PROVISIONAL REGULATIONS UNDER THE DEFENCE ACTS 19031904.

I, THE GOVERNORGENERAL in and over the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby certify that on account of urgency the following Regulations under the Defence Acts 19031904 should come into immediate operation, and make the Regulations to come into operation forthwith as Provisional Regulations.

Regulations for the Commonwealth Military Cadet Corps.

The regulations made by Statutory Rules 1907, Nos. 63, 81, 85, 87, and 121, and 1908, Nos. 9, 49, 52, 56, 59, and 72 are hereby repealed and the following Regulations are substituted therefor :

Under special circumstances, additional Companies, not exceeding two, may be approved by the Military Board. In such cases one additional Major may be added to the Battalion Staff (HeadQuarters).

Allowances.

R. 3. During each year the following allowances may be paid, subject to the amount being voted by Parliament, viz. :—

(a) Allowances to officers.

(b) Senior Cadets not attending School.

To be effective, Senior Cadets not attending school must, prior to the 30th June in each year, have attended at least eighteen drills, and completed the prescribed musketry course, or, in the case of those who have not served the full year, they must, after having been passed into the ranks, complete the full musketry course and attend drills at the rate of at least two per month.

(c) Senior Cadets attending School.

For each detachment certified as effective by the Officer Commanding Senior Cadets and approved by the District Commandant

To be effective 80 per cent, of each Detachment must, between 1st January and 31st December, have completed the musketry course laid down and attended 24 drills, or, in the case of those who have not served the full year, have completed the musketry course and attended at the rate of at least three drills per month.

The allowances under subparas, (b) and (c) may be paid to Battalion Commanders, or, subject to the approval of the District Commandant, to officers commanding detachments, and in the case of new detachments these allowances, subject to the approval of the District Commandant, may be paid as soon as possible after approval of formation by the Military Board.

Conditions governing payment of allowances.

R. 4. In order that the amounts laid down in the preceding paragraph may be claimed, the following conditions must be observed :—

Officers' Allowances.

(a) Senior Cadets not attending School.—Each officer appointed to a Detachment must provide his own uniform, of the approved pattern, and have been returned effective on the 30th June preceding the financial year in which payment is made. In the case of a new appointment, the officer must have been appointed to his Battalion, Company, or Detachment prior to the 30th June preceding the financial year in which payment is made.

(b) Senior Cadets attending School.—Each officer appointed to a Detachment must provide his own uniform, of the approved pattern, and have been returned effective on the 31st December, or, in the case of new appointments, have been appointed to their Battalion, Company, or Detachment prior to that date.


(c) The allowance of any officer or officers may be stopped or reduced at the discretion of the District Commandant, if in the opinion of the Inspecting Officer, the Battalion, Company, or Detachment is not in a satisfactory state.

(d) Officers in command of Battalions, Companies, or Detachments must keep a complete record of all drills and rifle practices held, and also the necessary books showing the amounts received and the expenditure incurred by them on behalf of their commands. These books must be produced at each official inspection.

(e) No payments will be made to Officers of Battalions, Companies, or Detachments which have been disbanded during the year, nor to any officer not connected with an effective Detachment.

Effective, Detachment, and Clothing Allowances.

(f) The Effective Allowance for Senior Cadets not attending school shall be applied to the supply and maintenance of Uniform, expenses incidental to musketry practice, drills, bands, camps and exercises, postage and telegrams.

(g) Detachment Allowances shall be applied to expenses incidental to musketry practice, drills, bands, camps and exercises, postage and telegrams.

(h) Clothing Allowance for Senior Cadets attending school shall be utilized for the supply of uniform of the authorized pattern, and for incidental expenses connected therewith, such as cleaning, repairs, alterations, &c. ; no portion of this allowance is to be diverted to any other purpose.

(i) Claims for Allowances must be rendered on the forms supplied by District HeadQuarters, and, before being paid, be countersigned by the Officer Commanding Senior Cadets. No claim will be paid without the authority of the District Commandant

No payment is to be made from the foregoing allowances to any Senior Cadet.

When a company consists of more than three detachments, one officer per detachment may be appointed provided the total establishment of officers of a Battalion is not exceeded.

Battalions shall be formed by grouping the Companies topographically, as far as possible, and in such localities as admit of efficient administration and drill.

Allowances.

R. 8. In each year an allowance (subject to the amount being voted by Parliament) may be paid to the following Officers, within the authorized Establishment: —

Amounts as under may be paid (subject to vote by Parliament) to each detachment certified as effective by the Officer Commanding Cadets, and approved by the District Commandant : —

Detachment allowances will be paid to Officers in charge of Detachments or, where there is no officer in command, to the Head Master, and will be devoted to the payment of expenses connected with musketry, bands, drills, camps, parades, postage and telegrams of the detachment, and must be duly accounted for by the officer in charge. No payment is to be made to any Cadet.

To be effective 80 per cent. of each detachment must, between the 1st January and the 31st December, have completed the musketry course laid down, and attended 24 drills, or, in the case of those who have not served the full year, have completed the musketry course and attended at the rate of at least three drills per month.

In the case of new detachments the above allowances, subject to the approval of the District Commandant, may be paid as soon as possible after the formation has been approved by the Military Board.

Conditions governing payment of allowances.

R. 9. In order that the above amounts may be claimed, the following conditions must be observed :—

(a) Each Officer must provide himself with uniform of the approved pattern, and have been appointed to his Battalion, Company, or Detachment, previous to 31st December.

(b) The allowance to any officer may be stopped or reduced at the discretion of the District Commandant if, in the opinion of the Inspecting Officer, the battalion, company, or detachment is not in a satisfactory state, and the Education Department will be informed. In the case of nonGovernment schools, the Head Master will be communicated with.

(c) Officers in charge of detachments must keep a complete record of all drills and rifle practices held and also the necessary books showing the amounts received and the expenditure incurred by them on behalf of their commands. These books must be produced at the halfyearly inspection.

(d) No payments will be made to officers of detachments which have been disbanded during the year, nor to any officer unconnected with an effective detachment.

(e) Claims for allowances must be rendered on the forms supplied by District HeadQuarters, and countersigned by the Officer Commanding Cadets before being paid. No claim will be paid without the authority of the District Commandant.

(f) In the event of an officer in command of a Detachment being transferred or removed, he shall render to his successor, or to the Head Master, a true and correct account of all vouchers, receipts, and expenditure up to date, together with the balance of allowances unexpended, before being relieved of his responsibility.


(g) Every officer in charge of a Detachment shall sign the approved document, making himself personally responsible for the disbursement of any allowance paid to him. In any case, however, in which it is estimated that a greater amount than 50 per annum will be drawn from Departmental Funds by any officer in command of a Detachment, such officer shall be guaranteed in the Fund established by, and in accordance with, Treasury Regulation No. 137. District Paymasters are responsible for the strict observance of this regulation, and that application is made to the Secretary, Department of Defence, to obtain approval of the Treasurer in each case.

Clothing allowance.

R. 10. Subject to the amount being voted by Parliament, an annual, allowance of seven shillings and sixpence for each effective Cadet within the establishment will be paid to Battalion Commanders, or, in cases approved by the District Commandant, to Officers in charge of Detachments. This allowance shall be utilized for the supply of uniform of the authorized pattern to Cadets, and for incidental expenses connected therewith, such as cleaning, repairs, alterations, &c.

No portion of this allowance is to be diverted to any other purpose nor is any payment to be made to a Cadet.

In the case of new detachments, the above allowance, subject to the approval of the District Commandant, may be paid as soon as possible after the formation has been approved by the Military Board.

First appointments.

R. 11. Officers will usually be first appointed on probation as Lieutenants. They must be over seventeen years of age. After six months on probation, commissions as Lieutenants will be granted on passing the examination for that rank.

Officers may be promoted, if a vacancy exists in the higher rank, and if they have passed the examination for such rank.

Supernumerary Officers.

R. 12. Officers, not exceeding two per company, may be appointed or transferred as supernumerary to establishment, pending a vacancy.

Unattached List.

R. 13. Officers holding substantive rank may be transferred to an Unattached List when unable to maintain an effective detachment, or to remain actively connected with the Corps.

Failing to return to active duty within three years, they will be retired.

R. 14. The power to reduce Noncommissioned Officers to a lower grade or to the ranks will be exercised by the Commanding Officer of the Battalion. The power of discharge, for misconduct, or other sufficient cause, will also be exercised by this Officer, but subject to the approval of the Officer Commanding the Senior Cadets or Cadets in each case.
