REGULATIONS UNDER THE NAVAL DEFENCE ACT 1910-1918.

I, THE GOVERNOR-GENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Naval Defence Act 1910-1918, to come into operation on and from the dates specified therein.

Amendment of Naval Financial Regulations.

(Statutory Rules 1912, No. 18, as amended to this date.)

1. The following alterations in title are to be made, where necessary, throughout the Naval Financial Regulations, as from 3rd October, 1918:—

2. Regulation 4 (e) is amended, as from. 17th July, 1919, by omitting the words “Value does not exceed £5” and inserting in their stead the words “original value of the stores struck off does not exceed £10 in any one month.”

3. Regulation 28 is amended—(1) by omitting sub-regulation (a), as from 4th May, 1918, and inserting the following sub-regulation in its stead:—

“28. (1) When the transfer of a member of the Naval Auxiliary Forces is effected, a transfer list, Form A.S.45, shall be completed, signed by the certifying officer and transmitted to the


Certifying Officer of the district or depôt, as the case may be, to which the transfer is made. Pay shall be adjusted to last fortnightly pay period only and not to actual date of transfer. The transfer list shall be attached to the voucher upon which the first payment of pay is made.

In the case of members enlisted or mobilized whose accounts are kept on a ship’s ledger, pay shall be credited on ledger to date of transfer and balance shown on transfer list as carried to next establishment for settlement in the usual course.

The date to which payment has been adjusted shall be indorsed on transfer list in all cases.”

(2) By omitting sub-regulation (b), as from 1st December, 1919, and inserting the following sub-regulation in its stead:—

“(2) The account for rail, steamer or other fare of the member transferred shall be rendered to and paid by the office or ship from which the warrant for such service was issued; but the member’s claim for travelling allowance and reimbursement of expenditure incurred consequent upon transfer shall be dealt with by the office or ship to which such member is transferred.”

4. Regulation 35a is amended, as from 1st January, 1918—

(1) By omitting the words “Naval Board” appearing in the first and second paragraphs and inserting in their stead the word “Minister” in each case.

(2) By omitting the words “of a mess” appearing in the second paragraph and inserting in their stead the words “of an officers’ mess”.

(3) By omitting the words “valuation of the furniture, &c., as approved by the Naval Board” in the third paragraph and inserting in their stead the words “official valuation”.

(4) By omitting the word “Payments” in the fourth paragraph and inserting in its stead the words “Percentage charges”.

5. Regulation 35b is amended, as from 1st July, 1918, as follows:—

(1) Omit from the second paragraph of sub-regulation (a) the words “direct that a lesser sum than 10 per centum of such person’s salary or wages shall be abated,” and insert in lieu thereof the words:—

“fix the rent to be charged to any person on a basis other than the foregoing,”.

(2) Add, at end of sub-regulation (c), the following:—

“Fractions of a pound shall be discarded in arriving at the amount to be deducted.”

(3) Sub-regulation (d) is renumbered (e).

(4) Add new sub-regulation (d) as follows:—

“(d) On and from 1st July, 1918, all officers and men on seagoing rates of pay, in occupation of official married quarters, shall pay such rent for the premises as is approved by the Minister. In such cases, the rent shall be charged in arrear, against the member’s account in the ship’s ledger at the end of each quarter, or, if the married quarters are vacated before the end of the quarter, on vacation of the premises.”


6. Regulation 40 is repealed, as from 1st January, 1918, and the following regulation is inserted in its stead:—

“40. The premiums payable under the preceding regulation shall be a charge against the votes of the Department and shall be paid to the credit of ‘Trust Fund—Guarantee Fund Account.’”

7. Regulation 42 (1) is amended as follows:—

(1) Sub-regulation (1) is amended—

(i) By omitting, as from 1st July, 1918, the rate of pay “6s.” as shown for midshipmen in columns headed “A. Executive “and” D. Accountant” and inserting in its stead the rate of “5s. in each case.

(ii) By inserting, as from 1st July, 1918, immediately after the rank of “Midshipman”, the rank of “Midshipman of 1 year’s service” with the rate of pay, “6s.”, in columns headed “A. Executive” and “D. Accountant”.

(iii) By omitting, as from 1st January, 1919, the words “as from 1st January, 1918” and inserting in their stead the words “as from 1st January, 1919.”

(iv) By omitting, as from 1st January, 1919, the complete scale of rates of pay and inserting the following in its stead:—

(2) Omit, as from 1st January, 1919, the word “Notes” immediately preceding sub-regulation (2).

(3) Sub-regulation (2) is omitted, as from 1st January, 1919, and the present sub-regulation (5) relating to the pay of chaplains inserted in its stead and renumbered “(2)” accordingly.

(4) Sub-regulation (2) is amended, as from 1st April, 1919, by omitting the words “24s. rate” at end of sub-regulation and inserting in their stead the words “pay at the rate of 29s. per diem.”

(5) Sub-regulation (3) is amended, as from 1st October, 1918, by inserting the words “Commissioned and Warrant Mechanician,” immediately after the words “Warrant Electrician”.

(6) Sub-regulation (3) is omitted, as from 1st January, 1919, and the following inserted in its stead:—

“(3) The Mechanical Branch (column ‘A’ of Table B) shall include the ranks of Artificer Engineer, Chief Artificer Engineer, Engineer Lieutenant and Engineer Lieutenant-Commander, Warrant Mechanician, Commissioned Warrant Mechanician, Warrant Shipwright and Commissioned Shipwright and Shipwright Lieutenant, Warrant Electrician, Commissioned Electrician, Warrant Armourer and Commissioned Warrant Armourer (Head Schoolmaster, Chief Schoolmaster temporarily), and officers promoted to the rank of Lieutenant and Lieutenant-Commander in their respective branches from the foregoing ranks.”

(7) Sub-regulation (4) is amended, as from 1st October, 1918, by omitting the words “Commissioned and Warrant Mechanician”.

(8) Sub-regulation (4) is omitted as from 1st January, 1919, and the following inserted in its stead:—

“(4) The Non-Mechanical Branch (column ‘B’ of Table B) shall include the ranks of Gunner, Chief Gunner, Gunner (T.), Chief Gunner (T.), Boatswain, Signal Boatswain, Chief Signal


Boatswain, Warrant Telegraphist, Commissioned Telegraphist, Warrant Wardmaster, Commissioned Wardmaster, Chief Master-at-Arms, Commissioned Master-at-Arms, Warrant Writer; Commissioned Writer, Warrant Victualling Officer, Commissioned Victualling Officer, Instructor in Cookery, Commissioned Instructor in Cookery, and officers promoted to the rank of Lieutenant and Lieutenant-Commander in their respective branches from the foregoing ranks.”

(9) Sub-regulation (7) is amended, as from 1st January, 1919, by omitting the whole of the first and second paragraphs and inserting in their stead the following:—

“(7) Commissioned Warrant and Warrant ranks shall receive an increase of 4d. per diem every two years, up’ to and including ten years, and Lieutenant rank (promoted from Warrant Officer) 6d. per diem every two years up to and including six years.”

(10) Add, as from 1st October, 1918, new sub-regulation (11) as follows:—

Temporary Officers.

“(11) Officers appointed for temporary service shall be paid at the same rates (including increments for service) as permanent Seagoing Officers but deferred pay shall be paid in cash with the active pay.”

8. Regulation 42 (II.) is amended as follows:—

(1) Sub-regulation (1) is amended—

(i) By inserting, as from 1st October, 1918, in the first column immediately after and bracketed with the word “Shipwrights”, the word “Dental Mechanics”.

(ii) By inserting, as from 1st October, 1918, the following, in the last column and in line with the pay of Mechanicians:—

(a) And three further increments of 3d. per diem to Band ratings at 6, 9, and 12 years. (b) 3rd Class, under 12 months. (c) 3rd Class, over 12 months. (d) 2nd Class, irrespective of relative rating.

(2) Add, as from 1st July, 1918, new sub-regulation (4a) as follows:—

“(4a) Ratings re-entering the service shall not count their former service towards progressive pay when the period of absence has exceeded five years, except in such special cases as may be approved by the Naval Board.”

(3) Sub-regulation (7) is amended—

(i) By omitting, as from 1st July, 1918, the word “seagoing “in the fourth line.

(ii) By omitting, as from 1st July, 1918, the words “to R.A.N. sea-going service” in the last line and inserting in their stead the words “of service on sea-going rates of pay”.

(iii) By omitting, as from 1st April, 1919, the words “other than those on consolidated rates of pay” from the third line.

(iv) By inserting the words “Chief Petty Officers,” immediately before the words “Petty Officers” in the first and fifth lines.

9. Regulation 43 (I.) is amended as follows:—

(1) Sub-regulation (2) is amended—

(i) By omitting, as from 1st July, 1918, the words “one year after” in the third and fourth lines and inserting in their stead the words “the day following the date of”.

(ii) By omitting, as from 1st October, 1919, the words “8d.” and “6d.” and inserting in their stead the words “9d.” and “8d.” respectively.

(2) Sub-regulation (3) is amended—

(i) By omitting, as from 1st July, 1918, the words “Temporary Surgeons” and inserting in their stead the words “Officers appointed for temporary service”.

(ii) By omitting, as from 1st July, 1918, the words “In such cases uniform allowance will not commence until one year after promotion, or appointment, as the case may be”.

(iii) By omitting, as from 1st January, 1919, the following words:—

“Commissioned Officers on first joining, £40 (except Chaplains, or Officers appointed for temporary service, £25); Warrant Officers and Paymaster Midshipmen on first joining or on promotion to that rank, £25

(3) Sub-regulation (7) is amended, as from 1st January, 1918, by omitting the words “In lieu thereof.”

(4) Add, as from 1st September, 1918, new sub-regulation (7a) as follows:—

“(7a) Clothing Gratuity on Discharge.—During the currency of the war and for such period afterwards as the Naval Board may determine, an allowance in cash or of clothing in kind to the value of 30s. shall be granted to each rating dressed as a seaman, on discharge from the Sea-going Forces. The conditions prescribed in Admiralty Monthly Order 2772 of 1918 shall govern all payments or issues made under this sub-regulation.”


(5) Sub-regulation (10) is amended—

(i) By omitting, as from 1st April, 1919, the whole of this sub-regulation and inserting in its stead the following:—

“(10) Rations.—Rations shall be supplied, subject to such regulations as may be prescribed by the Naval Board. An allowance in lieu of rations shall be paid at the rate of 2s. 6d. per diem.”

(ii) By adding, as from 1st July, 1919, the following at end of sub-regulation:—

“The allowance in lieu of rations shall not be paid to parties of twelve or over, when working together on detached duty and able to form a mess.”

(6) Sub-regulation (11) is amended, as from 1st July, 1919, by adding the following at the end of sub-regulation:—

“Officers and men in receipt of Lodging Allowance shall not be credited with same when on leave for periods exceeding four days.

16. Regulation 45 is repealed, as from 1st January, 1918, and the following new regulation inserted in its stead:—

Victualling.

“45. (1) Except when otherwise ordered or approved by the Naval Board, the system of messing shall (except for officers) be that known as the ‘General Mess’ system, and the Accountant Officer shall be responsible that the average value of rations issued shall not exceed the daily rate fixed by the Naval Board, and that all accounts are kept in the prescribed forms.

(2) The Accountant Officer shall be responsible for the maintenance of an adequate stock of provisions on board, for their being in good condition when received, and for the issue, in order of age and condition, and for the periodical inspection necessary to maintain such provisions in good condition. He shall see that provisions are weighed and surveyed on arrival on board, as laid


down in the King’s Regulations. The minimum stock to be carried in peace time will be thirty days’ sea-going rations, viz.:—biscuit, flour, preserved meat, potatoes or preserved vegetables, sugar, chocolate, tea, milk, &c., and generally the Accountant Officer shall see that his Department is in all respects, and always, sufficiently stocked for the ship to be able to keep the sea for thirty days. To assist the Accountant Officer in regulating the requisite sea stocks, particularly of fresh provisions, the Commanding Officer shall, as far as is practicable, see that the Accountant Officer is informed of the probable number of days for which stocks should be carried.

(3) The Accountant Officer shall take every reasonable step to insure and maintain, within his province, the comfort of the crew, and shall submit to the Commanding Officer, prior to adoption, any recommendations necessary to this end. He shall also submit to the Commanding Officer a weekly bill of fare for the men.

(4) Officers shall draw the Ration Allowance in cash, subject to such regulations as may be prescribed by the Naval Board. Petty officers may have the option of either drawing the allowance or of joining the general mess. If they exercise the latter option it must be for a period of not less than one full quarter, and not be for the purpose of covering intervals when the vessel is operating in isolated waters.

(5) Allowance in lieu of rations shall be credited, in the ship’s ledger, to officers and men only when the period of absence of leave exceeds forty-eight hours, but shall not be payable to persons proceeding on week-end leave on Friday returning a.m. on Monday.

(6) As a general rule, under the system of victualling referred to in sub-regulations (1) and (14), no debit balance in the General Mess Account shall be permitted at the end of the quarter, except with the approval of the Commanding Officer, who shall represent the full circumstances of the case to the Naval Board, and in such eases every effort, consistent with the proper victualling of the general mess, shall be made in the following or succeeding quarters to eliminate any accumulated debt. Credits or debits shall be carried forward from quarter to quarter. In exceptional circumstances, such as on relief, or on paying of, the Naval Board may, on production of satisfactory evidence, release the Accountant Officer of, a part, or the whole, of the responsibility incurred.

(7) A report shall be prepared by the Accountant Officer at the end of each quarter, and forwarded by the Commanding Officer to the Naval Board, showing the following:—

(a) Total number victualled in general mess.

(b) Total allowance due.

(c) Value of provisions used.

(d) Debit or credit balance.

(e) Detailed explanation as to difference.

(8) A statement of numbers victualled and amount of credit or debit to date shall be handed to the Commanding Officer weekly, when the weekly reports of other heads of Departments are made.

(9) The signature to all payments of mess savings shall be that of the bonâ fide caterer of the mess.


(10) The Accountant Officer shall see that all accounts for provisions are paid, and outstanding matters settled, before leaving a port. Temporary receipts for supplies shall be given to contractors, and these shall be returned with final account for comparison, before payment is made, with the orders given and with the daily abstract of provisions received. Orders shall be signed by an officer, and any alterations after signature shall be legibly and distinctly initialed with a signed explanation on back of order (when amended by any person other than the officer signing the original order).

(11) When provisions are issued in exchange for sound provisions accumulated by messes, a running statement shall be kept and adjustments made after a general issue has been made, but never at intervals longer than a week.

(12) At the end of each quarter, a statement shall be forwarded to the Royal Edward Victualling Yard showing total consumption of the various items stocked by the Victualling Yard, for estimation of future requirements.

(13) Whenever possible such articles must be demanded from a Naval Victualling Yard on all occasions. When articles stocked by the Victualling Yard are obtained from other sources, a certificate should be given on the face of the purchase voucher stating why it was not practicable to obtain them from the Victualling Yard.

(14) To as far as possible equalize the conditions under which the general mess is carried on in H.M.A. Ships and Shore Establishments, and also to enable a ready comparison to be made of the degree of efficiency of the general mess in each vessel, the practice of charging fixed issuing prices (irrespective of the original cost) for certain essential fresh provisions shall be followed. These articles and the prices to be charged the general and repayment messes, with any subsequent additions or alterations, shall be circulated from time to time in Navy Orders. Periodical fixed issuing prices shall also be adopted for Victualling Yard stocks. All other articles, the prices of which are not specially provided for, shall be issued and charged at cost price. All purchases of provisions shall be subject to such regulations as may be prescribed from time to time by the Naval Board in Navy Orders.

(15.) Except to meet the immediate requirements on arrival at any port, three competitive tenders shall be obtained on the established form for all supplies and such tenders and any remarks thereon attached to the cash voucher. Where such tenders cannot be obtained an explanation shall be attached to the cash voucher.”

17. Regulation 46 is repealed, as from 1st January, 1918, and the following new regulation inserted in its stead:—

“Ship’s Accounts.

46. (1) Ledger—Pay and allowances, other than travelling, of all Officers, Petty Officers, and men (sea-going) shall be shown in the ship’s ledger, which shall be kept in duplicate, in accordance with ‘Naval Account Regulations.’

The address of all Officers and men shall be noted in ‘Remarks’ column of ship’s ledger on discharge to the shore.


(2) Second Class Conduct.—The total daily pay of men in the second class for conduct shall be credited on the ship’s ledger at the full rate of pay, and a charge of one-sixth shown in the ‘Fines’ column and brought to account as a fine. This deduction refers only to active pay and non-substantive allowances. Deferred pay, married allowance, and allowance in lieu of rations, and allowances of a temporary nature, such as torpedo-boat destroyer pay and lodging allowance, shall not be subjected to this deduction. While any rating is thus paid, the words ‘2nd class for conduct’ shall be noted in red ink after his rating on the ship’s ledger, transfer lists, and other documents, and the instructions laid down in the King’s Regulations and Admiralty Instructions shall be fully observed.

(3) Cells, Detention.—In all cases where ratings are undergoing punishments enumerated in regulation 44 (I.) sub-regulation (8) they shall be shown as checked to cells or detention as the case may be. Ratings undergoing such punishments shall not be borne for pay, nor the pay shown as mulct.

(4) Men absent on Sailing.—Arrangements shall be male, as the circumstances may require, by Commanding Officers in regard to the certificates and effects of men left behind at any port on sailing and in the event of difficulty arising owing to the absence of the necessary papers or information, the officers concerned shall be held responsible.

No men shall be discharged to another ship, or left behind on sailing, without pay papers or an explanation in lieu, and such other information or notice to the responsible authorities as may be desirable.”

18. Regulation 47 (I.) is amended, as from 1st October, 1918, as follows:—

(1) Sub-regulation (4) is amended—

(i) By omitting from, the second line the word “be paid at the rate of 25s. per diem, and”.

(ii) By omitting all words appearing after the words “Regulation 43 (I.)” in the last line of this sub-regulation.

19. Immediately after regulation 47 (II.) insert, as from 1st January, 1919, new regulation 47 (III.), as follows:—

“Re-engagement Gratuity.

47. (III.) (1) A cash gratuity of £25 shall be paid to all ratings of the Permanent Sea-going Forces who, on and after 1st January, 1918, complete an engagement of not less than five years in the Royal Australian Navy, and re-engage to serve for a further period of five years as from 1st January, 1919, or later date. Such ratings shall also be granted one month’s re-engagement leave on full pay.

(2) On and after 1st October, 1919, such gratuity shall be limited to ratings who engage to complete twelve years’ service, viz.:—Re-engage for a further period of five years after completing seven years man’s service, or for a further period of seven years after completing five years man’s service.


(3) The foregoing sub-regulations shall apply to Royal Australian Navy ratings including ex-Royal Navy ratings only, but shall not be applicable to Royal Navy ratings loaned to the Royal Australian Navy who may re-engage in the Royal Navy whilst lent to the Royal Australian Navy. In the case of ex-Royal Navy ratings, time served in the Royal Australian Navy only shall count towards qualifying service for the re-engagement gratuity and leave.

(4) The full amount of the gratuity and leave shall be granted only in cases where the ratings’ service is continuous. A reduced cash gratuity of £10 shall be granted to ratings who re-engage, in accordance with the above, within a period of six months from the date of discharge from the Permanent Sea-going Forces, but re-engagement leave shall not be allowed in such cases. Where the period of absence from the Permanent Sea-going Forces, in any case, exceeds six months, no gratuity shall be payable on re-engagement.

(5) Time-expired’ ratings who had re-engaged prior to 1st January, 1919, and have subsequently executed a revised engagement to serve for a period of five years as from 1st January, 1919, may be granted the gratuity and leave, or the reduced gratuity, as the case may be, provided such new engagement covers a minimum period of twelve years man’s service.

(6) Ratings entered for the period of the war, who have not completed five years’ service, but otherwise comply with the foregoing, shall be eligible for the gratuity.”

20. Regulation 49a is amended, as from 1st January, 1918, by adding, immediately after the second paragraph, new paragraph as follows:—

“Clothing gratuity balance at credit at date of desertion, under regulations in force prior to 1st January, 1918, shall not be re-credited to the member’s account on or after 1st January, 1918, if subsequently recovered from desertion.”

21. Regulation 49b is amended, as from 1st January, 1918—

(1) By omitting the words “Petty Officers, seamen, and others below the rank of Warrant Officer who are entered or who re-engage on or after 1st December, 1912, shall be permitted” and inserting in their stead the following:—

“Petty Officers and other ratings may, in peace time, be permitted”.

(2) By omitting the following words and figures:—

“(d) After re-engagement—

(1) Up to three years’ service since..........................

£12.

(2) Over three years’ service..............................

£8.”

and inserting in their stead the words and figures “(d) After re-engagement, £20”.

22. Regulation 50 (1) is amended, as follows:—

(1) Add, as from 1st July, 1918, the following, immediately after the words “R.A.N. Radio Service” in the second line of sub-regulation (1):—

“Naval Instructor Staff, R.A.N. College”.

(1a) Add, as from 1st November, 1919, immediately after the words “Petty Officers”, in clause (iii) paragraph (a) of sub-regulation (4), the words “and other ratings”.


(2) Omit, as from 1st November, 1918, paragraph (b) in sub-regulation (5) and insert in its stead the following:—

(b) Increments shall be payable as from the date the actually fall due.”

(3) Add, as from 1st July, 1918, at end of sub-regulation (5) the following:—

“(c) ‘Acting’ time served in a rank or rating shall not count for purposes of increments of pay.”

23. Regulation 68 is repealed, as from 1st January, 1918, and the following inserted in its stead:—

“Compensation for Injuries.

68. Assessment.—(1) Compensation may be recommended by a Board consisting of three medical officers appointed to inquire into the case of any member of the Permanent Forces who is retired or discharged on account of wounds or injuries received, or disease contracted due to service, provided the wound, injury, or disease was not due to the member’s default. The medical officers selected shall be the most senior available. When three medical officers are not available, two senior medical officers may form the Board. The compensation shall be according to the following scale:—

(a) The maximum amount.

(b) Three-quarters of the maximum amount.

(c) One-half of the maximum amount.

(d) One-quarter of the maximum amount.

(e) One-eighth of the maximum amount.

(f) One-sixteenth of the maximum amount.

(2) The maximum amount shall be a sum equivalent to three years’ pay, including any allowance in cash or kind for quarters, clothing and rations at the rate received by or allowed to the member or valued at in these Regulations at the date of his retirement or discharge. The maximum amount shall only be awarded in case of total disability to earn a livelihood. In case of partial disability, the compensation shall be less than the maximum amount and shall be fixed in accordance with the scale, so that the amount awarded shall be proportionate to the degree of disability of the member, as may be determined by the Naval Board.”

24. Regulation 69 is repealed, as from 1st January, 1918, and the following inserted in its stead:—

“69. Widows and Families.—Compensation may be recommended by a similar Board of Medical Officers to that prescribed in regulation 68, sub-regulation (1), for the case of the widow and family of any member of the Permanent Forces who is killed when on duty, or dies of any disease contracted due to the service, if the death or disease was not due to the member’s default. The amount of compensation awarded shall not exceed three years’ pay, as defined in sub-regulation (2) of regulation 68 above, at the rate valued at in these Regulations, or received by, or allowed to, the member at the date of his death. No claim for compensation shall be considered unless it is made within twelve months after the death of the member.”


25. Regulation 77 is amended as follows:—

(1) Add, as from 1st February, 1919, new sub-regulation (37a) as follows:—

“(37a) Allowance where Official Quarters or Private Residence is not Available.—Where a person, upon transfer, cannot enter into occupancy of quarters or private residence through unavoidable delay in transmission of furniture and household effects, or for any other reason approved by the Naval Board, and the person must therefore reside, for the time being, with his family at an hotel or other house of accommodation, the Naval Board may approve of payment to such person of travelling allowance for a period not exceeding fourteen days as from date of his arrival; provided that the maximum amount payable shall not exceed the ordinary daily rate of travelling allowance for the first seven days and half of the ordinary daily rate for the other seven days or portion thereof.”

(2) Add, as from 1st January, 1919, at end of sub-regulation 49, new sub-regulation (49a) as follows:—

“(49a) Notwithstanding the provisions of sub-regulation (49), officers and men, on first taking up appointment in the Royal Australian Naval Auxiliary Services after long service afloat in the Permanent Sea-going Forces, may, on the approval of the Naval Board, be paid transfer and removal expenses, as prescribed in sub-regulations (52), (53), and (54) respectively, when they reside in another State than that to which they are appointed, or on taking up first appointment and required to transfer their residence from the capital city to an outport within a State; provided that such appointments are made direct from the Sea-going Forces, or within a period of six months from the date of discharge from the Sea-going Forces.”

26. Regulation 81a is amended, as from 1st January, 1918, by omitting from the footnote at end of this regulation the words “see regulation 43 (VI.)” and inserting in their stead the words “see regulation 43 (V.)”.

27. The heading “Medical Attendance—Permanent Naval Forces” after Part X. of the Regulations is omitted, as from 1st January, 1918, and the following inserted in its stead:—

“Medical Attendance, Medicines and Dental Treatment.”

28. Immediately before regulation 82, the following new heading and regulations are inserted, as from 1st January, 1918:—

“(I.) Permanent Naval Forces (Sea-going).

81b. (1) Members of the Permanent Sea-going Forces shall be granted free medical attendance in accordance with the following sub-regulations.

(2) Arrangements may be made for admission and treatment of officers and men in a hospital with approved accommodation and the expense so incurred shall be defrayed by the Department.


(3) The term “hospital” referred to in these Regulations shall include any hospital—Naval, Military, civil (general or private), receiving home or ward, but shall not include Naval Sick Quarters.

(4) Private Hospitals.—In cases where an officer or man elects to be treated in a private hospital, or by a private practitioner, a Naval hospital, or hospital with approved accommodation being available, or where a patient, being an invalid or otherwise, is discharged, at his own request, from such hospital or from the care of a medical officer against the advice of such medical officer, such member shall assume all financial responsibility consequent upon his action and, before his request is approved, shall sign a written undertaking to that effect, which shall be transmitted to the Naval Board. During such treatment, the Naval Board may require the officer or man to be medically surveyed at any time.

(5) Surgical Operations.—When, in an emergency, operations are performed by civil surgeons upon officers and men at hospitals with which the Department has no arrangements as to fees, and when patients cannot travel to a recognised hospital, the sum allowed in payment of such operations shall be determined by the Naval Board, but shall not, unless in special circumstances, exceed £30.

81c. Dental Treatment.—(1) Full dental treatment, at the expense of the Department, shall be allowed to officers and men. Such treatment shall include extractions, scaling of teeth, fillings (amalgam or cement), treatment of pyorrhœa and dentures.

(2) The supply of dentures shall be limited to one upper and one lower set, except in those cases where a new denture is considered necessary by the Medical Officer and the Surgeon Dentist owing to subsequent extractions. Ordinary repairs may be undertaken.”

29. Sub-regulation (3) of regulation 81b is amended, as from 1st April, 1919, by adding the following at the end of the sub-regulation:—

“In cases of venereal disease, however, the Sick Quarters at Garden Island shall be regarded as a hospital.”

30. Immediately after regulation 81c, new heading as follows is inserted, as from 1st January, 1918:—

“(II.) Permanent Naval Forces (Auxiliary Services).”

31. Immediately after paragraph (f) of regulation 82, new regulation 82a as follows is inserted, as from 1st January, 1918:—

“82a. Dental Treatment.—Members of the R.A.N.B. Staff may, where circumstances permit, receive free dental treatment by the Surgeon Dentist so far as is necessary for the relief of pain only.”

32. Regulation 91 is amended, as from 1st January, 1918—

(1) By omitting the words “to the Authorizing Officer when claiming reimbursements for stamps expended. It shall be the duty of the paymaster to bring under the notice of the District Naval Officer” and inserting in their stead the following:—

“with the claim for reimbursement of stamps expended. The officer examining such claims shall bring under notice”.


(2) By inserting the words “disciplinarily responsible and be” immediately after the words “others sending them will be” in paragraph (b).

(3) By omitting the words “of the Naval Forces and its Departments” in paragraph (c).

(4) By inserting the words “or on any matter” immediately after the words “or private business” in paragraph (c).

33. Regulation 92 is amended—

(1) By inserting, as from 1st January, 1918, the words “with the value of the stamps expended on each letter or telegram” immediately after the words “shall be entered” in paragraph (a).

(2) By omitting, as from 1st January, 1918, the words “District Naval Paymasters” in paragraph (b) and inserting in their stead the words “officers in charge”.

34. The heading of Part XII. of the Regulations is amended, as from 1st January, 1918, by omitting the words “Permanent Forces’’.

35. Immediately before regulation 93, new heading and regulations as follow are inserted, as from 1st January, 1918:—

“(I.) Permanent Naval Forces (Sea-going.)

92a. Period of Full Pay.—(1) In peace time, members sent to approved hospitals on account of disabilities for which they are not themselves responsible shall, if not previously invalided from the service, be borne on full pay for a period not exceeding six months. During war time, the period of full pay under this regulation may be extended to eighteen months.

(2) In special cases, such as where a member is sent to hospital for treatment of any serious bodily injury received whilst serving, insanity resulting from an accident on duty, extraordinary exposure or exertion on service, the Naval Board may determine the period, in addition to that prescribed in sub-regulation (1), during which the member shall receive the full rate of pay.

92b. Venereal Disease and other Disabilities due to Members’ Default.—(1) Members sick on shore or sent to hospital suffering from venereal disease, or from disabilities which are the result of the member’s own misconduct, carelessness or neglect, shall be placed on half pay at the expiration of 30 days and cease pay at the expiration of 91 days.

(2) All such members again checked sick on shore or in hospital, within fourteen days from the expiration of their previous period of sickness on shore or in hospital, shall be considered as being under continuous treatment, but only those days actually so checked shall be counted for the purposes of reduced pay in accordance with the terms specified in sub-regulation (1).

92c. Sick Allowance.—(1) When on leave and under treatment of a private practitioner, in consequence of being unfit to travel, a sick allowance of 6s. per diem may be granted up to a limit of 91 days. In exceptional cases this period may be extended by the Naval Board.


(2) Sick allowance shall not be payable in the case of venereal disease nor in the case of disabilities which are the result of the member’s own misconduct, carelessness or neglect.

(3) The Commanding Officer may, on the recommendation of the Medical Officer, approve of the payment of sick allowance, up to a limit of 30 days, without reference to the Naval Board. All payments shall be supported by a certificate from the Medical Practitioner who attended the case setting out the nature of the disabilities and the period for which the member was under treatment and unfit to travel. Payment shall be made on voucher through the cash account.

(4) Sick allowance shall cover cost of lodging, rations and medical attendance, and the Accountant Officer shall certify, in the body of each voucher for payment of the allowance, that neither ration nor lodging allowance has been credited to the member on the ship’s ledger for the period during which sick allowance was payable.

(5) The Department shall not be responsible for the account of the medical practitioner called in on such cases.

(6) Sick allowance, being for the purpose of insuring medical care of men whilst absent on leave and for their speedy return to their ship, shall be entirely subject to the decision of the Commanding Officer and of the Naval Board, who will take into consideration all the circumstances of the case. During treatment, a Naval Medical Officer may inquire into or take over direction of the case.

92d. Private Hospitals.—In cases where an officer or man elects to be treated in a private hospital, under the conditions prescribed in regulation 81b, sub-regulation 4, the period of full and of half pay shall be determined by the Naval Board according to the circumstances of each case, but shall, generally, not exceed 91 days.

92e. Allowances.—(1) Married and dependent relatives’ allowances shall be paid continuously during sickness, from whatever cause arising, when full or half pay is paid; but when a member is placed on half pay the provisions of regulation 43 (1) sub-regulation (12) in regard to allotment of proportion of pay shall apply to the reduced pay.

(2) Whilst undergoing hospital treatment at Government expense, allowance in lieu of rations, or of quarters, shall not be payable. When undergoing private treatment, no allowance in lieu of rations and quarters shall be payable, except as prescribed in regulation 92c, sub-regulation (4).

92f. Reduced Pay.—Half pay shall consist of half the substantive and non-substantive rates of pay received by or credited to the member at the date of being placed on reduced pay. Married or dependent relatives allowance, if previously paid, shall, however, continue to be credited in full, subject to the provisions of regulation 92e.

92g. Deferred Pay.—No reduction shall be made in deferred pay in respect of sick leave granted on reduced pay.


36. Immediately after regulation 92g, new heading as follows is inserted, as from 1st January, 1918:—

“(II.) Permanent Naval Forces (Auxiliary Services).”

37. Regulation 98a is repealed, as from 1st January, 1918.

38. Regulation 103 is repealed, as from 1st January, 1918, and the following heading and regulation inserted in its stead:—

“Loan and Sale of Stores and Supplies.

103. (1) The authority under which condemned, unfit or damaged stores may be sold, or condemned, unfit, damaged or deficient stores may be written off, is contained in the Naval Account Regulations.

The Minister may approve of the sale, exchange or loan of other stores.

(2) All recommendations for the sale, exchange or loan of Government stores shall be submitted by memorandum to the Naval Board, accompanied by a schedule of the articles proposed to be loaned, exchanged or sold. Treasury Form 41 must not be used for this purpose, but when a sale has been effected the report of same shall be prepared in duplicate on Treasury Form 41 and forwarded in accordance with Naval Account Regulations.

(3) The above procedure shall not apply to the sale of small arms ammunition, rifles, spare parts, oil, flannelette, or to materials in connexion with the use and cleaning of small arms, or to firewood, the issues of which are governed by special regulation, but a statement of such sales on Treasury Form 41 shall be forwarded.

39. Regulation 104 is repealed, as from 1st January, 1918.

40. Regulation 106 is amended, as from 4th August, 1914, by adding the following at end of regulation:—

“and members of the R.A.N. Brigade mobilized or enlisted for service in time of war or national emergency.

Where it is proved to the satisfaction of the Naval Board that the actual necessary expenses incurred were in excess of £10, the Naval Board may approve payment of such further sum as may be considered reasonable.”

41. The Appendix to the Naval Financial Regulations specifying the rates of pay and allowances at 30th June, 1911, and the conditions governing payment of same, is omitted as from 1st January, 1918.
