Old Rates of Pay.

(7) Any Officer, whose pay and allowances in the nature of pay under Regulations in force immediately prior to the rates of pay and allowances set out in these Regulations coming into force are greater than those set out in these Regulations may continue to receive such higher pay and allowances during the period of his existing appointment, or until such time as the new rates, either on account of increment or promotion, exceed the old rates.

Excess Numbers.

(8) Officers in excess of the authorized number of any rank may be carried on the strength, provided there are vacancies in the higher rank, and that the total establishment is not exceeded.

Shore Appointments.

(9) Officers on the Sea-going List (except members of the Naval Board), who, though serving in shore appointments, are eligible and liable to be appointed to sea, shall receive the Sea-going rates of pay and allowances of their respective ranks.

Reserve Officers.

(10) Officers of the Naval Reserves (Sea-going) appointed to H.M.A. Ships shall receive the same rates of pay and allowances as Officers of the same rank in the Permanent Naval Forces (Sea-going). deferred pay being paid with active pay. Progressive pay for Reserve Officers will accrue according to seniority in rank.

Citizen Naval Forces and R.A.N.R. Staff Officers.

(11) Officers of the Citizen Naval Forces appointed to H.M.A. Ships shall receive the “on promotion” rates of pay and allowances of Officers of the same rank in the Permanent Naval Forces (Sea-going), deferred pay being paid with active pay. Officers of the R.A.N. Reserve Staff in receipt of consolidated rates of pay appointed to H.M.A. Ships may receive Sea-going rates of pay and allowances if approved in special circumstances by the Naval Board, deferred pay being paid with active pay.

Officers of the Royal Navy.

(12) Officers of the Royal Navy serving in the Permanent Naval Forces (Sea-going) may elect to receive either the rates of active pay and allowances prescribed for their relative ranks in the Royal Navy or those prescribed in these Regulations. The following Royal Australian Navy allowances shall be payable, at the rates and under the conditions set forth in these Regulations, in lieu of the corresponding Royal Navy allowances, where such Officers elect to receive Royal Navy rates of pay:—

 (i)  Ration Allowance.

 (ii)  Lodging Allowance.

(iii) Travelling Allowance.

Deferred pay shall not be credited to Officers of the Royal Navy whether in receipt of Royal Navy or Royal Australian Navy rates of pay.

Half-pay List.

(13) Officers placed on the half-pay list shall receive pay at the daily rate of one-half of the active pay prescribed for their rank, but shall not be entitled to deferred pay or allowances of any nature whatsoever.

An officer who has been on the half-pay list for a period of six consecutive months may, if not then re-employed, be placed on the retired list. An officer who has been on the half-pay list for twelve consecutive months shall be placed on the retired list from the date following that on which the twelve months’ half-pay time is completed.

Officers shall cease to be entitled to half-pay as from the date of being placed on the retired list.

*Instrument Allowance and Efficiency Allowance have been absorbed in new Band rates; these allowances having been abolished.

 

 (2) Petty Officers and men serving under the Regulations existing prior to 1st July, 1911, will be paid at the substantive rates (total active and deferred pay) of their seniority shown above until they reach their present compulsory age for retirement.

(3) Leading Seamen already in receipt of progressive pay, under special Naval Board authority, although not passed professional examination for Petty Officer, may continue to be paid as such, but progressive pay is not to be paid in such circumstances in any further cases.

(4) Ratings re-entering the service shall not count their former service towards progressive pay when the period of absence has exceeded five years, except in such special cases as may be approved by the Naval Board.

Increments—Counting time for.

(5) All increments of pay shall be subject to such conditions as may be prescribed by the Naval Board. Time prior to desertion shall, under no circumstances, count as service for purpose of increment, but time served prior to disrating may count towards progressive pay on restoration to rating.

Excess of Establishment.

(6) Excess Numbers.—Ratings in excess of the authorized number may be carried on the strength, provided that there are vacancies in higher grades, and that the total establishment is not exceeded.

Pay, &c., of reserve ratings.

(7) Reserve and other Chief Petty Officers, Petty Officers, and Men.—Chief Petty Officers, Petty Officers, and men of the Naval Reserve, R.A.N Reserve Staff, or of other Commonwealth Naval Forces shall, when serving or undergoing training in H.M.A. Ships, receive the rates of pay and allowances of Chief Petty Officers, Petty Officers, and Men of the same grade and service in the Permanent Naval Forces (Sea-going), deferred pay being paid with active pay. Progressive rates of pay shall accrue only in respect of service on Sea-going rates of pay.

AllowancesGeneral.

35. (1) Uniform Allowance shall be granted as follows:—

Additional emoluments.

Ratings, Classes I. and III.—Free kit on entry, and allowance of 9d. per diem commencing one year after.

Kitting up of rating.

Ratings, Class II.—Free kit on entry, and allowance of 8d. per diem commencing one year after.

Such allowance shall be credited on the ship’s ledger in cash.

In all cases where deferred pay is stopped the allowance towards cost of uniform shall also be stopped for the same period.

Uniform gratuities—Amount of.

(2) Uniform on Entry, Promotion, &c.—Uniform gratuities will be paid to Officers on first joining; or on promotion to Officer rank, as follow:—

Commissioned Officers on first joining, £60 (except Chaplains or Officers appointed for temporary service, £30); Warrant Officers and Paymaster Midshipmen on first joining or on promotion to that rank, £40; on promotion from Warrant to Mate or Lieutenant rank, £25.

Officers discharged within twelve months of entry —Recoveries to be made on monthly basis.

(3) In the event of discharge except by invaliding within twelve months of grant of clothing gratuity, a proportionate part of gratuity for the unexpired period is to be recovered from the Officer concerned, on a monthly basis. Recovery will be made on the basis of one-twelfth for each full month of the unexpired period.

Men—Recoveries to be made if discharged within twelve months of entry.

(4) In the event of discharge of men within twelve months of entry, at own request, a charge will, if deferred pay is granted, be made against deferred pay of £1 per month in the case of Ratings Classes I. and III., and of 15s. per month in the cases of Ratings Class II. for each full month of the unexpired period of twelve months. A similar charge is to be made in all cases of discharge within twelve months where deferred pay is not forfeited, except that in the case of men invalided no charge is to be made. In the case of ratings discharged within one year of entry, other than by invaliding, being in debt or having insufficient credit of deferred pay to cover the charge referred to in the foregoing, the kit, or portion thereof, is to be recovered and sold, except such as is sufficient to meet requirements. Any balance received from sale of kit is to be paid to the rating.

This sub-regulation does not affect any special regulations concerning Boys which may be ordered by Training Ship Regulations.


(5) Ratings who have been discharged “time expired” and re-engage, after an interval, for a further period of service in the Royal Australian Navy, shall be entitled to be issued with a free kit.

Should a rating not have disposed of his kit prior to his re-engagement, he may, if he so elects, be paid the usual daily allowance as from the date of his re-entry in lieu of being supplied with the free kit as prescribed.

Additional gratuities to C.P.O’s. and P.O.’s. on promotion. &c.

(6) Petty Officers dressed as seamen shall, on promotion to Chief Petty Officers, be paid a gratuity (additional to daily allowance) of £5 towards cost of change of uniform. A gratuity of £5 shall similarly be paid to every Petty Officer or man dressed as a seaman, on transfer to another rating, provided he is required to change his uniform from Class II. to Class III. A rating required to change his uniform from Class III. to Class II. shall also be paid this gratuity. No gratuity shall be paid when the transfer is made on account of misconduct.

Uniform of Officers and men lent from Royal Navy.

(7) Uniform gratuities shall not be payable to Officers and men lent from the Royal Navy, nor will a free kit be issued in such cases.

Uniform allowance, at the rates stated in sub-regulation (1), shall be credited to ratings lent from the Royal Navy commencing from date of entry.

Kitting up of recovered deserters.

(8) Deserters’ Uniforms.—Recovered deserters are not to be treated as new entries. The kit of a deserter if not sold before his recovery may be restored to him. If his kit has been sold, he should be supplied with a reduced kit (as laid down in the Uniform Regulations) to be charged against his pay and allowances.

Stoppage of uniform allowance.

(9) Issue of Civilian Suit.—Ratings about to be discharged from the Sea-going Forces—

(a) Dismissed with disgrace;

(b) Dismissed; and

(c) Services no longer required on account of misconduct, who, at date of discharge, are in debt to the Crown, may be issued gratuitously with a civilian suit, the cost of which shall not exceed 32s. 6d.

Where the pay account of the rating about to be discharged in the manner stated in the preceding paragraph is in credit, such rating may be issued with a civilian suit on repayment, the cost of which, not exceeding 32s. 6d., shall be recovered from the pay due on discharge.

Additional emoluments.

(10) Rations.—Rations shall be supplied, subject to such regulations as may be prescribed by the Naval Board. An allowance in lieu of rations shall be paid at the rate of 2s. 6d. per diem.

The allowance in lieu of rations shall not be paid to parties of twelve or over, when working together on detached duty and able to form a mess.

Lodging allowance payable when residing at home.

In cases where Lodging Allowance is paid owing to quarters not being available and the officer or man resides at his own home, the rates of Lodging Allowance shall be the foregoing rates, less the amount of Married Allowance, if any, drawn.

Officers and men in receipt of Lodging Allowance shall not be credited with same when on leave for periods exceeding four days.

Officers (Sea-going) of the Royal Australian Navy, who are appointed to positions on shore, and are not provided with accommodation, shall be paid Lodging Allowance at the following rates provided that, where the period of service ashore does not exceed one month, Officers shall be paid the difference between the daily and annual rates of Lodging Allowance prescribed in this sub-regulation:—

Payment of Lodging Allowance at the annual rate shall not cease when an Officer proceeds on recreation leave.

In calculating Lodging Allowance at the annual rate, the amount payable shall be ascertained by multiplying the annual rate by the number of days in the period of calculation and dividing the result by 365.

Married Allowance shall not be payable concurrently with the annual rate of Lodging Allowance when an officer resides, or is able to reside, at his own home.

(12) Married Allowance.—(i) On production to the Commanding Officer of satisfactory evidence of marriage, an allowance shall be payable in accordance with the scale set out hereunder:—

Warrant Officers over six years’ seniority shall receive the allowance prescribed for Warrant Officers under six years’ seniority up to a maximum of 3s. per diem.


Commissioned Warrant Officers in receipt of “on promotion” rates of pay shall receive 2s. per diem Married Allowance. Commissioned Warrant Officers in receipt of rates of pay prescribed for Commissioned Warrant Officers “after three years’ seniority” and “after six years’ seniority” shall receive 1s. per diem Married Allowance. Commissioned Warrant Officers in receipt of pay as Commissioned Warrant Officer “after nine years’ seniority” shall not be entitled to Married Allowance.

Conditions governing Marriage Allowance.

(ii) The conditions as set forth in the following sub-paragraphs shall govern payment of Married Allowance.

(iii) In the case of an Officer, an allotment must be declared in favour of his wife of not less than one-third of his active pay (excluding allowances) plus full amount of Married Allowance payable.

(iv) In the case of a Chief Petty Officer, Petty Officer, or man an allotment must be declared in favour of his wife of one-half of his active pay (excluding allowances) plus full amount of Married Allowance payable.

 (v) For the purposes of determining the amount of monthly allotment to be declared in each case in respect of Married Allowance, a month shall be reckoned as 30 days.

(vi) In the case of a person already serving in the Royal Australian Navy the allotment required to be declared under these Regulations should be paid to allottees as from 1st January, 1918.

(vii) In the case of Officers and men appointed to the Royal Australian Navy subsequent to 1st January, 1918, the necessary allotment should commence from the first day of the month following appointment.

 (viii) Allotment declarations must invariably be made on the proper form (A.S.63 or S.63) provided for the purpose.

(ix) Married Allowance may be paid to widowers with children subject to an allotment in favour of a guardian of one-quarter active pay (excluding allowances) plus full amount of Married Allowance payable.

(x) Married Allowance will be payable irrespective of place of residence of wife, or of guardian in the case of a widower, provided the necessary allotment is made.

(xi) Married Allowance may be paid in regard to step-children and adopted children under sixteen years of age, provided that the rating claiming the allowance maintains such children and that they are not in receipt of endowment from any other source.

 (xii) During periods of detention or imprisonment not exceeding 90 days, the allotment should be continued at a rate not less than the amount of Married Allowance which would have been payable to the rating. The debt accumulated by such allotment may be recovered in easy instalments, or in the event of discharge communicated to Navy Office for recovery from deferred pay.

(xiii) The payment of Married Allowance shall be entirely subject to the pleasure of the Naval Board, who may withhold the whole or part of the allowance as may be considered desirable.

(13) Dependant Allowance.—(i) When Married Allowance is not drawn, Dependant Allowance at the rate of 2s. per diem may be paid to—

(a) Commissioned Warrant Officers in receipt of “on promotion” rates of pay.

(b) Warrant Officers irrespective of the rate of pay received.

(c) Ratings.

in respect of a dependant residing in Australia requiring support, subject to an allotment of one-half of the pay of the Officer or man, plus the amount of Dependant Allowance credited.

Commissioned Warrant Officers in receipt of pay as Commissioned Warrant Officer “after three years’ seniority” or Commissioned Warrant Officer “after six years’ seniority” may be paid Dependant Allowance under similar conditions at the rate of 1s. per diem only.

Commissioned Warrant Officers in receipt of pay as Commissioned Warrant Officer “after nine years’ seniority,” shall not be entitled to this allowance.

 (ii) Dependant Allowance shall not be credited without the prior approval of the Naval Board and shall, generally, be limited to cases of mothers being widows or of the father being permanently incapacitated by age or infirmity from earning wages exceeding £2 per week. Such Allowance shall not be payable where there are unmarried sons not serving in the Naval or Military Forces, or daughters in receipt of wages exceeding £2 per week, or where the allottee possesses income of like amount. An Allowance at the minimum rate may also be approved by the Naval Board in any other special case where Married Allowance is not already paid and dependence upon the member of the Permanent Naval Forces (Sea-going) is clearly established, subject to residence in Australia and to the above limitation as to private income.

A War Pension shall not count as income for the purpose of the foregoing, and Dependant Allowance shall be payable to a widow or other female relative provided she does not possess other income exceeding £2 per week.

(iii) Payment of Dependant Allowance shall be entirely subject to the pleasure of the Naval Board, who may withhold the whole or part of the Allowance as may be considered desirable.

(iv) This Allowance shall not be included in the daily rate of pay for the purposes of mulcts, being regarded for that purpose similarly to Lodging, Ration, and Married Allowances. Payment of Dependant Allowance shall not, however, be made when a rating is in cells, civil prison, or undergoing detention.

 (v) During periods of detention or imprisonment not exceeding 90 days, the allotment shall be continued at a rate not less than the rate of Dependant Allowance As allotment will be continued in such circumstances at the rate of, at least, £3 per month, when the ordinary allotment is stopped on discharge of a man to cells, civil prison, or detention quarters, a charge shall be made against his pay in respect of an allotment at the reduced rate. Form A.S. 63 declaring an allotment at the reduced rate shall be forwarded to the Director of Navy Accounts in every case.


(vi) The debt accumulated by such allotment may be recovered by easy instalments from the pay of the rating. In the event of discharge, the debt incurred shall be communicated to the Director of Navy Accounts for recovery from deferred pay.

Payment to medical officers undergoing hospital courses.

(14) Hospital Courses.—Where Medical Officers of the Permanent Naval Forces (Sea-going) are required to undergo a six months’ course of study at an approved Medical School prior to presenting themselves for examination for the rank of Surgeon Lieutenant-Commander, or where Senior Medical Officers of over fourteen years’ seniority are permitted to undergo a special three months’ course in approved subjects, the Naval Board may approve of payment, from Commonwealth Funds, of the whole or a portion only of the fees for such courses. Surgeons undergoing courses of study in approved Medical Schools may be credited with the pay and allowances of their respective ranks in the Permanent Naval Forces (Sea-going).

Special allowances.

(a) The period for which payment is made is only to count from the time of entering to that of leaving the water; and should the work be subsequently found to be improperly done, the Captain, at his discretion, may cancel the whole or any portion of the payment.

(b) Artificer Divers, when actually employed at their trade under water on repair or construction work, and when not paid a bonus or gratuity, are to be paid half a day’s pay of their substantive rating for every hour, and proportionately for parts of an hour, in addition to the Diving Pay to which they may be entitled for the several depths.

(c) For recovery of articles, a bonus not exceeding £1 or one-fourth the value of the article may be given in lieu of payment by scale, of which bonus one-tenth is to be paid to the Attendant.

When diving takes place for recovery of articles, a certificate should be inserted in the Extra Pay sub-voucher, stating whether blame was attributable to any Officer or man for the loss; and, if so, where the corresponding charge has been made against their pay.

(d) A gratuity, not exceeding £5, may be given in lieu of payment by scale, in exceptional circumstances requiring dispatch, and for important skilled work satisfactorily performed, of which gratuity one-eighth is to be paid to the Attendant.

(e) A Diver who fails to conform to the conditions of exercise, or is at any time unwilling to dive, will be deprived of his Diver rating and retaining pay for the current quarter.

(f) Only one first hour rate is to be paid for any one day, but in cases of diving at two different depths payment may be made at whichever first hour rate is more advantageous to the Diver.

(g) Details of amounts paid for Diving Pay are to be shown on Form A.S. 9, which should accompany the ledger into office.

(12) Interpreter

Ratings acting as Interpreter, whilst actually performing the duties, shall receive an allowance of 1s. per hour, with a maximum payment of 5s. for any one day.

Deferred Pay of Permanent Naval Forces (Sea-going).

Payment of deferred pay.

40. (1) Deferred pay in accordance with the scale set forth in the next succeeding regulation shall be allowed to accumulate to the credit of every officer and man entered for service in the Permanent Naval Forces (Sea-going); provided that deferred pay shall not be credited to any officer of the Royal Navy serving in the Permanent Naval Forces (Sea-going).

Interest to be credited.

(2) Interest shall be computed, on 30th June in each year, on the amount of deferred pay standing at credit of each member at the 30th June of the previous year, and shall be credited to each member’s account annually.

Conditions of payment.

(3) Payment of deferred pay shall be subject to the following conditions:—

(a) No person entered after the 1st July, 1918, who is—

  (i) discharged “Run”;

 (ii) dismissed from His Majesty’s Service with disgrace;

(iii) dismissed from His Majesty’s Service;

(iv) discharged from the Service as “Services no longer required” on account of misconduct; or

 (v) discharged “at own request” whether “free,” “by purchase,” “by resignation,” or “voluntary retirement,”

shall be entitled to any payment under this regulation;

(b) An officer trained in the Royal Australian Naval College shall not, until he has completed twelve years’ service after attaining the age of eighteen years, be entitled to payment of deferred pay, but in special cases the Naval Board may, on completion by the officer of seven years’ service from the date of his being promoted to the rank of Acting Sub-Lieutenant, approve of the payment to the officer of the whole or portion of the deferred pay accumulated to the credit of the officer;

(c) Officers, other than those trained in the Royal Australian Naval College, shall not be entitled to payment of deferred pay until the completion of seven years’ service on full pay, and subsequent payments shall not be made until the expiration of seven years from the date of the last preceding payment or until final discharge from the active list of the Sea-going Forces, whichever first happens;

(d) A petty officer or man shall not be entitled to payment of deferred pay until he has completed the engagement into which he has entered, and subsequent payments shall not be made until the completion of each period of re-engagement or until transfer to the Royal Australian Naval Auxiliary Service.


Special exemptions.

(4) Notwithstanding anything contained in this regulation—

(a) in the event of the death of a member of the Permanent Naval Forces (Sea-going) whilst serving, the full amount of deferred pay accumulated to the credit of the member, together with interest thereon, shall be payable into his estate;

(b) in the event of such a member being invalided from the Service for causes beyond his control, the full amount of deferred pay accumulated to his credit, together with interest thereon, shall be paid to him on discharge;

(c) in special cases, the Naval Board may authorize the payment to the member of such part of the deferred pay accumulated to the credit of the member, together with interest thereon, as the Board thinks expedient, although the member concerned may not be entitled to payment in pursuance of sub-regulation (2) of this regulation; and

(d) persons entered or re-engaged prior to the 1st July, 1918, shall, for the periods of engagement or re-engagement so entered into, unless they elect to be subject to the conditions of payment of deferred pay provided by this regulation, be subject to the regulations relating to deferred pay in force at the date of the engagement or re-engagement.

Pension liability to be abated.

(5) Contributions by the Commonwealth towards pension rights of men lent from the Royal Navy shall be deducted from amounts credited to those men on account of deferred pay.

When deferred pay is not allowable.

(6) Deferred pay shall not be credited in any of the following circumstances:—

(a) during imprisonment or detention (either summarily or by court martial);

(b) during imprisonment following conviction by a civil Court;

(c) during confinement in cells; or

(d) during sick leave granted without pay.

Mulcts, sick leave, &c.

(7) In every case where active pay is drawn by ratings, deferred pay allowed shall be credited. Mulcts for leave-breaking or deductions on account of being in 2nd Class for conduct, and sick leave granted on reduced pay shall not affect deferred pay.

General.

42. The allowances provided in regulations 35 to 39 inclusive shall apply only to Officers, Petty Officers, and men of the Permanent Naval Forces (Sea-going) in receipt of sea-going rates of pay, and shall not be applicable to Officers, Petty Officers, and men of the Permanent Naval Forces (Sea-going) in receipt of consolidated rates of pay.

Victualling.

System.

43. (1) Except when otherwise ordered or approved by the Naval Board, the system of messing shall (except for officers) be that known as the “General Mess” system, and the Accountant Officer shall be responsible that the average value of rations issued shall not exceed the daily rate fixed by the Naval Board, and that all accounts are kept in the prescribed forms. The established forms shall be rendered completed in detail for each day’s transactions. The money columns in Daily General Mess Statement, Daily Abstract of Issues, and Provision Account are invariably to be completed.

Responsibility of Accountant Officer.

(2) The Accountant Officer shall be responsible for the maintenance of an adequate stock of provisions on board, for their being in good condition when received, and for the issue, in order of age and condition, and for the periodical inspection necessary to maintain such provisions in good condition. He shall see that provisions are weighed and surveyed on arrival on board, as laid down in the King’s Regulations. The minimum stock to be carried in peace time will be thirty days’ sea-going rations, viz.:—biscuit, flour, preserved meat, potatoes or preserved vegetables, sugar, chocolate, tea, milk, &c., and generally the Accountant Officer shall see that his Department is in all respects, and always, sufficiently stocked for the ship to be able to keep the sea for thirty days. To assist the Accountant Officer in regulating the requisite sea stocks, particularly of fresh provisions, the Commanding Officer shall, as far as is


practicable, see that the Accountant Officer is informed of the probable number of days for which stocks should be carried. A judicious exercise of this discretion will frequently entail considerable saving both to the Crown and the General Mess.

(3) The Accountant Officer shall take every reasonable step to insure and maintain, within his province, the comfort of the crew, and shall submit to the Commanding Officer, prior to adoption, any recommendations necessary to this end. He shall also submit to the Commanding Officer a weekly bill of fare for the men.

Allowance may be paid in cash.

(4) Officers shall draw the Ration Allowance in cash, subject to such regulations as may be prescribed by the Naval Board. Petty Officers may have the option of either drawing the allowance or of joining the general mess. If they exercise the latter option, it must be for a period of not less than one full quarter, and not be for the purpose of covering intervals when the vessel is operating in isolated waters.

(5) Allowance in lieu of rations shall be credited, in the ship’s ledger, to Officers and men only when the period of absence of leave exceeds forty-eight hours, but shall not be payable to persons proceeding on week-end leave on Friday returning a.m. on Monday.

General mess account.

(6) As a general rule, under the system of victualling referred to in sub-regulations (1) and (18), no debit balance in the General Mess Account shall be permitted at the end of the quarter, except with the approval of the Commanding Officer, who shall represent the full circumstances of the case to the Naval Board, and in such cases every effort, consistent with the proper victualling of the general mess, shall be made in the following or succeeding quarters to eliminate any accumulated debt. Credits or debits shall be carried forward from quarter to quarter. In exceptional circumstances, such as on relief, or on paying off, the Naval Board may, on production of satisfactory evidence, release the Accountant Officer of a part, or the whole, of the responsibility incurred.

(7) A report shall be prepared by the Accountant Officer at the end of each quarter, and forwarded by the Commanding Officer to the Naval Board, showing the following:—

(a) Total number victualled in general mess.

(b) Total allowance due.

(c) Value of provisions used.

(d) Debit or credit balance.

(e) Detailed explanation as to difference.

(8) A statement of numbers victualled and amount of credit or debit to date shall be handed to the Commanding Officer weekly, when the weekly reports of other heads of Departments are made.

(9) The signature to all payments of mess savings shall be that of the bonâ fide caterer of the mess.

Purchase of supplies.

(10) Where Government contracts of any kind exist, purchases of articles under contract must be made from such contractors. Should exceptional reasons justify any departure from this rule, a detailed statement is to accompany the purchase voucher showing the reasons and the Commanding Officer’s approval. When no contracts are in force, the Accountant Officer must obtain three quotations, where possible, on the special Tender Form established for the purpose. In placing orders for supplies, the lowest tender should be accepted unless for special reasons approved by the Commanding Officer.


Settlement of accounts.

(11) The Accountant Officer shall see that all accounts for provisions are paid, and outstanding matters settled, before leaving a port. Temporary receipts for supplies shall be given to contractors, and these shall be returned with final account for comparison, before payment is made, with the orders given and with the daily abstract of provisions received. Orders shall be signed by an officer, and any alterations after signature shall be legibly and distinctly initialed with a signed explanation on back of order (when amended by any person other than the officer signing the original order).

(12) When provisions are issued in exchange for sound provisions accumulated by messes, a running statement shall be kept and adjustments made after a general issue has been made, but never at intervals longer than a week.

(13) At the end of each quarter, a statement shall be forwarded to the Royal Edward Victualling Yard showing total consumption of the various items stocked by the Victualling Yard, for estimation of future requirements.

(14) Any extra issues necessary, other than for the ordinary meals, and on the hands turning out in the morning, shall not be charged against the messing allowance, but are to be included in the Provision Account and credit taken for same at the end of each quarter or period of account.

(15) In Home ports, where repayment messes draw provisions for individuals to take ashore to their homes, this concession shall apply generally to married ratings only and then, only in so far as the same is permissible by Customs or other Government Regulations, no departure from which is to be permitted under any circumstances. Other ratings may, for special reasons approved by the Executive Officer in each case, be granted the same privilege, and have their names added to a Permission List, which is to be kept in all ships. No provisions drawn in this manner shall be landed unless accompanied by the established pass for this purpose, and no rating shall be allowed to take provisions for any one month in excess of his ration allowance.

(16) All seamen’s mess utensils shall be mustered at least every three months to insure that breakages are replaced and more particularly to insure that an adequate supply is maintained in all messes to meet requirements, suitable and adequate mess traps being essential to a reasonable standard of comfort. Excess breakages due to stress of weather or circumstances other than neglect may, at the Captain’s discretion, be replaced free of charge to the messes, and, whilst recovery should be made in cases of neglect, the Accountant Officer shall bring to the notice of the Commanding Officer any action desirable for the comfort of the lower deck in connexion with victualling arrangements.

(17) Whenever possible such articles must be demanded from a Naval Victualling Yard on all occasions. When articles stocked by the Victualling Yard are obtained from other sources, a certificate should be given on the face of the purchase voucher stating why it was not practicable to obtain them from the Victualling Yard.

Issuing prices.

(18) To equalize as far as possible the conditions under which the general mess is carried on in H.M.A. Ships and Shore Establishments, and also to enable a ready comparison to be made of the degree of efficiency of the general mess in each vessel, the practice of charging


fixed issuing prices (irrespective of the original cost) for certain essential fresh provisions shall be followed. These articles and the prices to be charged the general and repayment messes, with any subsequent additions or alterations, shall be circulated from time to time in Navy Orders. Periodical fixed issuing prices shall also be adopted for Victualling Yard stocks. All other articles, the prices of which are not specially provided for, shall be issued and charged at cost price. All purchases of provisions shall be subject to such regulations as may be prescribed from time to time by the Naval Board in Navy Orders.

Quotations to be obtained.

(19) Except to meet the immediate requirements on arrival at any port, three competitive tenders shall be obtained on the established form for all supplies, and such tenders and any remarks thereon attached to the cash voucher. Where such tenders cannot be obtained an explanation shall be attached to the cash voucher.

Mess Expenses for Official Visits.—(20) Expenses incurred by Officers’ Messes in entertaining official visitors shall not be allowed as a charge against Government Funds, except in special circumstances approved by the Naval Board. When official visits of Officers of foreign warships are expected, prior approval of the estimated entertaining expenses should be applied for.

Ship’s Accounts.

44. (1) Ledger.—Pay and allowances, other than travelling, of all Officers, Petty Officers, and men (sea-going) shall be shown in the ship’s ledger, which shall be kept in duplicate, in accordance with Naval Account Regulations.

The addresses of all Officers and men shall be noted in “Remarks” column of ship’s ledger on discharge to the shore.

(2) Second Class Conduct.—The total daily pay of men in the second class for conduct shall be credited on the ship’s ledger at the full rate of pay, and a charge of one-sixth shown in the “Fines” column and brought to account as a fine.              This deduction refers only to active pay and substantive allowances.  Deferred pay, married allowance, and allowance in lieu of rations, and allowances of a temporary nature, such as torpedo-boat destroyer pay and lodging allowance, shall not be subjected to this deduction.              While any rating is thus paid, the words “2nd class for conduct” shall be noted in red ink after his rating on the ship’s ledger, transfer lists, and other documents, and the instructions laid down in the King’s Regulations and Admiralty Instructions shall be fully observed.

(3) Cells, Detention.—In all cases where ratings are undergoing punishments enumerated in regulation 40, sub-regulation (6), they shall be shown as checked to cells or detention as the case may be. Ratings undergoing such punishments shall not be borne for pay, nor the pay shown as mulct.

(4) Men absent on Sailing.—Arrangements shall be made, as the circumstances may require, by Commanding Officers in regard to the certificates and effects of men left behind at any port on sailing and in the event of difficulty arising owing to the absence of the necessary papers or information, the officers concerned shall be held responsible.

No men shall be discharged to another ship, or left behind on sailing, without pay papers or an explanation in lieu, and such other information or notice to the responsible authorities as may be desirable.

(5) Pay whlist on Leave.—When proceeding on leave for seven days or longer, Officers and men of the Permanent Naval Forces (Sea-going) may be advanced pay and leave allowance due up to the date of expiration of such leave.

When proceeding on leave for over forty-eight hours, but under seven days, pay may be advanced to Officers and men when a pay day will occur prior to the expiration of the leave only.

(6) Gratuitous Issues.—When gratuitous issues of clothing or uniform are made to members of the Permanent Naval Forces (Sea-going) to replace articles of clothing or uniform lost, the total value of such issues shall be shown in the ship’s ledger in the column “Value of Free Issues of Clothing,” and the reason and authority for such issues inserted. Gratuitous issues of clothing granted as compensation for loss shall be shown separately in ratings’ accounts and separate totals shown in the ledger and summary.

Engagements, Promotion, Retirements, Etc.

Officers.

Surgeon-Lieutenants shall be compulsorily retired—

(a) On attaining eight years’ seniority, if they have previously failed, on two occasions, to pass the Surgeon-Lieutenant-Commander’s examination:

(b) On second failure to pass, if Surgeon-Lieutenants sit for the examination after attaining eight years’ seniority; or

(c) On attaining ten years’ seniority, if Surgeon-Lieutenants fail to sit for the Surgeon-Lieutenant-Commander’s examination a second time.

Conditions of service—Officers.

Voluntary retirement may take place, subject to the approval of the Naval Board, under section 13 of Naval Defence Act 1910–18, as follows:—

(a) Except in time of war, an Officer may, by writing under his hand, resign his commission at the expiration of any time not being less than three months from the date of his resignation.

(b) The resignation shall not have effect until it has been accepted by the Governor-General.

(c) For special reasons the Governor-General may accept any resignation at any time after the receipt thereof.

Dismissal of officers.

Officers are liable to be dismissed from the service or to be compulsorily retired at any time for misconduct, in which case they forfeit all claim to deferred pay; Officers may also be dismissed, for inefficiency.


Definition of term “Service.”

(2) Service.—Service in Rank on the Active List for purposes of pay shall include all time actually served on full pay by an Officer on the Active List of the Royal Navy, Royal Australian Navy, or Navy of any of His Majesty’s Dominions.

Officers of Emergency List, Royal Australian Navy.

(3) Emergency List.—Officers on resigning their Commissions in the Permanent Service may, subject to the approval of the Naval Board, be placed on an Emergency List, and will be allowed in such cases to retain their Commissions and wear the uniform of their rank, but will not receive any pay whilst not actually employed.

Officers of the Retired List “called up” for duty in time of war or national emergency shall be permitted to count such service for purposes of increments of pay

Only Medical Officers who continue to practise their profession will be allowed to enrol on the Emergency List.

Pay of temporary Surgeon-Lieutenants.

(4) Temporary Surgeon-Lieutenants.—Surgeon-Lieutenants appointed for temporary service only, in time of war or emergency will rank with, but after, surgeons in the Permanent Service, and be subject to such regulations as may be prescribed. They will receive the allowances prescribed in regulation 35.

Engagement and Discharge of Petty Officers And Men of Permanent Naval Forces (Sea-going).

Conditions of service of petty officers and men.

46. (1) Engagements.—All ratings will be required to execute engagements to serve in the Permanent Naval Forces (Sea-going) for a first period of seven years from the date of entry, or from the date of attaining 18 years of age if such date is subsequent to date of entry. Ratings may be allowed to re-engage for further periods of five years subject to such regulations as may be prescribed, and shall, generally, be compulsorily retired after 22 years’ service from the age of 18.

Conditions of service of petty officers and men.

(2) Special Retention.—Subject to the requirements of the Fleet, ratings may be retained for a further period of five years, or, in such exceptional cases as may be approved by the Naval Board, for ten years from the age of 40.

Transference to and preference in Naval Establishments’ Appointment.

3 Civil Employment.—Men compulsorily retired from sea-going duty on account of age or invaliding who are not absorbed for Auxiliary, &c., services, will be given preference in civil employment in or connected with Naval Establishments. Writers or ships’ stewards will have opportunity of transfer for clerical duties in Naval Establishments.

(4) Special Cases.—In special cases where the date of entry is prior to the date of attaining the age of 18 years, the Naval Board may approve of the engagement dating from the date of entry.

(5) Stewards and Cooks.—The re-engagement of Officers Stewards, and Cooks, and of Ship’s Cook ratings, will be conditional on recommendation.

(6) R.N. Ratings.—Ratings lent from the Active Service of the Royal Navy will be required to engage for three years’ service, which period may, in special circumstances, be extended.

Counting previous service.

(7) Previous Service.—All previous service in the Royal Navy or Royal Marines, or in the Navy of any of His Majesty’s Dominions, will be allowed to count as if served in the Royal Australian Navy towards “service” for rates of seniority, pay, good conduct badges, and other allowances.

Note.—(See also sub-regulation 53 of regulation 38.)

Re-engagement Gratuity.

47. (1) Ratings serving in the Permanent Naval Forces (Seagoing) on the 1st July, 1920, who are permitted to amend their existing engagements to cover a period of twelve years’ service, commencing from the date—

(a) of attaining eighteen years of age, in the case of ratings entered through the Training Ship; or

(b) of first entry in the Royal Australian Navy, if entered direct from Shore,

shall be granted gratuities in accordance with the scale set forth in sub-regulation (3).

(2) The provisions of this regulation shall apply to Royal Australian Navy ratings, including ex-Royal Navy ratings, but shall not be applicable to Royal Navy ratings loaned to the Royal Australian Navy who may re-engage in the Royal Navy whilst lent to the Royal Australian Navy. In the case of ex-Royal Navy ratings, time served in the Royal Australian Navy only shall count towards qualifying service for the re-engagement gratuity and leave.

(3) The following shall be the scale of gratuities payable to ratings who amend their existing engagements:—

(4) The amount of gratuity payable in each case shall be credited to the rating’s deferred pay account and subject to the conditions prescribed in regulation 40, sub-regulations (2), (3) and (4).

Gratuity and Allowance for Good Conduct Medal.

48. Gratuity.—(1) A gratuity of £20 shall be payable to members of the Permanent Naval Forces (Sea-going), including the Royal Navy ratings, who become entitled to the award of the Long Service and Good Conduct Medal, on and after 1st January, 1920, under the conditions laid down in the King’s Regulations and Admiralty Instructions.

Allowance.—(2) An allowance of £1 per annum, in addition to the gratuity, may also be paid for each completed year of service assessed as “Very Good” subsequent to 31st December, 1919, or the date of award of the medal if such award is made later than 31st December, 1919. Payment shall be made in arrear at the end of each engagement, or upon discharge, but payment shall not be made in respect of uncompleted years, nor for more than a period of seven years.

(3) Royal Navy ratings serving in the Royal Australian Navy who become eligible for the Royal Navy Medal and Gratuity shall not be entitled to the Royal Australian Navy Gratuity and Allowance in


addition to the award provided in King’s Regulations and Admiralty Instructions, nor shall any rating be eligible for the gratuity and allowance who would have become entitled to the Long Service and Good Conduct Medal prior to 1st January, 1920, but for the fact that his character had not been continuously assessed as “Very Good.”

Allotments and Payments on Account of Pay.

Scale of pay-allotments.

49. Allotments.—(1) Allotments of active pay may be made by Officers and men of the Sea-going Forces to any person above the age of 18 years, at any rate from 10s. per month upwards within the amount of pay and allowances earned, Clothing Allowance being excluded.

Payments on account of pay

Payments.—(2) Bi-monthly payments on account of pay shall be made on the basis of fifteen days’ pay (fourteen in February) and allowances exclusive of deferred pay, less half the allotment in force and any odd pence, settlement being effected at the end of each quarter.

Deduction shall be made from bi-monthly payments on account of clothing issued and other charges. Accountant Officers shall be held responsible that payments are not made which would bring any person into debt to the Crown.

(3) Training ships will observe such special regulations as may be prescribed by the Naval Board, but, in the absence of special regulations, these Regulations shall be observed.

RecruitsCapitation and Medical Fees.

50. Capitation Fees.—(1) At places where there is no District or Sub-District Naval Office, the local Military Warrant or Non-Commissioned Officers of the Instructional Staff who act as Recruiting Officers for the Navy Department may be granted a capitation allowance of £1 for each recruit finally entered for service in the Permanent Naval Forces (Sea-going).

Medical Fees.—(2) A fixed fee of 10s. 6d. per capita shall be paid to Military Area Medical Officers for the examination of Naval Recruits at places where there is no Naval Medical Officer available.

Deserters.

Forfeiture of pay.

51. (1) A person who deserts from the Royal Australian Navy shall forfeit all active pay, allowances, and deferred pay due to him to the date of his desertion, and shall forfeit all past service for the purposes of furlough, of Good Conduct Badges, and Long Service and Good Conduct Medal.

(2) The Naval Board may in the case of recovered deserters in special circumstances approve of the restoration of any portion of the pay, allowances, deferred pay, or service forfeited by the act of desertion.

(3) In the case of those R.A.N. recovered deserters who, subsequent to desertion, joined the Australian Imperial Expeditionary Forces for active service in connexion with the war, which commenced on 4th August, 1914, the Naval Board may, in special circumstances, approve of the restoration of any portion of the pay, allowances, deferred pay, or service forfeited by the act of desertion, and may allow time served in those Forces, or any portion of such time, to count in the Royal Australian Navy for the purpose of furlough, of Good Conduct Badges, and Long Service and Good Conduct Medal.


(4) Where death of a deserter from the Royal Australian Navy occurred whilst on active service with the Expeditionary Forces above mentioned the full amount of active pay, deferred pay, and other allowances due to deceased at date of desertion may, on the approval of the Naval Board, in special circumstances, be payable to deceased’s estate.

(5) Clothing gratuity balance at credit at date of desertion, under regulations in force prior to 1st January, 1918, shall not be remediated to the member’s account after 1st January, 1918, if subsequently recovered from desertion.

52. Effects.—(1) The Captain shall cause the clothes and effects of a deserter to be delivered into the charge of the Accountant Officer, together with an inventory signed by two or more persons.

Effects—sale of, by auction.

(2) After the expiration of three months from the date of desertion the Captain shall authorize the clothes and effects of a deserter to be sold on board by auction.

(3) The proceeds of such sale shall be credited by the Accountant Officer to Revenue.

Rewards—payment of.

53. Rewards.—Rewards for arrest of deserters may be paid as follow:—

Up to a limit of £2 for a straggler.

Up to a limit of £6 for a deserter or presumed deserter.

The amount of the reward, within above limits, shall be at the discretion of the Officer issuing the warrant, and shall, together with any expenses incidental to arrest, be charged against the pay of the deserter or straggler earned subsequently to arrest.

Subsistence of Prisoners in Civil Gaols.

54. (1) When any member of the Permanent Naval Forces (Seagoing) is in a civil gaol—

(a) prisoner undergoing sentence;

(b) in civil custody as a deserter or absentee; or

(c) awaiting trial for a civil or naval offence

the cost of his subsistence shall not be payable from Commonwealth Funds, but is a charge against the State Government concerned under Section 120 of the Constitution, which enacts that every State shall make provision for the detention in its prison of all persons accused or convicted of offences under the laws of the Commonwealth.

(2) Accountant Officers shall not, therefore, accept claims made by the various Police Departments for reimbursement of cost of subsistence of members of the Permanent Naval Forces (Sea-going).

Purchase of Discharge.

55. (1) Petty Officers and other ratings may, in peace time, be permitted, subject to the approval of the Naval Board, to purchase their discharge on the following terms:—

(a) Up to but not exceeding one month from date of first entry, £10.

(b) After one month, but not exceeding three months from date of first entry, £20.


(c) After three months from date of first entry—

Boys under eighteen years of age, £40.

Men—

Up to four years’ service since date of engagement, £48.

Over four years and up to six years’ service since date of engagement, £36.

Over six years’ service since date of engagement, £24.

Time served as boy shall not be allowed to count as “service.”

(d) After re-engagement, £20, and refund of any re-engagement gratuity paid.

Service must be actual service in receipt of wages, as recorded on the Service Certificate.

(2) In special circumstances, the Naval Board may approve of the discharge of a rating without payment of purchase money, or may reduce the amount of purchase money required in the above scale.

Re-entry After Discharge by Purchase.

56. Ratings, except boys, discharged by purchase from the Royal Australian Navy and subsequently allowed to re-engage in the Service within a period of two years from date of their discharge, may, on the approval of the Naval Board, be refunded one-half of the amount paid for discharge in each case, or the full amount paid when deferred pay has been forfeited, provided an engagement to serve for five years is executed on re-entry of the rating concerned.

R.A.N. Auxiliary Services (Non-sea-going).

Pay and Allowances.

57. Conditions of Service.—(1) The R.A.N. Auxiliary Services shall comprise the R.A.N. Reserve Staff, R.A.N. Radio Service, Naval Instructor Staff R.A.N. College, and Naval employees permanently appointed for duty in H.M.A. Naval Depôts, Establishments, and Offices.

(2) Members of the Auxiliary Services shall be subject to the provisions of the Naval Discipline Act. They shall be considered members of the Permanent Naval Forces (Non-Sea-going), and will be required to wear uniform on duty, and at all times when uniform is required to be worn by the Sea-going Forces.

58. Appointment.—(1) Appointments to the Auxiliary Forces shall be subject to such conditions and qualifications as may be prescribed by the Naval Board, and will, as far as possible, be made from persons of long service in the Sea-going Forces.

(2) All appointments and re-engagements shall be subject to recommendation, vacancies existing, and the approval of the Naval Board, and irrespective of the period of engagement entered into shall only be for such period for which a member’s services are required.

(3) When serving or undergoing training in H.M.A. Ships, members of the R.A.N.R. Staff shall receive the rates of pay and allowances for corresponding members of the Permanent Naval Forces (Sea-going) in accordance with regulations 33 (11) and 34 (7).

Scale of pay.

59. Rates of Pay.—(1) The following consolidated rates of pay, inclusive of all allowances (except travelling and other allowances specially provided), shall apply to persons appointed for permanent duty on shore in the R.A.N. Auxiliary Services:—

60. Uniform Gratuities on First Appointment.—(1) Ranks and ratings transferred direct from the Sea-going Forces will receive no outfit gratuity on transfer, except in regard to ratings required to change class of uniform, who will receive gratuities as per scale in sub-regulation (3).

61. Uniform Gratuity on Promotion subsequent to Entry.—On advancement subsequent to entry, all ranks and ratings of the R.A.N. Auxiliary Services shall be entitled to uniform gratuities, as follow:—

Provided that on promotion from Petty Officer Telegraphist (old scheme) to Chief Petty Officer Telegraphist in which case no change of uniform is required, no gratuity shall be payable.

62. Uniform gratuities shall not be payable again on re-engagement in the Auxiliary Services.

63. Gratuity and Allowance for Good Conduct Medal.—Chief Petty Officers, Petty Officers and other ratings on the Royal Australian Naval Reserve Staff whose combined service in the Permanent Naval Forces (Sea-going) and on the Royal Australian Naval Reserve Staff entitles them to the award of the Royal Australian Navy Long Service and Good Conduct Medal may be paid the gratuity of £20 and the allowance of £1 per annum subject to compliance with the conditions prescribed in regulation 48 of these Regulations for ratings in the Permanent Naval Forces (Sea-going).

63a. Increments.—(1) All increments shall be subject to such conditions as may be prescribed by the Naval Board, and to the necessary provision on Estimates being approved.

(2) Increments shall be payable as from the date they actually fall due.

(3) “Acting” time served in a rank or rating shall not count for purposes of increments of pay.

64. Advancement.—(1) Advancement after joining the Auxiliary Services will be subject to such regulations as may be prescribed by the Naval Board. Members of the Auxiliary Services, below the rating of Chief Petty Officer, possessing the necessary qualifications may, if not otherwise promoted, and subject to the existence of vacancies and Naval Board approval, be advanced to the next higher rating after one year’s service at the maximum pay of their rating. Messengers, coxswains, storemen, general workmen, caretakers, &c., shall not, however, be eligible for promotion to Chief Petty Officer, except in the case of senior messengers at Navy Office and Naval Establishments, who may be so promoted, but shall not be advanced beyond a salary of £204 per annum.

(2) Chief Petty Officers of the Sea-going or Auxiliary Forces will, if transferred or reverted to a position in the Petty Officer grade, receive the maximum pay of the Petty Officer grade only; but they may be allowed to retain the uniform of the rating of Chief Petty Officer.

65. Recreation Leave.—(1) Recreation leave shall be granted on full pay under the conditions prescribed for the Permanent Naval Forces in the Naval Forces Regulations.

(2) Persons appointed to the Royal Australian Naval Reserve Staff from the Permanent Naval Forces (Sea-going) and permitted to carry forward recreation leave not taken prior to date of transfer may, on the approval of the Naval Board, be granted such leave subsequently but at R.A.N.R. Staff rates of pay only.


Civilian Officers.

Professional Division.

66. (1) The Professional Division shall include all Officers who, prior to 1st July, 1918, were appointed by the Governor-General as Ship Constructor, Engineer Constructor, Draughtsman, Engineer for Electrical Equipment, or Assistant Engineer for Electrical Equipment, and all officers hereafter appointed by the Governor-General to the Professional Division, and shall be divided into classes.

(2) Officers in Class A.1 shall be paid such salaries as are approved by the Minister from time to time, and are appropriated by Parliament.

(3) Officers, other than those in Class A.1, shall be classified as under:—

(4) Officers in Classes “E” and “F” may be granted, on the approval of the Naval Board, annual increments of £18 each, subject to good conduct, diligence, and efficiency.

(5) Officers in Classes “C” and “D” may be awarded increments of £18 each at the discretion of the Naval Board.

(6) Officers in Class “B” may be awarded increments of £24 each at the discretion of the Naval Board.

(7) Officers in Class “A.2” may be awarded increments of £100 each at the discretion of the Naval Board.

(8) Notwithstanding anything in this regulation, the Naval Board may grant an officer any salary within the limits of his class, but an officer who has attained the age of 21 years shall not be paid less than £132 if unmarried or £156 per annum if married, provided that seniority shall not be affected by any salary granted merely because of age or marriage.

(9) The Governor-General may, upon the recommendation of the Naval Board, determine the classification of any officer of the Professional Division or may promote an officer from one class to a higher class to fill a vacancy or a new position.

(10) From the first day of September, 1919, the provisions of Clauses 3, 4, 5 and 6 (or any variation thereof) of the Award of the Commonwealth Court of Conciliation and Arbitration, No. 49 of 1917, relating to officers of the Professional Division of the Commonwealth Public Service, shall apply to officers included in the Professional Division under sub-regulation (1) of this regulation.

(11) From the first day of September, 1919, the provisions of Part 1. (so far as it relates to leave of absence and furlough) and Part VIII. (relating to Travelling and other allowances) of the Regulations under the Commonwealth Public Service Act 1902-1918, applicable to officers


of the Professional Division, shall apply to officers included in the Professional Division under sub-regulation (1), except where inconsistent with the provisions of sub-regulation (10), provided that where in the Public Service Regulations any power is vested in or any action is prescribed to be taken by the Chief Officer, Permanent Head, Public Service Inspector, or Public Service Commissioner, such power shall be vested in or such action shall be taken by the Naval Board or any person named thereby.

(12) Persons temporarily employed in positions appropriate to the Professional Division shall be deemed to be temporary Professional Officers and shall be entitled to the same rates of pay and increments as permanent officers, provided that until such persons complete two years’ service, increments shall be discretionary. The benefits prescribed by sub-regulations (10) and (11) of this regulation shall apply also to temporary Professional Officers except that the provisions of Public Service Regulations in regard to sick leave and extended leave without pay shall not apply to any temporary officer who has not completed three years’ continuous service.

Naval Staff Clerks.

Rates of pay—Naval Staff Clerks.

67. (1) Naval Staff Clerks shall be divided into five classes. The rates of pay shall be as follows:—

(2) The Act and Regulations governing the classification, pay, increments, and allowances of the Clerical Division of the Commonwealth Public Service shall apply generally to Naval Staff Clerks.

Provided that the Award of the Commonwealth Court of Conciliation and Arbitration, No. 10 of 1919, in respect of members of the Australian Commonwealth Public Service Clerical Association, shall apply to Naval Staff Clerks in all cases when the provisions of the Commonwealth Public Service Act and Regulations are not in agreement with such Award.

(3) The granting of increments shall be subject to the recommendation of the Naval Board and the approval of the Minister.

(4) Notwithstanding the provisions of sub-regulation (2), the Minister may, when it appears expedient or desirable in the interests of the Department, appoint an Officer at any salary within the limits of Class IV. and V., and may in special circumstances advance an officer from a subdivision of a Class to a higher subdivision of the same Class, although he has not served one year in each of the subdivisions lower than that to which he is advanced.


Allowances to Junior Officers Appointed Away from Home.

68. Officers of the Professional Division and Naval Staff Clerks appointed or transferred away from their homes may be paid an allowance in addition to salary of such sum as may be approved by the Minister. Provided that no allowance shall be paid under this regulation of a sum which, added to salary, would raise an Officer’s total remuneration above £84 per annum, nor shall any allowance be paid in any case where, in the opinion of the Minister, the circumstances do not warrant such payment.

Positions of officers on furlough may be filled.

Positions of Persons on Leave or Furlough.

69. The positions of Officers who are granted leave of absence or furlough prior to retirement may be filled before actual retirement at the expiration of such leave of absence or furlough takes place, provided funds are available on the Appropriation.

Allowances to Naval Brigade Chaplains.

70. (1) Allowances for religious ministrations to seamen may be paid to persons appointed as Naval Brigade Chaplains as set forth in the following sub-regulations:—

(2) In the case of occasional ministrations, e.g., at ports which are not regularly visited by a ship or squadron, at the rate of 6d. per head per service of those actually attending the services.

(3) At ports where ships are more or less permanently stationed, and the duties performed include visitation of the crews and the sick in hospital in addition to the conduct of Divine Service, at the rate of 26s. per head per annum based on the average number, taken quarterly, of Officers and men of the particular denomination present at the port on each Sunday morning during the period the ministrations are given. The numbers shall be communicated by the Senior Officer to the Chaplain on his requisition.

Special service.

(4) Where it is necessary for the Chaplain to hold a special separate service exclusively for the benefit of seamen, an allowance of £1 for each such service may be paid in addition to the capitation allowance.

(5) Payment of these allowances shall be subject to such conditions as may be prescribed by the Naval Board.

PART V.

Compensation for Injuries.

Compensation for injuries received or disease contracted on duty—Permanent Forces.

71. Assessment.—(1) Compensation may be recommended by a Board consisting of three medical officers appointed to inquire into the case of any member of the Permanent Naval Forces who is retired or discharged on account of wounds or injuries received, or disease contracted due to service, provided the wound, injury, or disease was not due to the member’s default. The medical officers selected shall be the most senior available. When three medical officers are not available, two senior medical officers may form the Board.


(2) The Board of Survey must, in every case in which compensation is recommended to be paid, make a definite recommendation:—

  (i) That the member is recommended for discharge,

(a) on account of wounds or injuries received on duty;

or

(b) on account of disease contracted on duty.

 (ii) That the wound, injury or disease was not due to the member’s default.

(iii) As to the degree of disability of the member in accordance with the scale prescribed in sub-regulation (3). A complete history of the case and description of the injuries or disease must also be submitted with the report of the Board of Survey.

(3) The compensation which the Naval Board may approve shall be according to the following scale:—

(a) The maximum amount.

(b) Three-quarters of the maximum amount.

(c) One-half of the maximum amount.

(d) One-quarter of the maximum amount.

(e) One-eighth of the maximum amount.

(f) One-sixteenth of the maximum amount.

Permanent injuries.

(4) The maximum amount shall be a sum equivalent to three years pay, including any allowance in cash or kind for quarters, clothing, and rations at the rate received by or allowed to the member or valued at in these Regulations at the date of his retirement or discharge. The maximum amount shall only be awarded in case of total disability to earn a livelihood. In case of partial disability, the compensation shall be less than the maximum amount, and shall be fixed in accordance with the scale, so that the amount awarded shall be proportionate to the degree of disability of the member, as may be determined by the Naval Board.

72. Widows and Families.—Compensation may be recommended by a similar Board of Medical Officers to that prescribed in regulation 71, sub-regulation (1), for the case of the widow and family of any member of the Permanent Forces who is killed when on duty, or dies of any disease contracted due to the service, if the death or disease was not due to the member’s default. The amount of compensation awarded shall not exceed three years’ pay, as defined in sub-regulation (4) of regulation 71, at the rate valued at in these Regulations, or received by, or allowed to, the member at the date of his death. No claim for compensation shall be considered unless it is made within twelve months after the death of the member.

73. Minor Injuries.—(1) The Naval Board may authorize payment of a gratuity not exceeding a maximum of £8 in each case, to Chief Petty Officers, Petty Officers, and men invalided or discharged who, at date of discharge are suffering from any disabilities resulting from minor injuries sustained on duty for which a Hurt Certificate (Form A.M.183) has been granted in accordance with Regulations. Such gratuity shall be payable at the expiration of the rating’s engagement only, and be in addition to any compensation awarded under the provisions of regulation 71 of these Regulations in respect of any other disability.

(2) The following condition shall apply generally to payment of the gratuity:—

  (i) The injury must be one for which a Hurt Certificate has been granted, but possession of a Hurt Certificate shall not entitle any rating to the gratuity where no disability exists.

 (ii) The amount of gratuity shall be assessed by a Board of Survey consisting of, at least, two Medical Officers, due regard being given to the rating’s future occupation.

(iii) The Board of Survey shall assess, separately, the gratuity for any disability arising from any previous minor injury for which a Hurt Certificate is held in any case where the rating is being invalided in consequence of a hurt or sickness attributable to the Service.

(iv) The Naval Board shall determine the amount of gratuity, if any, payable, each case being dealt with on its merits.

PART VI.

Travelling Allowances.

Permanent Naval Forces (Sea-going).

74. Scale of Travelling Allowances.—(1) The following shall be the rates of Travelling Allowances which may be drawn by members of the Permanent Naval Forces (Sea-going) when travelling on duty and in receipt of Sea-going rates of pay:

(2) The minimum period of absence for which payment may be made is six hours.

(3) The following sub-regulations, and regulations 74a to 74d inclusive, shall also apply to members of the Permanent Naval Forces (Sea-going) when travelling on duty and in receipt of Sea-going rates of pay.

(4) Travelling Allowance is payable only up to a maximum period of fourteen days, except in such special cases as may be approved by the Naval Board. Members of the Sea-going Forces on duty involving a longer absence than fourteen days shall draw the rates of Lodging Allowance specified in regulation 35, sub-regulation (11) only, in addition to Ration Allowance.

(5) Officers, in receipt of ration allowance detached for duty on shore or in other ships for periods of less than six hours, will be paid an allowance of 1s. 6d. per meal. Petty Officers and men detached for duty on shore, for periods of less than six hours, shall receive an allowance of


1s. per meal. Such payments shall only be made on certificate of Commanding Officers that absence was necessary during the prescribed meal hours.

(6) Officers temporarily loaned to other ships for periods exceeding six but under 48 hours, who are required to continue their mess subscription in their own ship in their absence, may receive an allowance of 3s. per full day, with the meal allowance (not exceeding 3s. for any one day) for any broken period.

Payment will be made, in such cases, in the ship from which the Officer is loaned.

(7) In the cases of Officers and men absent over forty-eight hours, whose Ration Allowance has been credited during their absence, a deduction of 1s. 8d. per diem (or 1d. per hour for broken periods under twenty hours) is to be made from the above Travelling Allowance but not from the reduced Lodging Allowance payable after fourteen days’ absence. The number and date of cash vouchers are to be noted in remarks column of ledger, and a notation as to whether or not they are drawing Ration Allowance is to appear on voucher.

(8) Travelling Allowance shall not be payable concurrently with Lodging Allowance or Allowance in lieu of rations, or when quarters are provided at place of duty, except that Officers in receipt of the annual rate of Lodging Allowance may draw such allowance concurrently with Travelling Allowance in cases where absence from their Head-quarters of duty does not exceed seven days and lodgings are retained.

(9) The above rates of Travelling Allowance are exclusive of any cost of conveyance by rail, coach, or steamer; and, in computing the period, the time shall be counted from the time of departure by train, coach, or steamer to the time of return by the same.

(10) Where it is proved to the satisfaction of the Naval Board that the Travelling Allowances a member is entitled to draw under these Regulations do not cover his actual expenses, the Naval Board may authorize payment of an increased rate of Travelling Allowance, or the Naval Board may reduce the rates of Travelling Allowances under the scale, when circumstances appear to justify such a course. Travelling Allowance shall not be payable when travelling by steamer or other vessel, or by railway, in which quarters and rations are provided.

(11) Officers travelling overseas on duty, in such special cases as may be approved by the Naval Board, may receive the passage money and be allowed to make their own arrangements for passage, provided that, except where otherwise approved, such Officers shall travel by the cheapest and most direct route. Where, in special circumstances, approval to travel by another route is given at an Officer’s own request, the additional expense thus incurred must be borne by such Officer. In every case, Shipping Companies’ 1st class vouchers must be produced for the full sum advanced.

(12) In those cases where Officers and men are entitled to passages by sea or rail, at Commonwealth expense, for their wives and families, the term “children” is to be understood to include only such sons as are not over 16 years of age at the date of commencement of the journey, and unmarried daughters dependent on and residing with their fathers. An exception to this rule may be permitted in the case of sons over 16 years who, by reason of physical or mental infirmity, are necessarily dependent on their parents.


Steamer, rail, or other fares of adopted children are not allowable except under special circumstances with the approval of the Naval Board.

Cab Hire (including Taxi Cabs).—(13) Cab hire shall be allowed to Officers only when travelling with baggage.

(14) Cab hire will not be allowed when railway or other ordinary public conveyance is available. Claims for cab hire must be supported by a statement showing the necessity for using carriages or cabs, also the places from and to, and distance travelled.

(15) Cab hire will not be admissible for distances of less than 2 miles, unless baggage of a bulky nature or of over 28 lbs. weight is necessarily taken, or unless such conveyance is required for necessary saving of time apart from all circumstances under the Officers’ own control. A full explanation of the circumstances must accompany each claim, and the distance travelled, together with the places from and to, must in every case be shown.

(16) Cab hire shall be allowed to Petty Officers when travelling with baggage if no cheaper mode of conveyance is available.

(17) When cab hire is claimed for more than 5s., receipt for such payment must accompany claim. Claims for cab hire at rates in excess of the legal fares are not admissible. Claims for hire of taxi-cabs shall not be admitted where the rates for hire of such cabs exceed the rates for hire of ordinary cabs.

(18) When an Officer or Petty Officer proceeds on duty by rail or steamer, the amount which may be approved for cab or taxi hire between ship, depôt or home and railway station or steamer shall be limited to 5s. except in special cases when the Officer in Command may approve of a larger amount being paid on production of supporting receipt. When such special approval is given the reason shall be stated on the voucher.

(19) When two or more Officers or two or more Petty Officers proceed from one quarter on the same duty, a separate cab will not be allowed for each, unless it be shown that it was impracticable for the Officers or Petty Officers to perform the journey together.

(20) Claims for cab or carriage hire will not be admissible in connexion with attendance at levees, reviews, arrival and departure of Governors or other ceremonials, the paying of official calls, or on any occasion of a similar nature, except as provided in the following paragraph.

(21) Cab hire will be permitted only for official calls which are compulsory for official purposes, and in the case of officers not in command claims for cab hire for such purposes must be so certified by the Commanding Officer on voucher.

Motor Cars.—(22) Claims for hire of motor cars in excess of One pound must receive the prior approval of the Naval Board. Motor cars are only to be engaged when their use is as economical as cabs.


Accommodation, Class of.—(23) The following shall be the classes of accommodation by rail and sea when travelling on duty in Australia:—

(24) Chief Petty Officers when travelling by rail on duty on Inter-State journeys may be granted first class accommodation, but this concession shall not include Sleeping Berth accommodation.

(25) Commanding Officers may assign a superior class of accommodation to invalids upon medical recommendation; and, in special cases, to others where suitable accommodation by sea is not available.

(26) Petty Officers shall generally be given 2nd Class accommodation when travelling by mercantile vessels, except that, when travelling in company with members of the Royal Navy, they shall conform to the arrangement being adopted for such ratings.

(27) When drafts are sent by train, seats shall be reserved, whenever possible, in proximity, in one or more compartments, for the Petty Officer in charge or sub-charge and men. No person is to travel on duty by sea without an official order or other document of identification.

74a. General.—(1) Claims for Travelling Allowance (including any expenses incurred for conveyance of baggage) and for Travelling Expenses shall be prepared in full detail, and in order of occurrence, on the usual voucher form, to be submitted for payment not later than one month after the completion of the journey.

(2) Claims for increased rate of travelling or other allowances consequent on promotion to higher rank shall not be admitted for any period prior to date of gazettal or notification of the promotion.

(3) Officers and others holding temporary or acting rank shall draw the allowances of such rank.

(4) No officer shall travel on duty without first obtaining the written instructions of his Commanding Officer, and such Commanding Officer, before issuing such instructions, shall satisfy himself that the travelling is necessary, and shall state the nature of the duty on the written authority.

(5) All persons, on first taking up appointments within the Commonwealth, must join at their own cost, and no travelling or other expenses shall be allowed for themselves, wives, or families, provided that in exceptional circumstances the Naval Board may approve payment of travelling or other expenses on first appointment.

(6) Ratings belonging to the Permanent Naval Forces lent to vessels or services in which they have to contribute to a higher official rate of messing shall be allowed the difference, subject to the approval of the Naval Board in each case.

(7) Gratuities to railway porters, stewards, &c., are inadmissible, but porterage outside a railway station will be allowed for journeys with baggage of a bulky nature, or of over 28 lbs. in weight, when cab hire is not charged.


74b. Recruits.—Recruits entered in the Permanent Naval Forces (Sea-going) in one place and proceeding to join a ship or depôt in another place may receive travelling allowance and be provided with accommodation by rail or steamer as per scales prescribed in sub-regulations (1) and (23) respectively, of regulation 74.

74c. Government Fares.—(1) Railway warrants shall be prepared in such form and under such conditions as may be prescribed by the Naval Board.

(2) Railway warrants are in the nature of cheques drawn on the Department of the Navy and shall be prepared and issued with every regard to the prevention of unauthorized use and to insuring that accounts can be readily checked and passed for payment.

(3) Officers and men proceeding to complete unexpired leave after recall shall be entitled to railway warrants for both the forward and return journeys, but shall not be entitled to such railway warrants or any expenses in the following cases:—

  (i) Where the unexpired portion of the leave subsequent to recall will not admit of at least twenty-four hours being spent at their destination;

 (ii) where additional leave is granted in excess of four days over the unexpired period of leave originally granted; and

(iii) where they are aware, before proceeding on leave, that it is probable they will be recalled.

(4) Warrants chargeable to the Department of the Navy may be issued in the following cases:—

  (i) Officers and men given Christmas leave at Sydney or Melbourne, in respect to the journey beyond Adelaide or Brisbane to home, such ranks and ratings themselves meeting the cost of the journey as far as Adelaide or Brisbane.

 (ii) Boys on leave from the Training Ship to their homes at Christmas, and on final leave from Training Ship prior to being drafted to sea service, provided that a period of three months has elapsed since return from Christmas leave.

(5) Ratings discharged—

  (i) time expired,

 (ii) for misconduct,

(iii) invalided,

(iv) demobilized,

may be granted free railway or steamer warrant to actual place from which they were originally recruited within the Commonwealth, or to Port Division, as they may elect. Railways are to be used whenever possible.

Ratings discharged at own request whose engagements have not expired must themselves defray the cost of return to actual place whence they were recruited or to their Port Division.


74d. Freight.—(1) Payment, according to the following scale, for freight on service baggage actually necessary to be carried will be allowed to Officers and Men of the Permanent Naval Forces (Seagoing) travelling on duty, and in receipt of Sea-going rates of pay:

(2) Chaplains will be allowed 2 cwt. for books, Medical Officers 2 cwt. for professional books and instruments, and Officers in charge of Paymasters’ Accounts 1 cwt. for books and accounts in addition to their allowance of Baggage according to their seniority, as already defined.

(3) In all cases where Naval transport is available it must be used.

(4) When an Officer or rating is travelling on duty by rail with service baggage in excess of the weight allowed by the Railway Department to be carried free of charge, a railway warrant shall be issued to cover such baggage.

Where the weight for which the railway warrant is issued is in excess of the weight allowable under the scale prescribed in sub-regulation (1), the Commanding Officer shall be responsible that recovery of the cost of such excess is obtained from the Officer or rating concerned.

(5) Payments for Travelling Allowances made under previous regulations, prior to receipt of these Regulations in H.M.A. Ships, are not to be adjusted to the foregoing scales.


Royal Australian Naval Auxiliary Services, etc.

75. Scale of Travelling Allowances.—(1) The following shall be the rates of Travelling Allowance payable to members of the Royal Australian Naval Auxiliary Services, Officers holding a rank or relative rank, and persons on consolidated rates of pay not holding rank or relative rank when travelling on duty, and required to be absent from their head-quarters or temporary head-quarters overnight:—

(2) The minimum period for which payment is allowable is six hours.

(3) Except where otherwise provided in these Regulations, Civilian Officers not holding a rank or relative rank shall receive Travelling Allowance at the rates and in accordance with the conditions prescribed for the rank of Officers of the Royal Australian Naval Auxiliary Services of equivalent salary, provided that an Officer holding honorary rank may receive Travelling Allowance prescribed for his rank, or salary, according to whichever rate is the higher.

(4) The following sub-regulations, numbered (5) to (17) inclusive, shall also apply to members of the R.A.N. Auxiliary Services, Officers holding rank or relative rank, and persons on consolidated rates of pay not holding rank or relative rank, when travelling on duty.

(5) In the case of transfer temporarily from Head-Quarters to take up duty at another station for more than fourteen days, a reduced allowance at the following rates shall be paid, after the first period of seven days, in lieu of the daily rate prescribed above:—

(6) Allowance where Official Quarters or Private Residence is not Available.—Where a person, upon transfer, cannot enter into occupancy of quarters or private residence through unavoidable delay in transmission of furniture and household effects, or for any other reason approved by the Naval Board, and the person must therefore reside, for the time being, with his family at an hotel or other house of


accommodation, the Naval Board may approve of payment to such person of travelling allowance for a period not exceeding fourteen days as from date of his arrival; provided that the maximum amount payable shall not exceed the ordinary daily rate of travelling allowance for the first seven days and half of the ordinary daily rate for the other seven days or portion thereof.

(7) Unless otherwise provided for, where a person on consolidated rates of pay, whilst carrying out duties other than his own, receives additional salary equal to or greater than this reduced allowance, he shall not be entitled to any allowance; but, where the salary does not amount to the reduced allowance, he may be paid the difference.

(8) The means of conveyance shall be by railway, if the cost be not greater than by other mode of conveyance.

(9) When travelling by steamer, or other vessel, or by railway, in which the fare paid includes subsistence, one-quarter of the ordinary rates shall be allowed.

(10) The above rates of Travelling Allowances are exclusive of any cost of conveyance by rail, coach, or steamer, and, in computing the period, the time shall be counted from the time of departure by train, coach, or steamer, to the time of return by the same.

(11) Where it is proved to the satisfaction of the Naval Board that the Travelling Allowances a member is entitled to draw under these Regulations do not cover his actual expenses, the Naval Board may authorize payment of an increased rate of Travelling Allowance, or the Naval Board may reduce the rates of Travelling Allowance under this scale where circumstances appear to justify such a course. Officers travelling overseas on duty in such special cases as may be approved by the Naval Board may receive the passage money, and may be allowed to make their own arrangements for passage, but in such cases Shipping Companies’ vouchers must be produced for the full sum advanced

Cab Hire (including Taxi-cabs) and Motor Car Hire.—(12) Sub-regulations 13 to 22 inclusive of regulation 74, as prescribed for members of the Permanent Naval Forces (Sea-going), shall apply to members of the Royal Australian Naval Auxiliary Services and persons in receipt of consolidated rates of pay either holding or not holding rank or relative rank.

Accommodation.Class of.—(13) Persons holding rank or relative rank shall receive accommodation as prescribed for members of the Permanent Naval Forces (Sea-going) in receipt of Sea-going rates of pay, and be subject to such other conditions as are prescribed in sub-regulations 23 to 27 inclusive of regulation 74; provided that first class fares shall be allowed to Chief Petty Officers, also their wives and children, when travelling at Government expense by steamer or other vessel on the Queensland or Western Australian Coast or by narrow-gauge railway in Queensland, South Australia, or Western Australia.

(14) All persons, not holding rank or relative rank and in receipt of consolidated rates of pay, whose salary is £200 or over per annum shall be allowed first class fare. In all other cases, second class fare shall be allowed; but first class fare may be allowed to such persons under the same conditions as prescribed for Chief Petty Officers in paragraph above or in any case approved by the Naval Board.


Scale of Meal Allowance for Journeys under Six Hours.—(15) Members of the Royal Australian Naval Auxiliary Services, Officers holding rank or relative rank and persons not holding rank or relative rank, in receipt of consolidated rates of pay, detached for temporary duty and required to travel for periods of less than six hours may receive Meal Allowance at the following rates:—

(16) The amount payable in respect of meals shall be the actual amount necessarily expended, but in no case shall the amount allowable exceed the amount prescribed above.

(17) No payment shall be made to meet expenditure on the first meal partaken away from the usual place of residence of the person, not for any meal obtained before the following hours:—

76. General.—(1) Claims for Travelling Allowances (including any expenses incurred for conveyance of baggage) and other Travelling Expenses shall be prepared in full detail and in order of occurrence, on the usual Voucher Form, and be submitted for payment not later than one month after the completion of the journey.

(2) Claims for increased rate of Travelling or other Allowances consequent on promotion to higher rank shall not be admitted for any period prior to the date of gazettal or notification of the promotion.

(3) Officers and others holding temporary or acting rank shall draw the allowances of such rank. No officer shall travel on duty without first obtaining the written instructions of his Commanding Officer, and such Commanding Officer, before issuing instructions, shall satisfy himself that the travelling is necessary, and shall state the nature of the duty on the written authority.

(4) All, persons on first taking up appointment within the Commonwealth must join at their own cost, and no Travelling or other expenses shall be allowed for themselves, wives, or families, provided that in exceptional circumstances the Naval Board may approve payment.

(5) Notwithstanding the provisions of sub-regulation (4), Officers and men, on first taking up appointment in the Royal Australian Naval Auxiliary Services after long service afloat in the Permanent Naval Forces (Sea-going), may, on the approval of the Naval Board, be paid transfer and removal expenses, as prescribed in sub-regulations (1), (2)


and (3) of regulation 77, when they reside in another State than that to which they are appointed, or on taking up first appointment and required to transfer their residence from the capital city to an outport within a State; provided that such appointments are made direct from the Sea-going Forces, or within a period of six months from the date of discharge from the Sea-going Forces.

(6) Members of the Naval Reserves shall become entitled to Travelling Allowance, as prescribed in regulation 74 to 74d for corresponding ranks and ratings of the Permanent Naval Forces (Sea-going) on Sea-going rates of pay, only when ordered to proceed on special duties outside their ordinary duties at Inspections, Parades, Drills, or Annual Training; except that, when proceeding to or returning from Annual Training and required to travel long distances, payment of Meal Allowance may be made at the rates proscribed in sub-regulation (15) of regulation 75. Payment of Meal Allowance under similar conditions may also be made to Naval Cadets proceeding to or returning from Camps.

(7) Chaplains attending camps of training are not entitled to Travelling Allowance.

(8) Gratuities to railway porters, stewards, &c., are inadmissible, but porterage outside the railway station will be allowed for journeys with baggage of a bulky nature, or over 28 lbs. in weight, when cab hire is not charged.

77. Transfers and Removals.—(1) When a member of the Royal Australian Naval Auxiliary Services or other person on consolidated rates of pay is transferred from a District, Sub-District, or station to another District, Sub-District, or station, the actual cost of rail, steamer, coach, or other fares, at Government rates, of such member, his wife, and children (as defined in sub-regulation (12) of regulation 74) shall be paid by the Department, in addition to Travelling Allowance for such a member, provided such transfer is not made by way of punishment, or at the member or person’s own request.

(2) Reimbursement of cost of removing furniture shall be subject to the following limitations:—

(3) In providing for cost of removal only necessary household furniture and effects shall be taken into consideration.

(4) In very exceptional circumstances where it can be satisfactorily proved that the amount as set out in sub-regulation (3) above is not sufficient to cover the actual cost of removal of necessary household furniture and effects, the District Naval Officer or Officer in Charge may recommend, for the approval of the Naval Board, the payment of an additional amount towards such actual cost.


(5) Before removal is undertaken the person shall, where practicable, obtain quotations in writing from at least two carriers and submit same to the District Naval Officer or Officer in Charge, who may authorize the acceptance of the more suitable, provided that the maximum amount prescribed is not exceeded.

(6) The Naval Board may, in lieu of cost of removal, authorize payment of an amount not exceeding the maximum prescribed for removal expenses to compensate for loss in any case where an officer elects to dispose of his furniture and effects instead of removing them to his new station. Applications under this sub-regulation must be supported by account sales, receipts for goods purchased to replace those sold, and such other evidence as may be required.

(7) Persons shall not be entitled to any compensation for losses or damages arising from removal, nor to repayment of cost of insurance on household furniture and effects in transit.

(8) Furniture, where practicable, shall be removed by railway if the cost be not greater than by other means of conveyance.

(9) Vouchers must be produced for all sums paid.

78. (1) Members of the Royal Australian Naval Reserve Staff employed in camps of training or, in time of war or emergency on continuous or other duty which necessitates their absence overnight from their usual place of residence, shall be entitled to rations in kind at the rate prescribed for members of the Permanent Naval Forces (Sea-going).

(2) Meal Allowance, as prescribed in sub-regulation (3), shall not be payable concurrently with Travelling Allowance or when rations in kind are issued.

Scale of Meal Allowance—R.A.N.R. Staff.—(3) Members of the R.A.N.R. Staff shall not receive any allowance in lieu of rations when employed on duty ashore, except when engaged in time of war or emergency on continuous or other duty which necessitates absence from their usual place of residence over-night, and then only under the following conditions:—

(a) That no arrangements for victualling exist at the locality.

(b) That no arrangements can be made to enable the member to return to his place of residence for meals.

(c) That expenditure additional to the member’s ordinary expenditure has been incurred as the direct result of his inability to obtain, at his place of residence, the meals usually taken thereat.

(d) That the claim for payment is supported by a certificate signed by the District Naval Officer that the conditions governing payment, as prescribed in this sub-regulation, have been complied with.


(4) The amount payable in respect of meals obtained under the foregoing conditions shall be the actual amount necessarily expended, provided that payment for meals shall not exceed the following:—

79. District Allowances on the same scale as paid to members of the Commonwealth Public Service, and subject to the conditions prescribed in Public Service Regulations, shall be paid to all members of the Permanent Naval Forces in receipt of consolidated rates of pay while residing in any district or locality for which a District Allowance has been approved under Public Service Regulations 168 and 169.

When payable

80. District allowance shall be payable—

  (i) Where a member is absent from his district on recreation leave or accumulated recreation leave, whether or not his family remains in the district.

 (ii) Where a member is absent from his district on sick leave with pay and his family remains in the district, provided that where sick leave is granted on reduced pay a corresponding reduction shall be made in the allowance.

(iii) Where a member is absent on furlough and his family remains in the district, provided that where furlough is granted on half-pay a corresponding reduction shall be made in the allowance.

When not payable.

81. District allowance shall not be payable—

  (i) Where a member is absent on sick leave without pay.

 (ii) Where a member is absent on leave without pay.

(iii) Where stoppage of pay is effected on account of absence without leave or as a result of suspension for misconduct.


Upon transfer.

82. Officers transferred—

(1) Where a member is transferred from a non-allowance locality to a district-allowance locality the allowance shall not take effect until the member commences duty in the new position.

(2) Where a member is transferred from one district-allowance locality to another the allowance payable in the locality to which he is being transferred shall apply from the date the member finally leaves his old district; provided that where a member is granted accumulated leave between the time of leaving the old district and that of commencing duty in the new one, and the period of such leave is spent in a non-allowance locality, the Naval Board may direct the withdrawal of allowance for any portion of the period exceeding three weeks.

(3) Where a member is transferred from a district-allowance locality to a non-allowance locality the allowance shall cease from the date the member finally leaves his district.

PART VII.

Courts Martial and Courts of Inquiry.

Allowances to witnesses.

83. Where required to attend by the President of a court martial or a court of inquiry under the Naval Defence Act, witnesses may-receive remuneration for such attendance at the following rates:—

 

If resident at place of trial or within 5 miles thereof—for each day’s attendance.

Additional, if resident beyond 5 miles from place of trial—for each day necessarily absent, not including the days at court.

84. Courts Martial and Disciplinary Courts.—The allowances prescribed in King’s Regulations and Admiralty Instructions shall be paid to the Officiating Deputy Judge-Advocate or Clerk of Court, and to the Provost-Martial at Courts Martial.

PART VIII.

Medical Attendance, Medicines, and Dental Treatment.

(I.) Permanent Naval Forces (Sea-going).

85. (1) Members of the Permanent Naval Forces (Sea-going) shall be granted free medical attendance in accordance with the following sub-regulations.

(2) Arrangements may be made for admission and treatment of officers and men in a hospital with approved accommodation and the expense so incurred shall be defrayed by the Department.

(3) The term “hospital” referred to in these Regulations shall include any hospital—Naval, Military, civil (general or private), receiving home or ward, but shall not include Naval Sick Quarters.

In cases of venereal disease, however, the Sick Quarters at Garden Island shall be regarded as a hospital.

(4) Private Hospitals.—In cases where an officer or man elects to be treated in a private hospital, or by a private practitioner, a Naval hospital, or hospital with approved accommodation being available, or where a patient, being an invalid or otherwise, is discharged, at his own request, from such hospital or from the care of a medical officer against the advice of such medical officer, such member shall assume all financial responsibility consequent upon his action, and, before his request is approved, shall sign a written undertaking to that effect, which shall be transmitted to the Naval Board. During such treatment, the Naval Board may require the officer or man to be medically surveyed at any time.

(5) Surgical Operations.—When, in an emergency, operations are performed by civil surgeons upon officers and men at hospitals with which the Department has no arrangements as to fees, and when patients cannot travel to a recognised hospital, the sum allowed in payment of such operations shall be determined by the Naval Board, but shall not, unless in special circumstances, exceed £30.

86. Dental Treatment.—(1) Full dental treatment, at the expense of the Department, shall be allowed to officers and men. Such treatment shall include extractions, sealing of teeth, fillings (amalgam or cement), treatment of pyorrhœa and dentures.

(2) The supply of dentures shall be limited to one upper and one lower set, except in those cases where a new denture is considered necessary by the Medical Officer and the Surgeon Dentist owing to subsequent extractions. Ordinary repairs may be undertaken.


(II.) Permanent Naval Forces (Auxiliary Services).

Medical attendance—Permanent Forces.

87. (1) Medical attendance shall be granted to all members of the Royal Australian Naval Reserve Staff under the following sub-regulations and conditions hereafter defined:

(2) The term “medical attendance” throughout these Regulations means the professional advice and care during sickness or injury afforded in hospital or out of hospital by Naval Medical Officers appointed for the duty at the following Districts or Sub-districts:—

New South Wales 

Sydney, Newcastle;

Victoria 

Melbourne (including Williamstown), Geelong, Portland, Port Fairy;

Queensland 

Brisbane, Rockhampton, Cairns, Townsville, Bundaberg, Thursday Island;

South Australia 

Port Adelaide;

Western Australia 

Fremantle, Albany;

Tasmania 

Hobart, Launceston;

and at such other places as may be approved by the Minister. Members shall only be entitled to medical attendance at their own homes provided they reside within a radius of two miles from the Naval Staff Office.

(3) Medical attendance does not, however, include surgical operations, except those of a minor character, and which do not involve the administration of an anæsthetic.

(4) When necessary, arrangements may be made for admission and treatment in a general hospital approved of by the Naval Medical Officer.

(5) Medical attendance shall include supply of necessary drugs and dressings prescribed by the Naval Medical Officer in charge of the case. All medicines and dressings shall be supplied in accordance with the Government medical regulations of the respective States, and at Government contract rates. Where Government contracts do not exist, District or Sub-district Naval Officers may authorize Naval Medical Officers to arrange with local chemists for supply of medicines at a rate not exceeding 10s. per annum per member. These drugs shall be confined to those of the British Pharmacopœia or Squire’s Companion to the British Pharmacopœia; patent or proprietary medicines shall not be recognised.

(6) Members may be treated in a private hospital on the distinct understanding that the Department will only be liable for the payment of fees which would have been charged had the patient been treated in a general hospital, except under special circumstances, such as an injury in the performance of naval duty, which must at the earliest possible moment be submitted for the consideration of the Minister.


88. Dental Treatment.—Members of the R.A.N.R. Staff may, where circumstances permit, receive free dental treatment by the Surgeon Dentist so far as is necessary for the relief of pain only.

Royal Australian Naval College Staff.

R.A.N. College Staff.

89. Medical Attendance.—(1) Civilian Masters and Employees, permanently or temporarily employed at the Royal Australian Naval College, also their wives and families, may be granted free medical attendance under the conditions prescribed in regulation 87, sub-regulations (1), (2), (4) and (5). Such medical attendance shall form part of the duties of the Surgeon appointed for duty at the College.

The cost of medical attendance for confinements shall not be allowed.

Hospital Accommodation.—(2) Civilian Masters and Employees, their wives and families may, subject to the approval of the Commanding Officer, be admitted to the Hospital at the College. No charge for such accommodation shall be made in respect of the Masters and Employees, but a charge at the rate of 30s. per capita per week shall be made in the cases of wives and families. Such payments shall be brought to account as credits to Navy Revenue.

In admitting such cases into hospital, the Commanding Officer shall be responsible that, at all times, a sufficient number of beds is available for Cadet Midshipmen and other members of the Permanent Naval Forces (Sea-going).

Dental Treatment.—(3) Civilian Masters and Employees may, where circumstances permit, receive free dental treatment by the Dental Surgeon so far as is necessary for the relief of pain only, provided no extra expense to the Department is incurred.

PART IX.

Leave of Absence on Ground of Illness.

(I.) Permanent Naval Forces (Sea-going).

Sick Leave.

Sick leave—when allowable.

90. (1) Sick leave may be granted only to persons requiring convalescence after a severe illness, operation, illness due to service in the tropics or in an unhealthy climate, and then only upon the recommendation of a Naval Medical Officer.

(2) The period of Sick Leave on full pay is limited to 30 days, but in exceptional circumstances may be extended by the Naval Board to a period not exceeding 91 days, provided there is a reasonable probability of the person returning to duty.

Officers—Naval Board to approve.

(3) the case of Officers, prior Naval Board approval is to be obtained to any period of Sick Leave.

(4) Medical Officers are not to recommend Sick Leave for persons requiring medical attendance unless such attendance can be carried out by Naval Medical Officers without extra expense to the Department.

(5) Medical Officers are responsible that persons proceeding on Sick Leave clearly understand that the Department will not be responsible for the payment of expenses incurred for Medical and Surgical treatment whilst on Sick Leave, unless in such exceptional circumstances as may be specially approved by the Naval Board.

(6) Should persons while on Sick Leave be again taken ill, they are to return to their ship or depôt for treatment, or if unfit to travel they are to be dealt with under regulation 93.


Pay and Allowances During Illness.

91. Period of Full Pay.—(1) In peace time, members sent to approved hospitals on account of disabilities for which they are not themselves responsible, shall, if not previously invalided from the service, be borne on full pay for a period not exceeding six months. During wartime, the period of full pay under this regulation may be extended to eighteen months.

(2) In special cases, such as where a member is sent to hospital for treatment of any serious bodily injury received whilst serving, insanity resulting from an accident on duty, extraordinary exposure or exertion on service, the Naval Board may determine the period, in addition to that prescribed in sub-regulation (1), during which the member shall receive the full rate of pay.

92. Venereal Disease and other Disabilities due to Members’ Default.—(1) Members sick on shore or sent to hospital suffering from venereal disease, or from disabilities which are the result of the member’s own misconduct, carelessness or neglect, shall be placed on half pay at the expiration of 30 days and cease pay at the expiration of 91 days.

(2) All such members again checked sick on shore or in hospital, within fourteen days from the expiration of their previous period of sickness on shore or in hospital, shall be considered as being under continuous treatment, but only those days actually so checked shall be counted for the purposes of reduced pay in accordance with the terms specified in sub-regulation (1).

93. Sick Allowance.—(1) When on leave and under treatment of a private practitioner, in consequence of being unfit to travel, a sick allowance of 6s. per diem may be granted up to a limit of 91 days. In exceptional cases this period may be extended by the Naval Board.

(2) Sick allowance shall not be payable in the case of venereal disease nor in the case of disabilities which are the result of the member’s own misconduct, carelessness or neglect.

(3) The Commanding Officer may, on the recommendation of the Medical Officer, approve of the payment of sick allowance, up to a limit of 30 days, without reference to the Naval Board. All payments shall be supported by a certificate from the Medical Practitioner who attended the case setting out the nature of the disabilities and the period for which the member was under treatment and unfit to travel. Payment shall be made on voucher through the cash account.

(4) Sick allowance shall cover cost of lodging, rations and medical attendance, and the Accountant Officer shall certify, in the body of each voucher for payment of the allowance, that neither ration nor lodging allowance has been credited to the member on the ship’s ledger for the period during which sick allowance was payable.

(5) The Department shall not be responsible for the account of the medical practitioner called in on such cases.

(6) Sick allowance, being for the purpose of insuring medical care of men whilst absent on leave and for their speedy return to their ship, shall be entirely subject to the decision of the Commanding Officer and of the Naval Board, who will take into consideration all the circumstances of the case. During treatment, a Naval Medical Officer may inquire into or take over direction of the case.


94. Private Hospitals.—In cases where an officer or man elects to be treated in a private hospital, under the conditions prescribed in regulation 85, sub-regulation (4), the period of full and of half pay shall be determined by the Naval Board according to the circumstances of each case, but shall, generally, not exceed 91 days.

95. Allowances.—(1) Married and Dependant allowances shall be paid continuously during sickness, from whatever cause arising, when full or half pay is paid; but when a member is placed on half pay the provisions of regulation 35, sub-regulations (12) and (13), in regard to allotment of proportion of pay shall apply to the reduced pay.

(2) Whilst undergoing hospital treatment at Government expense, allowance in lieu of rations, or of quarters, shall not be payable. When undergoing private treatment, no allowance in lieu of rations and quarters shall be payable except as prescribed in regulation 93, sub-regulation (4).

96. Reduced Pay.—Half pay during illness shall consist of half the substantive and non-substantive rates of pay received by or credited to the member at the date of being placed on reduced pay. Married or Dependant allowance, if previously paid, shall, however, continue to be credited in full, subject to the provisions of regulation 95.

97. Deferred Pay.—No reduction shall be made in deferred pay in respect of any period during illness when reduced pay is drawn or of sick leave granted on reduced pay.

(II.) Permanent Naval Forces (Auxiliary Services).

Leave of absence.

98. Any member absent from duty on the ground of illness must notify his Commanding Officer, and furnish a medical certificate accounting for his absence.

D.N.O. may grant one month as portion of scale in regulations 100 and 102.

99. District Naval Officers may grant leave of absence, on full pay, on the ground of illness in cases in which such leave does not exceed one month in any triennial period provided the conditions and periods laid down in succeeding regulations are not exceeded.

100. In cases of continued sickness or ill health, the Naval Board may, on production of satisfactory evidence, grant extended leave, not exceeding three months, in accordance with the following schedule:—

101. In exceptional cases, the Minister may take any special circumstances into consideration, and vary the scale of leave, provided that in no case shall the leave granted exceed three months on full pay.


102. Where in cases of illness any member who has received leave of absence for three months is not so far recovered as to be able to resume his duties, further extensions of leave may be granted, with the approval of the Governor-General, in accordance with the following schedule; provided that on each extension of leave the applicant shall be subjected to medical examination:—

103. In exceptional cases, special circumstances may be taken into consideration, e.g., where a member in discharge of his duty sustains injuries of such a nature as to incapacitate him for all duty, this scale may be varied; provided that in no case shall full pay be allowed for a period exceeding nine months in addition to leave granted by the Naval Board on full pay.

104. Triennial Period.—(1) Sick Leave allowable under regulations 99, 100 and 102 may be granted in one or more periods, but the aggregate amount of leave provided for in the schedules is intended to cover a period of three years, commencing from the date of first absence on Sick Leave.

(2) The second or any subsequent triennial period of Sick Leave shall commence on the date of the first absence on Sick Leave following the date upon which the previous triennial period expires, and, for the three years thus commencing, the full amount of leave provided in the schedules according to length of service may again be allowed.

105. Leave of absence on account of injuries sustained when in the discharge of duty shall be dealt with as prescribed in these Regulations, but such leave shall not be counted as a portion of the leave which may, under these Regulations, be granted to an Officer, Petty Officer, or man, on account of illness.

106. If any member is absent from duty on account of illness, and such absence has extended beyond three months, he shall not be permitted to return to duty unless and until it is certified that he is medically fit to resume work.

107. When extended leave is granted other than on full pay, the rate paid for Sundays and holidays shall be the same as that allowed for the period of leave.


PART X.

Furlough.

108. Furlough.—(1) When a person has continued in the service of the Commonwealth under the provisions of the Defence or Naval Defence Acts for at least twenty years, the Governor-General may grant to him, on the recommendation of the Naval Board, leave of absence for a period not exceeding twelve months on half-pay, or six months on full pay.

Previous service in State or Commonwealth.

Previous Service.—(2) Where a person has become transferred or appointed from any position of a permanent nature under the State or Commonwealth to a permanent position in the service of the Commonwealth under the provisions of the Defence Act or Naval Defence Act, all continuous service of such person under the State or Commonwealth shall, for the purpose of furlough, be reckoned as service in the service of the Commonwealth under the provisions of the Defence Act or Naval Defence Act.

Furlough due on retirement or at death of member.

Furlough on Retirement or Death.—(3) Where a person not having been granted such leave of absence retires from the service after at least twenty years’ service, the Governor-General, on the recommendation of the Naval Board, may grant such person six months’ pay upon retirement, or, upon the death of any person who has continued in the service for at least twenty years, and has not been granted leave of absence under the provisions of this regulation, the Governor-General, on the recommendation of the Naval Board, may pay to the dependants of such deceased person a sum equivalent to six months’ pay of such person. Provided that where any such person has been reduced in position or salary through misconduct, such misconduct shall be taken into consideration in determining whether the whole or any portion of the prescribed leave of absence may be granted, or, in the event of retirement or death of any such person, whether payment may be made under the conditions prescribed herein, and as to the terms of such payment.

Scale leave when not eligible for furlough.

109. Extended Leave when not eligible for Furlough.—(1) The Governor-General may, on the recommendation of the Naval Board, grant to any person of satisfactory service who is not eligible for the furlough prescribed in regulation 108, leave of absence with full pay as follows:—

Provided that such person has attained the prescribed age for retirement or will attain the prescribed age for retirement on or before the expiration of such leave of absence.

Payment may be allowed in lieu.

Payment in lieu of Extended Leave.—(2) In lieu of such extended leave the Governor-General may, on the recommendation of the Naval Board, grant to the person a sum equivalent to


his pay for such period of leave, or, in the event of the death of any person who was eligible for, but had not been granted, the leave prescribed herein, may authorize payment to the dependants of such deceased person of a sum equivalent to the pay of such person for the period of leave which he could have been granted under this regulation.

Meaning of pay in Sea-going Forces.

110. In the case of persons on sea-going rates of pay, pay shall include only active and deferred pay and allowances of a permanent character in the nature of pay.

PART XI.

Miscellaneous.

I. Postage and Telegrams.

111. (1) The correct amount of postage shall, in all cases, be determined before letters and packets are despatched, and no unnecessary papers are to be sent through the post. The cost of such postage shall be defrayed by means of postage stamps marked “O.S.,” which shall be obtained on purchase from the Deputy Postmaster-General.

(2) Except in very special cases, large files of papers shall not be transmitted through the post. Book or packet post must, as far as possible, be utilized for returns, files or packages, so as to insure the cheapest rate.

(3) In transmitting correspondence through the post, care should be taken that any documents sent separately as “Commercial papers” or “Packet post” are posted at the same time.

Telegrams.

Telegrams.

112. (1) Telegraphic communications must be limited to messages of urgency on the public service, and recourse shall only be had to telegraphic communication in cases where the delay involved in the transmission of a letter by post would be prejudicial to the public service. Cablegrams shall not be sent to places outside the Commonwealth without authority from the Naval Board, and when approved, are to be transmitted viâ, Pacific route, whenever practicable.

(2) To be admitted as charges against the public, the sums expended must be vouched by copies of the telegrams sent, save in the case of telegrams sent personally by members of the Naval Board or such officers as may be approved by the Naval Board; and all such copies of telegrams shall be forwarded with the claim for reimbursement of stamps expended. The officer examining such claims shall bring under notice any telegrams which do not appear to be in strict compliance with the Regulations.


(3) The repetition of a message must be obtained as a “paid service message” through the delivering office, and not by means of a fresh message exchanged between sender and receiver, and all unnecessary wording must be avoided.

(4) In the event of any messages being improperly sent as on the public service, or of any messages not being of sufficient urgency or importance, the Officers or others sending them will be disciplinary responsible and be called upon to defray the cost.

(5) “O.S.” stamps shall not be used on telegraphic messages relating to leave of absence or private business or on any matter sent by Officers for the personal convenience of the senders or receivers. The cost of such messages shall not be admissible as a charge against the public.

(6) Where approval is obtained for private telegrams or cablegrams to be despatched to or on behalf of any persons, the cost of such messages must, in all cases, be paid by the senders prior to transmission. In those cases where private cablegrams or telegrams require a reply to be sent, the cost of such reply shall also be collected from the sender and the words “reply paid” included in the cablegram or telegram as the case may be. Where the cost of reply is to be collected from the addressee the words “collect reply” should be added to the message. A record of all private cablegrams and telegrams is to be kept and produced for audit.

113. (1) Accounts shall be kept as per form below, in which the addresses of all letters and telegrams chargeable to the public shall be entered with the value of the stamps appended on each letter or telegram. These accounts shall be examined and audited periodically by the officer responsible for the expenditure, whose signature shall be affixed as a voucher for correctness.

(2) Officers in charge may call for postage books to check expenditure of stamps issued by them.

II. Loan and Sale of Stores and Supplies.

Sale of Postage Stamps.

114. (1) Accountant Officers are authorized to purchase a supply of ordinary postage stamps, from the public money in their charge, for sale to the Ship’s company.

As the purchase of postage stamps for sale in the Commonwealth is allowed to be made only by persons licensed by the Postmaster-General’s Department, the necessary application for a licence in favour of the Accountant Officer should be submitted to the Naval Board and, if approved, arrangements for the issue of the licence will then be made in Navy Office.

(2) The maximum stock of stamps for sale should be based upon the monthly reimbursement of the amount of stamps sold.

(3) Postage stamps purchased for sale shall be treated as public money in the Accountant Officer’s charge and included in all statements of public money on hand. No entries should be made in the Cash Account in respect of purchases or sales of such stamps.

115. (1) The authority under which condemned, unfit or damaged stores may be sold, or condemned, unfit, damaged or deficient stores may be written off, is contained in the Naval Account Regulations.

The Minister may approve of the sale, exchange or loan of other stores.

(2) All recommendations for the sale, exchange or loan of Government stores shall be submitted by memorandum to the Naval Board, accompanied by a schedule of the articles proposed to be loaned, exchanged or sold. Treasury Form 41 must not be used for this purpose, but when a sale has been effected the report of same shall be prepared in duplicate on Treasury Form 41 and forwarded in accordance with Naval Account Regulations.

(3) The above procedure shall not apply to the sale of small arms ammunition, rifles, spare parts, oil, flannelette, or to materials in connexion with the use and cleaning of small arms, or to firewood, the issues of which are governed by special regulation, but a statement of such sales on Treasury Form 41 shall be forwarded.

III. Annual Prizes for Shooting.

116. Prizes, as provided in King’s Regulations and Admiralty Instructions, may be allowed, subject to the conditions prescribed therein.

IV. Funerals.

Miscellaneous expenditure.

117. (1) An expenditure not exceeding Ten pounds may be authorized by District Naval Officers on funerals of members of the Permanent Naval Forces and members of the R.A.N. Reserve mobilized or enlisted for service in time of war or national emergency.

(2) Where it is proved to the satisfaction of the Naval Board that the actual necessary expenses incurred were in excess of £10, the Naval Board may approve payment of such further sum as may be considered reasonable.
